LYN1A-OOD PLANNING COMMISSION MEETING,
September 09, 2008
The Lynwood Planning Commission met in regular session in the City Hall Council
Chambers, on the above date.
Vice Chair Castro-Ramirez called the meeting to order at 6:43 p.m.
Vice Chair Castro-Ramirez led the flag salute.
Vice Chair Castro-Ramirez requested the roll call.
Planning Consultant Michael Allen called roll.
Commissioners Patel, Younger, Landeros, Wells, and Castro-Ramirez answered
the roll call.
Also present were Public Works Engineering Manager Elias Saikaly, Planning
Assistant Karen Figueredo, Planning Consultant Michael Allen and Commission
Counsel Doug Haubert.
Vice-Chair Castro-Ramirez inquired if the Agenda had been duly posted.
Planning Consultant Allen indicated the Agenda had been duly posted.
Item #5 Minutes August 12, 2008
Vice Chair Castro-Ramirez announced Agenda Item #s, minutes of August 12,
2008, Planning Commission meeting and asked if there were any questions or
revisions.
Motion by Commissioner Younger to approve the August 12, 2008 minutes,
seconded by Commissioner Patel.
Vice-Chair Castro-Ramirez requested the roll call.
Planning Consultant Allen called the roll call and the motion to approve the
minutes passed 4-0 Commissioners Wells abstained.
Item #6: Swearing In Speakers
Commission Counsel Doug Haubert swore in citizens wishing to speak on any
agenda item.
Item #7: Public Orals
Florentine Stansell, 3611 Cedar, Lynwood CA 90262, stated she was trying to
convert her Single Family Residence into a duplex for about a year and that on
June 26 she was told "she was in the wrong zone". The property owner wants a
clarification regarding the zoning of her property because she feels she already
wasted a year preparing her plans and her project is being denied.
Vice Chair Castro-Ramirez asked Counsel Haubert to provide guidance.
Counsel Haubert replied since the property is not on the Agenda the Planning
Commission will not be able to respond but if staff had an answer it could be
provided otherwise.
Planning Consultant Allen replied the property is located in an R-1 Single Family
Residential zone.
Vice Chair Castro-Ramirez asked staff to schedule an appointment with property
owner.
Property owner complained about the time she invested to comply with the
zoning requirements.
Counsel Haubert asked the property owner to meet with him after the meeting to
discuss all the issues she might have outside the context of the public meeting.

Item #8: Conditional Use Permit No. 2008-07 & Variance No. 2008-04
APPLICANT: Jack Ku

Planning Consultant Allen presented the staff report and indicated that the
applicant is requesting approval to construct a 5,300 square foot single-story
commercial retail building with two restrooms and seventeen (17) parking stalls
and a Variance to reduce front and side yard setbacks. The project is intended to
be Phase II of Norton Plaza. The property is located at 10838 Long Beach
Boulevard in the C-2A (Medium Commercial) zone.
The property owner provided the Commission with an updated set of plans, that
included changes to the front setback and the width of the sidewalk, the
applicant will set a bond for future development of Long Beach Boulevard. The
trash enclosure located at the rear of the property has been relocated to the far
north eastern side of the property. Staff recommends that the Planning
Commission approve Conditional Use Permit No. 2008-07 and Variance No. 2008-
04.
Vice-Chair Castro-Ramirez asked if the Planning Commissioners have any
questions.
Vice-Chair Castro Ramirez asked if the seventeen parking stalls comply with the
requirements.
Planning Consultant Allen replied the project complies with the City of Lynwood
and American with Disabilities Act parking requirements.
Vice-Chair West asked if all the Variance findings were met and if staff could
explain finding No. 2.
Planning Consultant Allen explained that the proposed project is to develop a
commercial building similar to the property located at Norton Plaza to provide
consistent development along Long Beach Boulevard. In order to maximize the
use of the lot and terms of cost and building area the applicant requested the
Variance. The developer will be able to provide the Planning Commissioners with
more detailed information regarding the financing of the project.
Vice-Chair Castro-Ramirez asked if the project is consistent with the Long Beach
Specific Plan guidelines.
Planning Consultant Allen replied it meets the purpose and intent of the
guidelines.
Vice-Chair Castro-Ramirez opened the Public Hearing.
Applicant Jack Ku, Irvine presented his project and asked for the Planning
Commission support to approved Conditional Use Permit 2008-07 and Variance
2008-04.
Chair Castro-Ramirez closed the Public Hearing.
After discussion it was moved by Commissioner Wells to adopt Resolution No.
3219 approving Conditional Use Permit No. 2008-08 and Variance No. 2008-04 to
construct a 5,300 square foot single-story commercial retail building, seconded
by Commissioner Younger.

Commissioner Wells requested signage requirements be incorporated into the

Vice-Chair Castro-Ramirez requested a meeting with the Redevelopment Agency
and Development Services to discuss Long Beach Specific Plan.
Commissioner Landeros arrived at and asked if item No. 8 had already been
voted on?
Vice-Chair Castro-Ramirez affirms vote took place.
Counsel Haubert stated that the Planning Commission out of courtesy can open
the vote for Commissioner Landeros to cast his vote and voice his concerns, but
can not change the outcome.
Commissioner Landeros asked for respect to fellow Commissioners.
Commissioner Younger stated he believes staff did not deviate from the General
Plan and did not do anything wrong and believes the project was in compliance,
also requested an update regarding Fernwood Estates an invitation to the
developer for the next Planning Commission meeting.
Commissioner Landeros stated the item was in closed session for the past four
meetings.
Commissioner Landeros requested the Planning Commission stop making wrong
decisions and find a solution for future projects and stop going with staff
recommendation.
Vice-Chair Castro-Ramirez and Commissioner Wells requested to be registered
for the UCLA extension program/workshop.

PROPOSAL
The applicant is requesting approval to construct two (2) detached residences, two-
stories in height, with two (2) attached two-car garages, also a detached two-car
garage will be provided for the existing unit. The subject property is located at 11323
Louise Avenue, Assessor Parcel Number 6194-023-032 in the R-3 (Multiple-Family
Residential) zone.
PROJECT OVERVIEW
The subject property totals 18,480 square feet in area and is located on the west side
of Louise Avenue between Sanborn Avenue and Martin Luther King Jr. Boulevard.
Per section 25.65.060 of the Lynwood Municipal Code, each residence consisting of
three or fewer bedrooms shall provide atwo-car garage and residences consisting of
four or more bedrooms shall provide a three car garage. Each enclosed parking stall
shall provide 10' x 20' interior clear dimensions. One open guest parking stall shall be
provided.
The site plan indicates the property is rectangular in shape and totals 18,480 square
feet with an existing driveway providing a minimum of twenty feet (20') access.
Floor plans identify one detached duplex (two units) consisting of three-bedrooms and
an attached four-car garage and a front residence consisting of three-bedrooms and a
detached two-car garage and a guest parking stall.
Elevations indicate two-story structures twenty four and a half feet (24-6")' in height
consisting of stucco siding and a composition shingle roof.

The Lynwood Municipal Code allows a maximum density of 18 units per acre or one (1)
unit per 2,240 square feet of property area. The property is sufficient in size to
accommodate a maximum of seven (7) residential units.

WHEREAS, the Lynwood Planning Commission, pursuant to law, on October 14, 2008
conducted a public hearing; and
WHEREAS, the Planning Commission considered all testimony offered at the public
hearing; and
WHEREAS, the Development Services Department has determined that the proposal is
categorically exempt from the provisions set forth in the California Environmental Quality Act
(CEQA) Guidelines pursuant to Section 15303(b); therefore
Section 1. The Lynwood Planning Commission hereby finds and determines as
follows:
A. That the proposed Conditional Use is consistent with the General Plan.
The General Plan Designation for the subject property is Multi-Family Residential
that is consistent with the R-3 zoning designation. The project is consistent with
the General Plan policies and goals in the Land Use and Housing Elements.
B. That the nature, condition, and development of adjacent uses, buildings,
and structures have been considered, and that the use will not adversely
affect or be materially detrimental to these adjacent uses, building, or
structures;
The project would be consistent with the R-3 zone pertaining to density and would
satisfy all development standards to include but not be limited to setbacks, building
height, landscaping and parking.
C. That the site for the proposed conditional use is of adequate size and
shape to accommodate the use and buildings proposed.
The site is appropriate in size to support the proposed new structures consistent
with the R-3 zone specifications.
D. That the proposed conditional use complies with all applicable
development standards of the zoning district; and
The project would comply with all development standards set forth in the LMC. No
variances are necessary.
E. That the proposed conditional use observes the spirit and intent of;this
Zoning Code.
The project would comply with all development standards set forth in the LMC.
Section 2. The Lynwood Planning Commission hereby approves the Conditional Use
Permit No. 2008-08, subject to all conditions, restrictions and limitations set forth as
follows:
CONDITIONS OF APPROVAL
DEVELOPMENT SERVICES DEPARTMENT
1. The conditional use must be acted upon within one year. The Conditional
Use Permit shall become null and void 365 days from the date of approval
if not acted on within this period. One extension of 1 year may be granted
if the extension is requested in writing prior to the end of the valid
period, at the discretion of the Development Services Department.
2. The project shall comply with all regulations and standards set forth in the Lynwood
Municipal Code, the California Building Code, the Los Angeles County Fire Code and
all other City Departments.
3. The project shall be developed in accordance with the plans approved by the
Lynwood Planning Commission and on file in the Development service Department,
Planning Division.
4. Any proposed subsequent modification of the subject site or structures thereon,
shall be first reported to the Development Services Department, Planning Division,
for review of said modifications.

5. The property owner shall sign a Statement of Acceptance stating that he/she has
read, understands, and agrees to all conditions of this resolution prior to issuance
of building permits.
6. Conditions of approval shall be printed on plans prior to submission to the Building
and Safety Division for plan check.
7. All appeals must be brought within ten (10) working days of the date of
the final action by the Development Services Director, or Site Plan Review
Committee. An appeal will be scheduled for public hearing before the
Lynwood Planning Commission. Persons filing the appeal must submit an
application and pay a fee of $1,083.
PLANNING DIVISYON
8. Each garage shall have an interior dimension of 20' by 20'.
9. One guest parking shall be provided measuring 9' by 20'.
10. All driveways shall be permanently paved, maintained and remain clear and
accessible for vehicle access at all times.
11. Landscaping and irrigation shall be installed in accordance with a detailed
Landscaping Plan to be submitted and approved by the Planning Division prior to
the issuance of any building permits.
12. The required front, rear, and side yards shall be landscaped and shall consist
predominantly of plant material except for necessary walks, drives and fences.
13. Roofing material shall be non-reflective to include clay tile, concrete tile, synthetic
tile, or ARC 80 Composition Asphalt.
14. Structures shall consist of non-reflective materials to include brick, stucco, wood,
metal, concrete, or other similar materials.
15. Air conditioner, heating, cooling ventilation equipment, swimming pool pumps and
heaters and all other mechanical devices shall be located within the rear yard. Such
equipment shall be screened from surrounding properties and streets and so
operated that they do not disturb the peace, quiet and comfort of neighboring
residents, in accordance with the City's Noise Ordinance.

16. A six (6~ foot high solid and sight obscuring block fence shall be installed around
the perimeter of the property, except within the twenty foot (20') front yard setback
area. Front yard fences shall not exceed four feet (4') in height and may be
constructed of wrought iron or wrought iron with block pilasters or picket fences
constructed of wood synthetic plastic.
17. No fence or wall shall be constructed until a permit is obtained from the Planning
Division. Block walls shall require a building permit.
18. The owner of the property shall maintain apro-active approach to the elimination of
graffiti from the structures, fences and any accessory building, on a daily basis.-
19. Structures shall be architecturally compatible and exterior colors shall be neutral or
earth tone. Trim and architectural fixtures may consist of bright colors.
20. Prior to plan check applicant/property owner shall submit color sample and obtain a
paint permit from the Planning Division.
21. Prior to plan check applicant/property owner shall submit a written new address
request to the Planning Division.
22. All contractors working on the project site must obtain a City business license prior
to commencing any work.
23. Property owner shall secure water service from City, and refuse disposal services
with the City contracted firm.
24. This project is subject to the City of Lynwood's Development Impact and Art Fees.

BUILDING AND SAFETY DIVISION
25. All construction shall meet or exceed the minimum building standards that are
referenced in the following codes:
o The California Building Code - 2007 edition;
o The California Plumbing Code - 2007 edition;
o The California Mechanical Code - 2007 edition;
o The Los Angeles County Fire Code - 2007 edition;
o The National Electrical Code - 2005 edition;
All as amended by the California Building Code ofL007.

In case where the provisions of the California Building Code, The City of Lynwood
Municipal Code, or the plans or specifications in these plans may conflict, the more
restrictive provisions shall govern.
26, Applicant/property owner must provide a copy of permit card signed by
all other department prior to schedule a final inspection.

27. Applicant/Property Owner shall comply with the Notice of Municipal Code Violations
issued by the City of Lynwood, dated October 8, 2008.
28. Provide documentation that lots composing the property were legally tied together
to the satisfaction of the Department of Public Works/Engineering Division. After
reviewing the documents, the Department of Public Works/Engineering Division
may require the submission and recordation of parcel lot merger.
29. Submit a grading plan prepared and signed by a registered Civil Engineer. Grading
plan will be checked by the Department of Environmental Services/Engineering
Division. No building permits will be issued prior to the approval of the grading plan
by the city Engineer (see Engineering Division for standard plan requirements).

35. A permit from the Engineering Division is required for all off-site
improvements.
36. All required water meters, meter service changes and/or fire protection lines shall
be installed by the developer. Each building shall be connected separately. The
work shall be performed by a license contractor hired by the developer. The
contractor must obtain a permit from the Department of Environmental
Services/Engineering Division prior to performing any work. Any and all existing
water service lines less than one inch (1") in diameter shall be abandoned at the
water main line per City instructions. Each building/tenant shall have its own water
service/meter. This area is serviced by Park Water Co.
37. This project may be subject to the City of Lynwood's Construction and Demolition
Ordinance. Determination shall be made upon submittal of the project's cost
estimate to the Department of Environmental Services. Building permits and/or
demolition permits shall not be issued until developer/project owner contacts the
Department of Environmental Services, Division of Public Works.
38. No final sign off shall be given until all conditions of approval from the
Public Works Department have been completed.
39. Existing property is located in the 100 year flood zone (AH).
40. New and existing structures must be one (1) foot above food zone level.

41. Access shall comply with Section 503 of the Fire Code, which requires all weather
access. All weather access may require paving.
42. Fire Department Access shall be extended to within 150 feet distance of any
exterior portion of all structures.
43. Private driveways shall be indicated on the final map as "Private Driveway and
Firelane with the widths clearly depicted and shall be maintained in accordance
with the Fire Code. All required fire hydrants shall be installed, tested and accepted
prior to construction.

44. Vehicular access must be provided and maintained serviceable throughout
construction to all required fire hydrants. All required fire hydrants shall be
installed, tested and accepted prior to construction.
45. Provide Fire Department or City approved street signs and building access numbers
prior to occupancy.
46. Project as submitted is cleared for public hearing.
47. Provide water mains, fire hydrants and fire flows as required by the County of Los
Angeles Fire Department, for all land shown on map which shall be recorded.
48. The required fire flow for public fire hydrants at this location is 1250 gallons per
minute at 20 psi for a duration of 2 hours, over and above maximum daily domestic
demand. 1 Hydrant flowing simultaneously may be used to achive the require fire
flow.
49. Fire hydrant requirements are as follow: Upgrade/Verify i existing Public fire
hydrant (s).
50. All hydrants shall measure 6"x4"x2-1/2" brass or bronze, conforming to currents
AWWA standard C503 or approved equal. All on-site hydrants shall be installed a
minimum of 25' feet from a structure or protected by a two (2) hour rated firewall.

51. All required fire hydrants shall be installed, tested and accepted or bonded for prior
to Final Map approval. Vehicular access shall be provided and maintained
serviceable throughout construction.
52. Fire hydrant upgrade is not necessary, if existing hydrant(s) meet(s) fire flow
requirements. Submit original water availability form to our office.
53. Provide evidence on LACoFD fire flow form, Form 195 that the hydrant and
available flow rate meets the current Fire Department requirements.
54. Submit two complete set of architectural drawings to the Fire Prevention
Engineering Section Building Plan Check Unit. Contact 323.890.4125 for additional

55. The applicant shall comply with all code requirements and conditions set forth by
the Los Angeles County Fire Department, Fire Prevention Division, 5823
Rickenbacker Road, Commerce, CA 90040, or contact them at (323) 890-4243.
Final approvals from the Los Angeles County Fire Department must be
obtained prior to issuance of any building permits.
Section 3. A copy of Resolution No. 3220 and its conditions shall be delivered to the
applicant.
