ADJOURNMENT MINUTES OP A SPECIAL MEETING FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT ADVISORY BOARD COMMISSION MARCH 12, 2008 OPENING CEREMONIES: A. CALL TO ORDER The CDBG Commission meeting was called to order at 6:05 p.m. B. FLAG SALUTE -All persons present participated in the flag salute. C. ROLL CALL -Chairperson Ortiz requested the roll call. Present: Sylvia Ortiz, Joe Battle, Patricia Carr and Irene Garcia. D. CERTIFICATION OF AGENDA POSTING Ms. Potts informed the CDBG Commission that the Agenda has been properly posted. E. PUBLIC ORALS: (ITEMS ON AGENDA ONLY) Mr. Caldaron commented that it was good to see ethnic groups coming together. F. NEW BUSINESS: 1. Presentations of Public Service Projects a. ADELANTE Moving Forward Program Amanda Perez gave a presentation on behalf of the ADELANTE program. She explained that services offered include sessions conducted on domestic violence, anger management, parenting, and coping skills. The program focuses on correcting negative and violent behaviors. Techniques and skills will be taught to improve communication Two other representatives from ADELANTE gave testimony to the program's success. Jose Pacheco explained that he received services from the program, then became a volunteer, and is current working for the program. The program receives referrals from children's services, the department of corrections and others. Commissioner Battle asked why Parolee has to attend classes in other City's such as Pasadena. The Commission was informed that Pasadena is part of the Lynwood's service areas which also include South Gate and Compton. Commission Battle said that his concern is that the Parolee may get challenged when using public transportation. Commission Garcia said that she thought it would be good if Lynwood is able to offer these services within the City. After further decision, Ms. Perez concluded the presentation on ADELANTE. b. Ballet Folkloric Estampas de Mexico Arturo Lopez gave a presentation on behalf of the Ballet Program. He explained that the program current has 40 members from the ages of 3years to 45 years old and that the program current has 3 dance instructors. Services offered include folkloric and moderate dance instruction. After further decision, Mr. Lopez concluded his presentation. 2. FY2008-09 Funding Determinations The Commission review public service projects for funding consideration. Discuss took place regarding the continued funding of certain projects. The Commission also discussed and agreed that CDBG applications should have been accept after the deadline. Decisions resulted in the following allocations: 1. Lynwood Senior Citizen Program - $112,350 Commissioner Ortiz move to allocate $70,000 to this program. Commissioner Battle later increased the allocation by $42,350, which resulted in a total allocation of $112,350. 2. Natatorium Extended Hours - $30,000 The Commission unanimously agreed to fund the activity for $30,000. 3. Lynwood Athletics Community Services - $0 The Commission unanimously agreed not to provide funding for the upcoming year. 4. Gang Prevention Education - $5,000 Chairperson moved to approved for $10,000, which did not pass. A counter motion for $5,000 was recommended, which passed unanimously. 5. Parents Interested in Education -$0 Commission Ortiz moved to approved for $10,000, Commissioner Carr second. Commissioners Battle and Garcia denied. Allocation denied for lack of quorum. 6. Sunshine Afterschool Computer Program - $0 Commission moved, seconded to approve project for $10,000 funding. Commissioners Battle and Garcia did not vote. Allocation denied for lack of quorum. 7. Project Impact $0 Commissioner Carr motion to approve $10,000. However the motion died for lack of vote by the remaining Commissioners. 8. Lucha Against Diabetes $0 The Commission unanimously agreed not to recommend funding at this time. 9. Peace and Joy Center $10,000 The Commission unanimously agreed to fund the program for $10,000. 10. Domino's Parent Education Program $10,000 The Commission unanimously agreed to fund the program for $10,000. 11. Compton After School Dance Program $10,000 The Commission unanimously agreed to fund the program for $10,000 12. ADELANTA Moving Forward - $10,000 The Commission agreed to fund program by 3-1 voted. 13. L.A.C. Sheriff's Prostitution Eradication $0 The Commission agreed not to fund this program. 14. Positive Imaje - $0 The Commission unanimously agreed not to fund this program. 15. Lynwood Crossing Guard $50,000 The Commission unanimously agreed to fund this program for $50,000. 16. Lynwood Graffiti Program - $25,000 The Commission unanimously agreed to fund this program for $25,000. 