Resolution Accepting the Sanitary and Storm Sewer Improvements
for Woods Estates Phase 111
WHEREAS, Phase III of the Woods Estates subdivision in the City of Riverdale (hereinafter referred to as
"City") is the last and final phase of the development project; and,
WHEREAS, the sanitary and storm sewer improvements have been constructed throughout all phases of
the development, and those improvements in Phase I and Phase 11 have been accepted by the City in
previous resolutions; and,
WHEREAS, the City's engineering firm, MSA Professional Services, certifies that the sanitary and storm
sewer improvements in Woods Estates Phase I II have been constructed in substantial compliance with the
plans, specifications, plats, and other documents as submitted by the developer's engineering firm; and,
WHEREAS, per the Developer's Agreement, a maintenance bond in the amount of $2,000,000 was
required at the time of completion of the sanitary and storm sewer improvements in Woods Estates
Phase I II, and said maintenance bond was issued by KE Flatwork on December 19, 2022, when the work
was completed; and,
WHEREAS, the Planning and Zoning Commission has recommended acceptance of the sanitary and
storm improvements in Woods Estates Phase I II; and,
WHEREAS, the retention ponds and systems connected to those ponds will be owned and maintained by
the developer until the last phase of the subdivision is complete and are not made part of this resolution;
additionally, the public use parcels of the development are not a part of this resolution and are currently
owned and maintained by the developer.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF RIVERDALE, IOWA, AS FOLLOWS:
SECTION 1: The sanitary and storm sewer improvements for Woods Estates Phase III as described
above, having been constructed in substantial compliance with the plans, specifications,
and other documents, are hereby accepted.
SECTION 2. The City Clerk/Treasurer shall cause this resolution to be recorded with the Scott County
Recorder and shall supply certified copies to the developer and his attorney of record.
