Mayor Gilbertson called the regular meeting of the City Council to order at 7:40 p.m. 2. The invocation was given by the Reverend Father, Ian Holland, St. Luke's Catholic Church, Cloverly at Broadway, Temple City. 3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson. 4. ROLL CALL: PRESENT: Councilmen - Briggs, Harker, Merritt, Tyrell, Gilbertson ABSENT: Councilmen -None ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Parks & Recreation Director Kobett, Administrative Assistant Biel, Civil Engineering Assistant Linares, Maintenance Superintendent Dan Neff 5. APPROVAL OF MINUTES: Councilman Merritt moved to approve the minutes of the regular meeting of September 7, 1971, seconded by Councilman Harker and unanimously carried. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. Re. Assessments - Street Improvements PERSIMMON AVENUE, east and west side, Grand Ave. to Lower Azusa, and FAIRVIEW AVENUE, north and south sides, Persimmon Avenue to Arcadia Wash (Curb, gutter and drive approaches, pursuant to Chapter 27 of Streets and Highways Code) City Manager Koski advised that proper notice had been sent to all concerned in regard to the public hearing for Assessments for street improvements on Persimmon and Fairview Avenues, and provided description of properties to be assessed, as outlined in memorandum dated September 3, 1971. Mayor Gilbertson declared the public hearing open, and invited those present who wished to speak for or against the assessment to come forward. Gary L. Rosenberg and L. H. Rosenberg, 4922 N. Persimmon, described a problem for entering the drive at their location, in that larger cars could not clear the hump at the driveway connection to the apron. They also advised that they did not wish to sign a release to the City relative to water hazard if existing drive was filled to average depth because such release would be detrimental to property value as it related to mortgage or resale. Following discussion it was moved by Councilman Merritt, seconded by Councilman Harker and unanimously carried that staff get together with the Rosenberg's to remedy the problem by reduction of the hump to curb level. Salvadore Garcia, 4932 N. Persimmon, advised that no approach to the curb was provided at the right side of his driveway. Councilman Harker moved that the necessary approach be provided to correct this deficiency, seconded by Councilman Briggs and unanimously carried. Council Minutes, September 21, 1971 - Page 2 Pete Ringo, 4925 N. Persimmon, advised that the prolonged apron connecting to his driveway resulted in that portion of the drive to be approximately 1' lower than the lawn adjacent thereto, which had not previously existed. He stated that the City's offer to correct the situation by building a small retaining wall was acceptable to him. Councilman Briggs moved that the retaining wall be constructed adjacent to the drive, seconded by Councilman Harker and unanimously carried. Mary (Fialla) Lamb, 4836 La Madera, El Monte, owner of property at Lower Azusa and Persimmon (10733 Lower Azusa) wanted to be on record that drainoff from the improvement project is affecting her property. She was advised that the problem was being alleviated by a drainage pipe, which will be temporary in nature, pending improvements on Lower Azusa. No one else came forward to speak. Councilman Briggs moved to close the public hearing, seconded by Councilman Harker and unanimously carried. Councilman Merritt moved to approve the assessments and direct that the properties be so assessed, seconded by Councilman Harker and unanimously carried. 7. ORDINANCE NO. 71 -337: 1st read. Re. Proposed C -1 Retail Commercial Zone. City Attorney Martin advised that Ordinance No. 71 -337 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY ESTABLISHING A NEW "C -1" EXCLUSIVE COMMERCIAL ZONE IN THE CITY AND IMPOSING THE REGULATIONS THEREOF UPON CERTAIN PARCELS AND AREAS OF THE CITY had been prepared based upon the recommendation of the Planning Commission as outlined in Resolution No. 71- 410PC, and the recommendations of the Council at their previous meeting of September 7, 1971. He advised that the Planning Commission had reviewed the proposed ordinance at a regular meeting of the Commission, and had concurred with the Council recommendations included therein, and further recommended the inclusion of "Luggage and leather goods store" under Section 9399.1. Councilman Briggs inquired as to the number of vacancies that presently exist in the 5 -block area, and the feasibility of limiting to a 2 -block area, however it was the general consensus that this limitation would nullify the intent of establishing a concentrated C -1 retail area. In the general discussion, it was noted that the list of businesses may need additional refinement, however it was felt that the list, as now revised, was as comprehensive as could be determined at this time. Councilman Tyrell called attention to the need for supplemental description to Item 39 in "Uses permitted" as it pertained to other retail sales not more obnoxious, which was amended to read "not more obnoxious than the type of uses listed above, or more detrimental to the public health, safety and welfare." Likewise, Item D pertaining to sales of other than new products, was amended to read: "shall be permitted when conducted in a manner secondary, and reasonably incident to a new product retail trade." Councilman Merritt moved to waive further reading, as amended, seconded by Councilman Harker and unanimously carried. 