17. Ballet Folklorico Estamps de Mexico - $0 Commissioners Ortiz voted to fund the project. However, Commissioners Battle and Garcia voted to deny funding. Commissioner Carr abstained. Allocation denied for lack of quorum. Upon completion of the allocations to the public service providers, the CDBG Commission made the following allocations to activities as listed below: • CDBG Administration • Fair Housing Foundation • Section 108 Repayment • City Hall ADA Improvements • FY2008 Street Improvements • Code Enforcement Program • HOME Program $603,548r $331,000 $ 18,000 $607,646.50 $170,000 -0- $460,000 G. ADJOURNMENT The CDBG Commission meeting adjourned at 8:30 p.m. Chairperson Date Staff Date MINUTES OF A REGULAR MEETING OF THE COMMUNITY DEVELOPMENT BLOCK GRANT ADVISORY BOARD COMMISSION WEDNESDAY, APRIL 9, 2008 CALL TO ORDER: Chairperson Ortiz called the meeting to order on the above captioned date at 6:02 p.m. FLAG SALUTE: All those present participated in the flag salute. ROLL CALL: Present Chairperson Ortiz Commissioner Battle Commissioner Carr Commissioner Garcia CERTIFICATION OF AGENDA POSTING Staff stated that the Agenda was posted per the Brown Act. APPROVAL OF THE MINUTES Motion to approve the Minutes of March 12, 2008 was made by Commissioner Battle, seconded by Commissioner Carr with a note to submit corrected Minutes at next meeting. Motion carried unanimously. NEW BUSINESS Swearing in of New Commissioner -Iris Pygatt City Clerk Quinonez was in attendance to swear in Iris Pygatt. The Commission thanked Ms. Quinonez and Ms. Pygatt took her seat. Public Hearing - FY 2008-09 Consolidated Annual Action Plan Motion to open the public hearing was made by Commissioner Carr, seconded by Commissioner Battle. Staff explained that the purpose of the public hearing is to obtain public comments on the City's Draft Consolidated Annual Action Plan for fiscal year 2008-09. Commissioner Battle stated that City Council was upset that funding was recommended for Compton organizations. Commissioner Ortiz stated that Council may not be aware that the Compton program also serves Lynwood residents. Commissioner Garcia asked if P.I.E received all of their funding. Commissioner Ortiz stated that they have received their funding. Commissioner Battle stated that someone is stating in the community that CDBG should not subsidize the Crossing Guards, the School District should fund the guards. Commissioner Battle replied that the District has nothing to do with funding the crossing guards. It was turned over to the City years ago after the City challenged the District. Commissioner Garcia asked if the non profit status is verified prior to the organizations receiving funds. Staff replied yes, that is part of the intake paperwork. Commissioner Battle asked if the day care centers submit proof that their employees have had background checks and fingerprinting. He stated that the City could also be held liable if something happened to the children. Staff replied that information would be brought back to the Commission. After brief discussion, motion was made by Commissioner Battle, seconded by Commissioner Ortiz to receive and file the report. Motion carried unanimously. Motion to close the public hearing was made by Commissioner Battle, seconded by Commissioner Carr. STAFF ORALS: Ms. Handley informed the Commission that if they have additional questions regarding the Draft Consolidated Annual Action Plan they could contact Ms. Potts, Deputy Director of Administrative Services, in the City Manager's office. Also Commissioner Pygatt was welcomed aboard. BOARD ORALS: Commissioner Garcia welcomed Ms. Pygatt to the Commission. Commissioner Battle stated that due to the lack of a full Commission, reorganization has been postponed, and asked if the Commission could conduct the reorganization since Ms. Pygatt has jointed the Commission. Staff replied that only business listed on the Agenda can be conducted. However, reorganization can be placed on the following month's Agenda. Commissioner Carr stated that she was very disappointed that P.I.E. was not recommended for funding because they have been assisting the community for years and have done extremely well. Commission Carr also stated that Project Impact has an exceptional record of assisting the community as well, although they were not recommended for funding. Commissioner Ortiz welcomed Ms. Pygatt to the Commission Commissioner Pygatt expressed her thanks for the welcome and stated that she looks forward to working with the CDBG Commission. ADJOURNMENT: Motion to adjourn was made by Commissioner Battle, seconded by Commissioner Carr. Motion carried unanimously. The meeting adjourned at 7:12 p.m. Chairperson Staff Date Date CITY OF LYNWOOD CITIZEN PARTICIPATION PLAN [. POLICY STATEMENT It is the policy of the City of Lynwood to provide for full involvement of the Community in the planning, development, implementation, monitoring and evaluation of programs funded under the Housing and Community Development Act of 1974 or other HUD related Acts. Consolidated Plan The City's new Consolidated plan consolidates into a single submission the current CHAS, the HOME program description, the Community