The Meeting was called to order at 9 :00 A.M.
Upon Motion made by Vice Mayor LaPorte, seconded by Commissioner Armour, the
Commission approved the minutes of the Budget Workshop Meeting, August 13,
1981.
Upon Motion by Vice Mayor LaPorte, seconded by Commissioner Armour, the
Commission approved the minutes of the August 14, 1981 meeting.
Town Manager, William Gwynn, presented the monthly financial reports which are
made a part of the minutes. Mr. Gwynn stated that the Town Hall needs to redeem
a Water Fund Certificate temporarily to meet September expenses. At this time,
Mayor Koch asked Mr. Gwynn to report his findings concerning separate accounts
which matter had been raised by Commissioner Hunter at a previous town meeting.
Mr. Gwynn stated that an opinion letter from the Auditors was specific in that
the Town maintain separate enterprise funds for the water fund. Upon motion
made by Commissioner Armour, seconded by Commissioner Dixson, the Commission
approved the financial reports for the month of August, 1981.
Lt. Mahoney read the police report for the month of August; the report is made
a part of the minutes. Commissioner Armour voiced his concern of the numerous
false alarms and feels the Town should notify the people of the Alarm Ordinance.
Commissioner Hunter felt that the people should be informed of the Ordinance
through the Newsletter.
Commissioner Dixson then brought up the matter of the police contingency fund
for the 1981 -1982 budget, explaining that conditions might arise requiring the
possible use of these monies. Mayor Koch then asked if there were any further
comments on the budget, and then asked for the feelings of the people. After
hearing comments from various residents, it was decided that the budget would
be discussed in greater detail at the September 28th budget meeting. Commissioner
Dixson felt that there should be visual aids at that budget meeting.
John Randolph and Gene Caputo then told their findings concerning the amendments
to the zoning ordinances. Mr. Randolph stated that his findings were only in
draft form due to the fact that after there has been a first reading, the map
has to be reviewed. To date, the revised map has not been printed. After
discussion of the amendments to the zoning ordinances and the map, Commissioner
Armour suggested that the Commission should have a workshop meeting to discuss
the zoning ordinances in more detail. It was agreed to set a Workshop Meeting

for Thursday, September 17th at 4:00 P.M. The matters which would be discussed
at that time are the increases from 10,000 sq. ft. to 20,000 sq. ft.; changes
in the four zoning districts; sign restrictions and requirements and other
matters concerning the zoning changes. Commissioner Dixson suggested to the
Commission that after studying these amendments, they need to return their
findings to the Committee.
There were no further comments from the Commission and none from the audience.
At this time, Mr. Gwynn read a note to the Commission from the family of
John Whittemore acknowledging their thoughtfulness and sympathy and thanking
them for the flowers.
Commissioner Dixson moved for the adjournment of the meeting. All were in favor.

goals of the Town Commission in regard to proposed amendments to the Zoning
Ordinance wherein it was discussed that certain amendments should be
accomplished immediately with other amendments of a more extensive nature
to be considered by the Town Commission at a later time. The Commission then
decided to study in detail the rough draft of the zoning ordinance amendment
section by section. A copy of said Ordinance is attached hereto.
After much discussion among the Commission, they agreed on various items to be
j deleted or changed. Some of the items discussed included matters such as the
square footage, variances, lot requirements, setbacks, the recreational district
and the study of a new map. It was discussed that when the Ordinance was adopted,
changes could be placed in the Ordinance for the map.
Mayor Koch felt that the Commission should ask the people's opinion of re- zoning
by letters. If differences should arise concerning the re- zoning, then the
Commission would have to make the final decision.
After a discussion of professional and directional sign requirements and
restrictions, Commissioner Dixson stated that he would write the section con-
cerning the signs.
Mr. Randolph and Mr. Caputo stated that they would get together to make those
changes agreed on by the Commission Board and would bring the revised version
to the Committee, then to the Commission.