8. RESOLUTION NO. 71 -1130: Urging Adoption of Enabling Legislation for formation of New County. City Attorney Martin presented Resolution No. 71 -1130 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY URGING ADOPTION OF ENABLING LEGISLATION FOR, AND EXPRESSING THE CITY'S INTEREST IN, THE FORMATION OF A NEW COUNTY PROPOSED TO BE CREATED IN SAN GABRIEL VALLEY. Councilman Tyrell moved to adopt, seconded by Councilman Harker and unanimously carried. Council Minutes, September 21, 1971 - Page 3 9. REPORT FROM PLANNING COMMISSION ON PREVIOUS COUNCIL ITEMS. A. POTENTIAL DEVELOPMENT OF ROSEMEAD BOULEVARD. The Planning Commission is undertaking an immediate study of potential develop- ment of Rosemead Boulevard and contiguous area, with first study session scheduled for Thursday, September 23, 1971. B. ZONE VARIANCE CASE No. 71 -341 - 9638 Gidley Street (Orville Mapes). Council was advised that this matter was previously before the Council as a public hearing, and that it had been returned to the Planning Commission for consideration of new evidence, and was - denied; and that the appeal before the Council was still open. Councilman Tyre]] moved to set public hearing for October 5, 1971, at 7:30 p.m., seconded by Councilman Briggs and unanimously carried. C. CHILD CARE - 4932 McClintock (R -1 Zone) Kenneth & Laura Coles. Council received the report from the Planning Commission, stating that the applicants, Kenneth & Laura Coles have been advised to make an application for a variance if they wished to expand the facilities to accommodate from 6 to 10 children in an R -1 zone. NEW BUSINESS: 10. RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of September 15, 1971. A. Re- cosponsorship of Temple City United Soccer Club for 1971 -72. On motion of Councilman Tyrell, seconded by Councilman Briggs and unanimously carried, the Parks & Recreation Commission recommendation for re- cosponsorship of Temple City United Soccer Club for 1971 -72 was approved. B. American Little League Request to Install Additional Sprinklers at North Baseball Diamond at Live Oak Park. On motion of Councilman Harker, seconded by Councilman Tyrell and unanimously carried, the recommendation of the Parks and Recreation Commission for American Little League to install additional sprinklers on north baseball diamond at Live Oak Park was approved. 11. EMPLOYMENT OF PERSONNEL: A. Resolution No. 71 -1131: Park Maintenance Man - Ray Garcia. Councilman Tyrell moved to adopt Resolution No. 71 -1131 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by Councilman Merritt and unanimously carried. B. Resolution No. 71 -1132: Crossing Guards. Councilman Tyrell moved to adopt Resolution No. 71 -1132 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING CROSSING GUARDS, seconded by Councilman Merritt and unanimously carried. C. Resolution No. 71 -1133: Temporary Personnel. Councilman Tyrell moved to adopt Resolution No. 71 -1133 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPORARY PERSONNEL, seconded by Councilman Briggs and unanimously carried. Council Minutes, September 21, 1971 - Page 4 12. RESOLUTION NO. 71 -1134: WARRANTS & DEMANDS, Demand Nos. 4712 Thru 4766, in the amount of $63,809.35. Councilman Harker moved to adopt Resolution No. 71 -1134 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $63,809.35, DEMAND NOS. 4712 THRU 4766, seconded by Councilman Tyrell and unanimously carried. 13.. COMMUNICATIONS: A. Temple City Unified School District. The annual report prepared by the Temple City Unified School District relative to Pedestrian Bicycle Safety Program was received and referred to a study session to be held as soon as possible. B. Sunnyslope Water Company - Offer to purchase property at Longden and Encinita Avenues. The offer of the Sunnyslope WaterCo. to purchase city -owned property at the corner of Longden and Encinita Avenue, subject to Conditional Use Permit being granted for a well site, was received by the Council and held in abeyance, pending the hearings before the Planning Commission. C. Appeal, Zone Change Case No. 71 -352 and 71 -354PC (Ragsdale, Hinkley and Lovell), and D. Appeal, Conditional Use Permit 71 -347PC (Humble Oil ) Councilman Tyrell moved to set public hearings for appeal in Zone Change Cases No. 71 -352 and 71 -354PC by applicants Ragsdale, Hinkley and Lovell; and appeal by Humble Oil Company in regard to Conditional Use Permit 71- 347PC, denied by the Planning Commission, for Tuesday, October 19, 1971, at 7:30 p.m. in the Council Chambers of the City Hall. 14. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: Mrs. Zelma Cook, Mountain View, California, owner of property at 9520 Las Tunas Drive, questioned the acceptability of a proposed new lessee under the present and proposed zoning restrictions. She was advised that if it is primarily retail, it is a permitted use, and that if there is a question relative to the related incidental uses, that the City Attorney should be contacted for an opinion. 