Development Plan and CDBG Final Statement. Consolidating the submission requirements offers the City a better chance to shape the various programs into effective, coordinated neighborhood and community development strategies. It also consolidates the reporting requirements for these programs into a single report. The intent of the Consolidated Plan is to: • Promote citizen participation and development of local priority needs and objectives by providing comprehensive information which is easy to understand; • Coordinate HUD statutory requirements, reduce paperwork, minimize and simplify the process of obtaining federal funds; • Promote the development of an action plan that provides the basis for assessing performance; and • Encourage consu-tation with public and private agencies, to identify shared needs and solutions. Citizen Partieipation Plan This Citizen Participation Plan establishes the procedures and guidelines implemented by the City to provide for the continuing participation of the citizens of Lynwood. Although the Citizen Participation Plan is designed especially to encourage participation by very low and low income persons, particularly those living in slum and blighted areas and in areas where HUD funds are proposed to be used, the City encourages the participation of all its citizens, including minorities and non-English speaking persons, as well as persons with disabilities. 1 This plan,may be amended-from time to time and shal- remain in effect until superseded by a new plan or until the City no longer participates in the Housing and Community Development Block Grant and HOME Programs. II. SCOPE OF PARTICIPATION A. Citizens Role All citizens are invited to the Consolidated Plan public hearings and meetings to provide input, comments, and participate in the development of the City's Consolidated Plan. Citizens are also invited to make recotttmendations and provide input regarding amendment to the plan, and the performance report. Before the Consolidated Plan is adopted, the City will make available to citizens, public agencies and other interested parties information that includes the amount of assistance the City expects to receive and the range of activities that may be undertaken, including the amount that will benefit persons of very low and low income and plans to minimize displacement of persons and to assist any persons displaced, if applicable. The City of Lynwood's Redevelopment Agency adopted the State of California's Relocation Assistance and Real Property Acquisition Law ( government code, Section 7260), on June 21, 1988. These Hiles and regulations have been formulated with appropriate reference to the Relocation Assistance and Real Property Acquisition guidelines adopted by the Department of Housing and Community Development pursuant to the Health and Safety Code, (Section 50460). The rules and regulations for implementation of Relocation Assistance and Real Property Acquisition are designed to carry out the following policies with respect to activities of the Lynwood Redevelopment Agency: To ensure that uniform, fair and equitable treatment is afforded persons displaced as a result of the Agency's actions. Such persons shall not suffer disproportionate injury as a result of actions taken for the benefit of the public as a whole; and 2. To ensure consistent and fair treatment for owners of real property to be acquired. Also to encourage and expedite acquisition by agreement with owners of such property to avoid litigation and relieve congestion in courts, and to promote confidence in public land acquisitions. 2 With respect tb a federally funded project the City of Lynwood's Redevelopment Agency shall make relocation assistance payments and provide relocation advisory assistance as required under federal law. Lynwood encourages, in conjunction with public housing authorities, the participation of residents of public and assisted housing developments, in the process of developing and implementing the consolidated plan, along with residents of targeted revitalization areas in which the developments are located. Lynwood will make an effort to provide information to housing agencies about housing and community development plan activities related to the City's developments and surrounding communities so that the housing agency can make this information available to the public hearing required under the Comprehensive Grant program. B. Citizen Comments and Views The City encourages and will take into consideration public hearings meetings, written and oral comments and views by citizens during the preparation and development of the City's Consolidated Plan, amendments to the plan and performance report. A summary of this information and a summary of any comments or views not accepted and the reasons therefare, shall be attached to the final Consolidated Plan, amendment of the plan or performance report. Citizens written comments and views