AMENDED MINUTES
OF THE SEPTEMBER 28, 1981
BUDGET HEARING

Clerk; James Greer, Chief of Police
The hearing was called to order at 5:01 P.M. by Mayor Koch.
Mayor Koch then stated that this meeting was called to discuss the
budget and millage for next year, and further stated that they could
only deal with this subject. Mr. Gwynn, Town Manager, would first
read the budget as presented, the Commissioners would then make
comments, additions or subtractions followed by comments from the
public.
Town Manager Gwynn then read the proposed budget.
Mayor Koch stated that Commissioner Dixson, the Police Commissioner,
would discuss the police portion of the budget. Commissioner Dixson
then discussed in great detail the previous problems of the Police
Department, the qualifications of Chief Greer and the range of
salaries from 1979 to 1981. He further discussed the performance of
the Police Department as to the decreases in crimes, increases in
solutions of crimes and improved safety control on A -1 -A. In
addition to discussing the proposed Police Department's budget,
Commissioner Dixson pointed out the many eliminations the department
made which, if included, would have further increased the budget.
In conclusion, he stated that he was very satisfied with the Depart-
ment and feels that the pay raise and budget are justified and
reasonable.
Commissioner Armour, Public Works Commissioner, then discussed the
budget for streets, easements and road repairs. He stated that the
Town would slurry the streets which means to clean up the streets and
topdress them with the monies appropriated for the roads. Commissioner
Armour said that there was really nothing to discuss in street ease-
ments, but that more repairs would be made to the streets with the
monies designated in the budget.
Commissioner Hunter then voiced his opinion of the Police Department
feeling that the Department was doing a very good job. The question,
however, was how much the Town could afford, which the Commission
would have to decide.

Budget Hearing
Vice Mayor LaPorte then stated that she felt the Commission was
centering too much on the Police Department for budget cuts.
Mayor Koch stated that he had negotiated a reduction for the fire
contract from $32,400 to $25,000. He also negotiated a new garbage
contract, a reduction from $12.00 per unit per month to $10.00 per
unit per month. An additional option for the Commission to decide
would be to provide for pickup services twice a week at $8.00 per
unit per month. The Commission voted for twice weekly pickup. By
these reductions, there would be a half mill taken off the budget.
Mayor Koch then asked if there were any comments or suggestions from
the public. After various comments and suggestions from the residents
concerning the budget and tax increases, Mr. Souder, speaking on
behalf of the Civic Association, stated that the Association felt the
Police Department was doing an outstanding job and that their budget
should not be cut for the next year, and thanked the Commission for
their efforts in improving the Police Department.
The Commission then discussed the loan with Barnett Bank.
Commissioner Armour felt that the loan should be paid as agreed by
the Town Commission at 72J interest. It was discussed that postpone-
ment of the loan would allow a reduction in millage. Mayor Koch,
Vice Mayor LaPorte, Commissioner Armour and Commissioner Hunter then
voted that the loan, at the 70 interest rate, be paid as scheduled.
Commissioner Dixson opposed.
Mayor Koch then proposed to cut a half mill from the budget and
further proposed a new millage of 6.4979 mills. Commissioner Hunter
moved that the millage be reduced to 6.4979 mills; Vice Mayor LaPorte
seconded the motion. Motion passed.
It was agreed by the Commission that after publication in the news-
paper of the Budget Hearing, a second Budget Meeting would be set
for October 10, 1981, for final approval of the budget and millage.
Mayor Koch stated that any changes made in the budget at that time
could only reflect decreases, not increases. A copy of the amended
proposed budget is attached as a part of the minutes.

for specified residential anrl- et}Ter uses, the Town of
Gulf Stream, Florida, is hereby divided into districts
of which there shall be four (4) known as:
a. "RS "-- Residential Single - Family District.
b. "R.M " -- Multiple- Family District.