15. MATTERS FROM CITY OFFICIALS: A. PROPOSED ACQUISITION OF PROPERTY - Oak and Olema - Proposed Park site This matter was referred to a Study Session, and is covered in matters acted upon following the Council reconvening. B. Proposed Amendment to Los Angeles County Fire Code. Council discussed a staff recommendation dated September 16, 1971, relative to amending the Los Angeles County Fire Code to permit outside open fires for cooking purposes. Councilman Tyrell moved to instruct the City Attorney to prepare an appropriate ordinance amending the fire code relating to outdoor cooking fires and ornamental open flames, seconded by Councilman Briggs and unanimously carried. Council Minutes, September 21, 1971 - Page 5 C. RESOLUTION No. 71 -1135: Honoring the Telephone Pioneers of America. Councilman Harker moved to adopt Resolution No. 71 -1135 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, HONORING THE TELEPHONE PIONEERS OF AMERICA, seconded by Councilman Merritt and unanimously carried. D. WELLAND AVENUE TREE REMOVAL. A petition signed by 37 property owners on Welland, Wildflower and Daines Avenues, urging the City Council to reconsider previous action permitting removal of elm trees on Welland Avenue was received. Following discussion, Councilman Briggs moved to rescind the previous action of the Council, seconded by Councilman Harker and unanimously carried. E. CABLE ANTENNA TELEVISION PROPOSALS. An interim report summarizing bid proposals received relative to cable antenna television franchise, was provided to the Council by staff. The report was referred to the next meeting of the Council, at which time a more comprehensive report would also be provided. F. VACATION OF PORTION OF PUBLIC ALLEY, SOUTHERLY OF LAS TUNAS DRIVE, BETWEEN KAUFFMAN AVE. AND GOLDEN WEST - RESOLUTION No. 70- 1063C. City Attorney Martin advised that necessary documents relative to vacation of portion of public alley, southerly of Las Tunas Drive, between Kauffman Avenue and Golden West, had now been received, and advised that it was now appropriate for the Council to adopt Resolution No. 70 -1063C entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY VACATING A PORTION OF THE ALLEY LOCATED SOUTHERLY OF LAS TUNAS DRIVE RUNNING BETWEEN KAUFFMAN AVENUE AND GOLDEN WEST AVENUE IN SAID CITY, verifying that the three conditions imposed by the Council had been met, and which was now suitable for recordation with the County Engineer. Councilman Merritt moved to adopt, seconded by Councilman Harker and unanimously carried. G. Mayor Gilbertson was commended on the fine presentations he had made in television interviews relative to proposed changes in county government. H. Councilman Briggs called attention to the need to correct the problem of the dip at Golden West and Las Tunas Drive. Staff was directed to make a study to determine costs involved. I. Councilman Briggs and City Manager Koski reported on a Finance Committee meeting held on Monday, September 20, 1971, including the City Treasurer, advising that the State Controller has devised a method of transferring funds directly to local banks, eliminating several days to complete the transactions, and that the Finance Committee recommended the new procedure be implemented. The City Council concurred with the Finance Committee recommendations. J. Councilman Tyrell discussed the need for the extension of local bus transportation which would be under the Public Utilities Commission, and a jitney type service which would assist local residents to reach shopping centers, parks, etc. K. Lt. Keith Forbes, Watch Command, Temple Station, was introduced. 1 1 1 Council Minutes, September 21, 1971 - Page 6 L. Mayor Gilbertson advised the Council of the American Field Service reception for foreign exchange students, to be held at the Women's Club, September 26, from 6:30 to 8:30 p.m. M. Mayor Gilbertson advised that a meeting had been held the previous evening, with the Chairmen of the Commissions, to discuss a proposed City seminar to include Council, Commissions and Staff. 16. ADJOURNMENT: Councilman Tyrell moved to adjourn to a study session at 9:30 p.m. seconded by Councilman Merritt and unanimously carried. 17. RECONVENE: Following the Study Session, Council reconvened at 10 :30 p.m., at which time the following action was taken. A. PROPOSED ACQUISITION OF PROPERTY - Oak and Olema. Council reviewed the Parks & Recreation Commission recommendations regarding the possible acquisition of property for a park and recreation facility at Oak and Olema. After evaluating the benefits contrasted to the deficiencies, Council determined that it was not in the public interest to expend any monies at this time, particularly without benefit of an overall Master Plan of park site development. B. PROPOSED CITY OFFICIALS SEMINAR. Council discussed various possible times for holding a seminar for Council, Commissioners and staff members, for purposes of discussing issues pertinent to the City of Temple City, toward developing a program of action to accomplish long range goals. It was the general consensus that it should be held on a Saturday and Sunday, possibly during the month of January, and that it may be desirable to invite persons other than City Officials, i.e., business and civic leaders, and school district officials. A seminar of this nature should be well - planned and cover issues of significance to warrant the individual's participation. Therefore a list of issues and matters for discussion should be solicited from the various commissions, following which a tentative program can be outlined and discussed at an early study session of the Council. C. ENVIRONMENTAL STUDIES COMMITTEE. In order to bring the committee up to its prior number of 11, it would be desirable to have three appointments made. 18. ADJOURNMENT: On motion of Councilman Tyrell, seconded by Councilman Briggs and unanimously carried the meeting was adjourned at 10:50 p.m. Next regular meeting of the Council will be held on Tuesday, October 5, 1971, at 7:30 p.m. in the Council Chambers of the City Hall. 11diP /A P ATTEST:
