HomeMy Public PortalAbout10/21/97 CCM215 MEDINA CITY COUNCIL MEETING MINUTES OF OCTOBER 21, 1997 The City Council of Medina, Minnesota met in regular session on October 21, 1997 at 7:30 p.m. in the City Hall Chambers. Mayor John Ferris presided. Members present: Ferris, Hamilton, Johnson, Zietlow, and Thies. Members absent: None. Also present: Interim Police Chief Ed Belland, City Attorney Ron Batty, Public Works Director Jim Dillman, City Engineer Glenn Cook, and City Clerk -Treasurer Paul Robinson. 1. Approval of the Agenda Additions to the Agenda: 1. Job description for the police chief position. Moved by Ann Thies, seconded by Phil Zietlow, to approve the agenda as amended. Motion passed unanimously, 2. Approval of the Minutes from October 7, 1997, City Council Meeting Jim Dillman mentioned that the on call discussion was missing from the minutes. The on call discussion was added. There were no changes to the on -call policy. Moved by Ann Thies, seconded by Jim Johnson, to approve the minutes of the October 7, 1997, city council meeting as amended. Motion passed unanimously. 3. Consent Agenda Moved by Jim Johnson, seconded by John Hamilton to approve the consent agenda. A. Resolution 97-51 Granting a Permit to Minnegasco for Gas Main Installation Along Tamarack Drive North of Medina Road and Along Melody Lane. B. Approval of a Gambling License to Opportunities in Emergency Health Care for a raffle at the Medina Entertainment Center on November 15, 1997. C. Resolution 97-52 approving Conditional Use Permit for Jody Chanin, 32 Hamel Road. Motion passed unanimously. 4. Comments from Citizens on Items Not on the Agenda There were none. 5. Park Commission Comments Jim Dillman said that things at Hamel Legion Park were going good. He was waiting for Doboszenski's to have time to do the final grading. Dillman said it should be done in the next two weeks. 6. Planning Commission Comments - There were none. OLD BUSINESS 7. Police Garage Addition Phil Zietlow said the garage addition project was going good. Zietlow passed out a summary of the architect's hours. He said that to date the city owes Del Erickson $5,885, and Erickson estimated it cost another $2,200 to complete the project, bringing the total to $8,100. Ann Thies asked where the architects costs were in relation to the original budget. Medina City Council Meeting Minutes October 21, 1997 215 216 Phil Zietlow said that he budgeted $10,000 for the architecture work. 8. Police Chief Job Description John Ferris said the job description was included with the information packet. Ann Thies asked how this job description related to the 1993 job description done to comply with the state's pay equity requirements. Phil Zietlow said that Ed Belland rewrote the job description using the previous job description as a guide. Ann Thies suggested adding, "enforces federal and state statutes" to the job description. Phil Zietlow said the way the job description was written made it sound like the police chief would report directly to the city council liaison. He said this seemed like too much power for the liaison. Zietlow said that the police chief reports directly to the city council and uses the liaison as an advisor. John Ferris said that's true for all department heads. Phil Zietlow said the requirements of the job description should be measurable. He said parts of the job description that aren't measurable or accountable may not be needed. Ed Belland gave an example: " the police chief should have sound judgment" as an area that would be difficult to measure. Ann Thies asked about the minimum requirements. Phil Zietlow said the chief was required to have a four-year college degree. She asked if it should be "or comparable experience", such as a number of years as an officer. There was some discussion about this. The city council felt that it was okay to leave a four-year degree as a minimum requirement. Phil Zietlow said they added "the police chief would patrol to maximize coverage", this was not included in the previous job description. Ann Thies said she had always understood that the police chief would do regular patrols. Phil Zietlow said the police chief did patrol, but that the patrols weren't regularly scheduled. Paul Robinson mentioned that the job description should continue to have ADA required language for lifting, sitting for long periods of time, etc. Ed Belland asked about the section of the job description that required the chief to be on call, 24 hours a day, 7 days a week and how that would relate to vacation time or holiday time when he may go out of town. Jim Dillman suggested that the police chief be allowed to designate someone as on call in his absence. Medina City Council Meeting Minutes October21, 1997 216 217 John Ferris said this job description would be re -presented to the city council at the November 4 meeting. Phil Zietlow said John Hamilton would not be able to make the November 4 meeting and asked if it would be okay to delay approval of the job description and hiring of the police chief until the second meeting in November. Consensus of the city council was to wait until the second meeting in November. 9. Garbage Licenses Ron Batty said he provided comments on the revisions to the licenses. He said his comments were meant to bring the licenses into the 90's. Batty said these licenses are basically the same licenses that the city had been using for the past 10 years. Ann Thies said that the exhibits were not labeled. Ron Batty said that the exhibits should be labeled. He also said the current licenses were in effect from April 1 to March 30 and the new licenses would run from January 1 to December 31. There was some discussion about Randy's, who had taken over BFI's territory as of September. The discussion was whether or not the rates Randy's charges until the end of the year would be the same as the amount they would charge at the beginning of the year. Jim Dillman was not sure what the charge would be up to the beginning of the year. Phil Zietlow said the rates in the attachments were not obviously designated as monthly rates and that may need to be done to clarify the attachments. Moved by Ann Thies, seconded by Jim Johnson to approve the licenses with Superior Sanitation and Randy's Sanitation. Motion passed unanimously. 10. Conditional Use Permit for an Accessory Structure from K'N'R Electronics, 810 Tower Drive Ron Batty said that K'N'R was requesting a second building on their site. This structure would be 1,800 square foot in size. Batty said that a site plan showing the existing building was attached. The new building would be to the rear of the existing building. He said the planning commission reviewed this proposal last week and approved the amended conditional use permit with eight conditions. He said the conditions included are standard conditions to any proposal such as this. He prepared a resolution in the form of an amended conditional use permit. He retained two of the older conditions that would still be active under the current conditional use permit. Moved by Ann Thies, seconded by Jim Johnson, to approve the Resolution 97-53 approving the amended conditional use permit for K'N'R Electronics at 810 Tower Drive. Motion passed unanimously. 11. Livable Communities Act Resolution Paul Robinson said this resolution was exactly the same resolution as the city council passed last year in order to remain a participant in the Livable Communities Act. Medina City Council Meeting Minutes October21, 1997 217 218 There was some discussion about the Livable Communities Act and the city council decided to remain a part of this for 1998. Moved by Jim Johnson, seconded by Ann Thies, to approve the Livable Communities Act Resolution 97-54. Motion passed unanimously. NEW BUSINESS Jim Johnson welcomed Glenn Cook back as city engineer. Shawn Gustafson resigned and is moving to Arizona. For the time being, Glenn Cook will be the city engineer. 12. Public Works Morningside Ditch Project Jim Dillman said they assembled a technical panel to look at one of the wetlands on Keller's property. The panel included the board of water and soil resources, the conservation district, and the city. Dillman said it looks as if the area they considered a wetland may not actually be a wetland. If this holds true it would enable the city to use the soil from that area to correct the problem with the ditch. Dillman said they were meeting next Tuesday to determine if they could go ahead with the project based on one of the earlier proposals. Ron Batty said he would work with Jim Dillman on revising the previous agreement. 13. November 4 City Council Meeting Paul Robinson said the November 4 city council meeting would not start at 7:30 p.m. but at 8:00 p.m. because of school board elections. 14. Approval to Pay the Bills Moved by John Hamilton, seconded by Ann Thies, to approve payment of order checks #17653- 17700 for $38,477.35 and payroll checks #15372-15383 for $10,218.30. Motion passed unanimously. 15. Adjournment Moved by Ann Thies, seconded by John Ferris, to adjourn the meeting at 8:04 p.m. Motion passed unanimously. / : John B.