C. "OR " -- Outdoor Recreational District.
d. "PC " -- Preservation Conservation District."
The boundaries of the districts are shown upon the map accompanying
this Ordinance and made a part thereof, and entitled "Zoning Map of
the Town of Gulf Stream, Florida," which map shall be amended to
conform to the districts referenced herein. The Zoning Map shall be
a part of this Ordinance as if such information set forth on the
map were fully described and set forth herein. The Zoning Map,
property attested by the members of the Town Commission signing this
Ordinance, the signatures of the Mayor and the Town Clerk, and
containing the corporate seal of the municipality, shall remain at
all times on file in the office of the Town Clerk.
Section 3. Section III -- Residence district "A" is hereby
amended as follows:
A. The title of Residence district "A" shall be amended
to read as follows:
"Section III - - "RS" Residential Single - Family District
B. Section III(A)(4) is hereby deleted as a permitted use
C. Section III(D)(1) is hereby amended to read as follows
"(D) Building site area required.
(1) The minimum building site area shall be one lot
or parcel of land twenty thousand (20,000 sq. ft.)
square feet in area for each single - family dwelling
unit."
D. Section III(I)(1) is hereby amended to read as follows
"Any private school now being conducted on lands
within the Town of Gulf Stream, Florida, classified
as "RS "-- Residential Single - Family District, may
continue to be used as such uader the provisions of
Section VII hereof, provided, however, that any
private school building, or other structure used in
connection with and as a part of and appurtenant in
the operation and maintenance of such private school,
• may be__altered and repaired from time to time as shal
be necessary for the effective opeartion and mainte-
nance of such private school."

G. Section IV(F)(6) shall be amended to read as follows:
"(6) Special exceptions: Single family residences
will be permitted to observe the setbacks set forth
for the "RS" Residential Single - Family District."
Section 6. Section V-- Business district- is hereby
Irepealed and eliminated in its entirety from the Zoning Ordinance.
Section 7. Section VA -- Outdoor recreational district
lis hereby amended as follows:
A. The title to said Section VA is hereby amended to read
as follows:
"Section V. "OR " -- Outdoor recreational district."
B. Section V(B)(2) is hereby amended to read as follows:
"(2) Club facilities for recreational and social
purposes."
Section B. A new zoning district is hereby established
land known as the "PC " -- Preservation /Conservation district which
district and section shall read as follows:
"Section VA. "PC " -- Preservation /Conservation district.
(A) Purpose and intent - -the purpose and intent of
this district is to establish and protect certain
areas which are composed of the habitats of endangere
species of wildlife, fish or flora, or which are
important habitats for the production of fish and
wildlife, or which are sites of historical, archae-
ological or botanical significance.

(B) Pe rmitted uses.' In a PC-- Preservation /Conserva-
tion district no building, structure or land and
water use shall be permitted except for one or more
of the following uses upon approval by the Town
Commission:
(1) Nature and foot trails;
(2) Cahoe trails; and
(3) Wildlife management performed by the
Game and Fish Commission of the State of
Florida.
(C) Special Exceptions Subject to Commission
Approval. When the Town Commission determines as
a fact, after the review of the application and
site development plans submitted therewith, that
the conditions and provisions of this Section and
all other applicable provisions of the Town's Zoning
Ordinance and other codes haie been met, and when
the proposed use or uses are consistent with good
zoning practice and are not contrary to the policies
of the Comprehensive Plan of the Town, the following
use shall be permitted:
(1) Parks and recreation areas operated by
the Town.

