IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order: Mayor Orthwein called the Meeting to order at 5:01 P.M. II. Roll Call: Present and Joan K. Orthwein Mayor Participating Thomas M. Stanley Vice -Mayor Via Telephone W. Garrett Dering Commissioner Robert W. Ganger Commissioner Donna S. White Commissioner Also Present and William H. Thrasher Town Manager Participating Rita L. Taylor Town Clerk John C. Randolph Town Counsel Garrett J. Ward Police Chief Christopher O'Hare Resident Town Counsel Randolph asked for a modification of the Agenda after Item VI with regard to a discussion giving consideration to the Chandler case. Vice -Mayor Stanley moved and Commissioner Ganger seconded to approve the revision of the Agenda. All voted AYE. III. Consideration of Adopted Tentative Millage Rate and Adopted Tentative Budget for Fiscal Year 2013 -2014: A. Explanation and discussion of Tentative Millage Rate as compared to the rolled -back rate. Commissioner Ganger inquired as to what are the differences that require a definition. Town Manager Thrasher reported that there were no differences but that it is a statutory requirement to announce it. He continued that the calculated rolled -back rate for Fiscal Year 2013 -2014 is 2.9739 mills, and the proposed millage rate is 3.7000 mills, which is 24.42% higher than the rolled -back rate of 2.9739 mills. Town Manager Thrasher further commented that the budget is balanced with revenues and expenditures of $3,538,398. He also stated that there was a budgeted increase in reserves of $162,000. Town Manager Thrasher reported that the contract section has been updated. He added that the cost of living increases are 2.5 %. Town Manager Thrasher further detailed figures page by page. Commissioner Ganger inquired regarding the training budget. He continued discussing code enforcement with regard to possibly "farming" it out, and the monies available for it. Town Manager Thrasher discussed code enforcement possibly being contracted out to various vendors. He also stated that budgeted item is adequate at this time, but that this issue could be considered at a future time. Public Hearing Town Commission Meeting September 24, 2013 — Page 2 Commissioner Ganger discussed the importance of the $10,000 for the new fire study. He also addressed the issues of the lack of funding for continued training of staff. Town Manager Thrasher reported that was due to other financial commitments. GMayor Orthwein commented on the possibility of Delray Beach joining with Palm Beach County. Commissioner Ganger stated that it would be less effective as compared to what they have this day. B. Comments from the Commission and the Public: There were no further comments. IV. Adoption of the General Fluid FINAL Millage Rate for Fiscal Year 2013 -2014: Commissioner Ganger moved and Vice -Mayor Stanley seconded to approve the adoption of the General Fund FINAL Millage Rate of 3.7000 for Fiscal Year 2013 -2014. All voted AYE. V. Adoption of the FINAL Budgets for Fiscal Year 2013 -2014: A. General Fund Vice -Mayor Stanley moved and Commissioner Ganger seconded to approve the adoption of the General Fund Final Budget of $3,538,398 for Fiscal Year 2013 -2014. All voted AYE. B. Enterprise Fund (Water) Commissioner Ganger inquired if the year -end water figures were correct, and if Town Manager Thrasher was comfortable with the figures. Town Manager Thrasher responded "Yes ". Vice -Mayor Stanley moved and Commissioner Ganger seconded to approve the adoption of the Enterprise Fund (Water) Final Budget of $989,000 for Fiscal Year 2013 -2014. All voted AYE. VI. Resolutions for Adoption: Mayor Orthwein read the following Title and the entire document was read by Town Clerk Taylor. A. No. 013 -8; A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, ADOPTING THE FINAL LEVYING OF AD VALOREM TAMES FOR THE TOWN OF GULF STREAM GENERAL FUND FOR FISCAL YEAR COMMENCING ON OCTOBER 1, 2013 AND ENDING SEPTEMBER 30, 2014. Commissioner Ganger moved and Vice -Mayor Stanley seconded to approve the adoption of Resolution No. 013 -8. All voted AYE. No. 013 -9; A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH, FLORIDA, ADOPTING THE GENERAL FUND FINAL BUDGET FOR THE TOWN OF GULF STREAM FOR THE FISCAL YEAR COMMENCING ON OCTOBER 1, 2013 AND ENDING ON SEPTEMBER 30, 2014. Commissioner Ganger moved and Vice -Mayor Stanley seconded to approve the adoption of Resolution No. 013 -9. All voted AYE. Town Clerk Taylor read Resolution #013 -10 in its entirety. C. No. 013 -10; A RESOLUTION OF THE TOWN COMh4ISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, ADOPTING THE FINAL WATER FUND BUDGET FOR THE TOWN OF GULF STREAM FOR FISCAL YEAR COMMENCING ON OCTOBER 1, 2013 AND ENDING ON SEPTEMBER 30, 2014. Commissioner Ganger moved and Vice -Mayor Stanley seconded to approve the adoption of Resolution No. 013 -10. All voted AYE. Town Counsel Randolph requested consideration be given to a settlement of the suite Joel Chandler vs. Town of Gulf Stream Case No. 2013CA007789XXXXMBAM. He advised that the plaintiff has offered to dismiss this suite with prejudice by payment to him in the amount of $1,500.00. This would contemplate a dismissal wherein the Town would retract the statement in the answer that he was acting at the direction of another party. This would be included in the motion for dismissal and would incorporate releases for all parties in relation to this public records suite. Commissioner Ganger moved and Vice -Mayor Stanley seconded to approve the settlement of $1500.00, with all conditions just stated by Attorney Randolph, to Joel Chandler. All voted AYE. VII.