(D) Prohibited Uses and Activities. Any use which
has an adverse impact upon any invironmental habitat
or site causing the deterioration of the habitat or
physical altering thereof is prohibited. Intense
activity levels of the uses permitted herein without
due consideration of the compatibility of the activii
with the natural resources also prohibited. Any
alteration of the soils, vegetation or water level
beyond the minimum required to accommodate the uses
permitted is prohibited.
Section 9. Section VI-- General provisions is hereby
amended as follows:
A. Section VI(B) is hereby repealed and eliminated in
its entirety from the Zoning Ordinance. .
B. Section VI(E) is hereby repealed and eliminated in
its entirety from the Zoning Ordinance.
C. Section VI(F)(1) is hereby amended to read as follows:
"(1) The use of any property zoned as "RS" Residenti
Single- Family'District, or any building described as
as a residence, by a larger number of persons than
such property or residence is zoned for or designed
to accommodate, is hereby declared to be a violation
of this Ordinance.
D. Section VI(F)(2) is hereby amended to read as follows:
"(2) It shall be unlawful for the owner, lessee or
other person in the possession or control of any
property zoned as "RS" Residential Single - Family
District, or of any building designe as a residence

Section 10. Section VII -- Non - Conforming uses is hereby
amended to provide that references to Residence District "A" and
Apartment and Residence District "C" be amended to reference "RS"
Residential Single - Family District and "RM" Residential Multiple
Family District, respectively.
Section 11. Section X- -Plats is hereby amended as
follows:
A. All references in Section X to Residence District "A"
and Apartment and Residence District "C" shall be amended
to reference "RS" Residential Single - Family District and
"RM" Residential Multiple Family District, respectively.
B. Section X(A) is hereby amended at the second para-
graph to read as follows:
"(A) All plans, re- plans, plats or re -plats of lands
hereafter laid out within any area of the Town locat
in "RS" Residential Single - Family District, or in
It "RM" Residential Multiple Family District shall
provide for lots or tracts of land having a frontage

of at least one hundred (100 ft.) feet on a dedicated
street, road or avenue, and a land area of at least
twenty thousand (20,000 sq. ft.) square feet for each
lot or tract shown on said plat.
Section 12. Section XI-- Interpretation, purpose and
conflict is hereby amended at all subparagraphs thereof as follows:
A. To change references made to Residence District "A"
and Apartment and Residence District "C" to "RS" Residen-
tial Single- Family District and "RM" Residential Multiple
Family District, respectively.
B. Section XI(C) is hereby repealed and deleted in its
entirety from the Zoning Ordinance.
Section 13. If any section, paragraph, clause, phrase
or term of this Ordinance be declared invalid, the same shall not
operate to invalidate any other provisions.
Section 14. This Ordinance shall be codified and made a
Part of the official Code of Ordinances of the Town of Gulf Stream,
Florida.
Section 15. That this Ordinance shall be in full force
and effect from and after its passage and approval according to
law.

COMMISSION WORKSHOP MEETING
SEPTEMBER 17, 1981

Wanio; Robert Cross, Barbara Gwynn, Town Clerk
Commissioner Dixson began the meeting at 4:00 P.M.
John Randolph then presented a rough draft of the zoning ordinances for
discussion. He stated that two alternatives could be taken to amend the
ordinances. The first alternative presented was "housekeeping" in which
there is not a great deal of time spent. Through the method of "housekeeping ",
there are no notices sent to the people. It entails publication with a public
he4rj.ng. The other alternative consists of notifying the people of amendments
to the zoning ordinances and call for a public hearing. The Commission felt
that'as there would be less expense to use the method of "housekeeping ", that
it would be the most practical..
The Commission then decided to study in detail the rough.draft of the Ordinance
section by section. A copy of said Ordinance is attached hereto,
After much discussion among the Commission, they agreed on various items to be
deleted or changed. Some of the items discussed included matters such as the
square footage, variances, lot requirements, setbacks, the recreational district
and the study of a new map. It was discussed that when the Ordinance was adopted,
changes could be placed in the Ordinance for the map.
Mayor Koch felt that the Commission should ask the people's opinion of re- zoning
by letters. If differences should arise concerning the re- zoning, then the
Commission would have to make the final decision.
After a discussion of professional and directional sign requirements and
restrictions, Commissioner Dixson stated that he would write the section con-
d.
cerning the signs.
Mr. Randolph and Mr. Caputo stated that they would get together to make those
changes agreed on by the Commission Board and would bring the revised version
to the Committee, th6n to the Commission.