may be submitted to City of Lynwood, Administrative Services /CDBG Division, 11330 Bullis Road, Lynwood CA 90262, or at a meeting of the CDBG Advisory Board Commission mentioned in the plan, or at public hearings being conducted by the City Council C. Public Notice The City of Lynwood wi-1 publish the proposed Consolidated Plan (or a summary), amendments, or performance report and make available copies in public location of the plan at least thirty (30) days before submission to HUD to afford citizens. the opportunity to comment on the plan, amendment, and / or performance report. In an effort to keep the low and moderate residents aware of the services provided with CDBG and HOME funds, public notice flyers will be placed in local gathering places such as the Lynwood City Hall, and Annex, Public Library, Lynwood High School, recreational centers and grocery stores, in addition to the adjudicated newspapers, in both English and Spanish languages. Citizens are encouraged to contact the City's CDBG Division regarding any questions and J or concerning the process and CDBG and HOME activities underway. 3 D, Public Hearings The City will conduct pubic hearings and meetings on all phases of the Consolidated Plan and performance reports. The CDBGAB Commission when requested, shall assist the City Council in conducting the public hearings and meetings on the grant application for funding of the Community Development Block Grant and HOME Programs. All hearings and meetings will be open to the public The City will hold at least two public hearings per year to obtain citizen's views, to be conducted at a minimum of two different stages of the program year. Together, the hearings will address housing and community development needs, development of proposed activities, and review of program performance. To obtain the views of citizens on housing and community development needs, at least one hearing will be held before the proposed consolidated plan is published for comment. Meetings and hearings will be held at times and locations convenient to potential and actual beneficiaries, and with accommodations for persons with disabilities. At least two weeks advance notice will be given to citizens, or as appropriate, units of general local government of each hearing, with sufficient information published about the subject of the hearing to permit informed comment. In order to give adequate notice of public hearings, the City shall publish a legal notice and press release in a newspaper of general circulation prior to public hearings. All legal notices and news releases shall be published at least 15 days prior to the hearing and shall contain the following: * Date and time of public hearing; * Location of public hearing; * Topics to be considered; * Basic information about the program. E. Proposals All proposals for funding must be submitted by February 9, ] 998, prior to the start of the new fiscal year. The City will provide application packets for funding which will include program requirements. Interested parties should contact the City's Administrative Services/CDBG Division in order to obtain an application packet. The City will respond, in writing, to all written proposals within 30 working days and state the reasons for the 4 action on the proposal. Technical assistance will be provided upon request to groups representing low income persons. F. Access to Records: 1. The city will provide citizens, public agencies, and other interested parties with reasonable access to information and records relating to the City's Consolidated Plan, and performance reports. The City will respond to written requests within fiReen (15) working days or as soon as possible thereafter. Records will be available to the public fora five year period. A reasonable number of free copies of the Consolidated Plan will be made available to citizens and groups that request it. G. Technical Assistance To facilitate citizen input, the Gity will provide technical assistance, through its staff, to any community wide or neighborhood associations and to groups of low and moderate income residents of blighted neighborhoods who request such assistance. The city will make available Spanish speaking staff at meetings and hearings relating to the Community Development programs, upon request. H. Public Information To ensure that citizens remain informed of and involved in the program development, and implementation, the City will provide for full access to program information. The following information will be made available during the planning process of the program: a. Amount of entitlement; b. Types of activities previously funded; c. The activities previously funded d. Ineligible activities; e. Schedule of hearing; f. The process used by the City in approving the application; g. The Citizen Participation Plan; h. Other requirements the City deems necessary. 5 Copies of the proposed and final Consolidated Plan, amendments and/or performance report will be made available at Lynwood Libraries, Lynwood City Hall Offices, Lynwood Community/Transit Center and other public places I. Specific Areas of Citizen Participation Citizen involvement will be sought in the development, implementation, monitoring and evaluation stages of the City's program. To assure continued citizen involvement in program development and implementation, a citizen advisory committee was created (CDBGAB Commission) to review all matters related to Federal funding and advise City Council and inform citizens of current Federally funded activities and projects. Citizens will be given the opportunity to review and comment on all aspects of the City's Consolidated Plan, including the opportunity to evaluate projects and activities. J. Complaint Procedures The City will answer written complaints in a timely and responsive manner. Those complaints dealing with the City's Consolidated Plan, amendments and performance report shall be responded to within IS working days. K. Amendments (Substantial Change) The City will amend its Consolidated Plan whenever it decides not to carry out an activity described in the final plan, or to carry out an activity not previously described, or to substantially change the purpose, scope, location, or beneficiaries of an activity or to change its allocation method of distribution, or changes in the use of CDBG and/or Home funds from one eligible CDBG activity to another. Prior to amending the Consolidated Plan, the City shall provide citizens with reasonable notice of, and opportunity to comment on, such proposed changes to the use of funds. The City shall consider any such comments and, if the City deems appropriate, modify the changes. The City shall make available to the public, and shall submit to HUD, a description of any changes adopted. An amendment to the Consolidated Plan will constitute a Substantial Change. A change is considered substantial when the beneficiaries or the scope of an activity increases or decreases by more than 25% in the numbers or amounts budgeted in the Consolidated Plan for that activity, except that changes under $30,000 will not be considered substantial- 6 Ill. ADVISORY BOARD The City has established a Community Development Block Grant Advisory Board. The composition, role and responsibility of the organization is discussed below. A- COMMUNITY DEVELOPMENT BLOCK GRANT ADVISORY BOARD (CDBGAB} - ORGt1NIZATION CDBGAB Size and Appointment The Community Development Block Grant Advisory Board shall have seven (7) members appointed by the City Council of the City of Lynwood. 2. Representation In making appointments to the CDBGAB, the City Council shall insure reasonable representation of the community, including age, sex, racial background, income levels, and disabled. 3. Terms of Office Members of the CDBGAB shall serve a maximum of four (4) years. Terms will be staggered to provide overlap of approximately half of members. 4. Selection ofOfficers The CDBGAB shall have a Chairperson and Vice Chairperson. Both shall be elected from and by the members of the CDBGAB each year at the first meeting after the newly appointed members are present. >. 1acancies When vacancies occur, the_ City shall publish a notice, or press release in a publication locally circulated, which invites interested persons to make their interest known to the City Council. A position will automatically be declared vacant if a CDBGAB member has three (3) consecutive absences. 6. Meetings The CDBGAB shall meet on the first Wednesday of each calendar month, at City Hall, 11330 Bullis Rd., Lynwood, CA , 90262. All meetings are open to the public. Announcement of any changes in the regular meeting date shall be posted at least fifteen (15) days -prior to the meeting. 7 In addition, the CDBGAB shall hold special meetings to discuss and obtain public input on the City's Consolidated Plan and Grantee Performance reports. The City's CDBG staff will be present at all CDBGAB Commission meetings and advise the CDBGAB Commission on eligibility and other Hi JD regulations. B. Role and Responsibilities l . Advise Crty Council The CDBGAB is an advisory committee to the City Council in matters relating to Community Development Block Grant programs. 2: Public Information CDBGAB Commissioner shall participate and encourage citizens of their respective neighborhoods to participate in the process of developing and implementing the Consolidated Plan. The CDBGAB Commission shall also share information regarding the Consolidated Plan activities with citizens and invite participation and input during their scheduled meetings. 3. Consolidated Plan The CDBGAB Commission shall be involved in the development and/or the review of all elements pertaining to the planning and preparation of the annual Consolidated Plan application. Based on that planning, preparation, community needs and citizen input, the CDBGAB Commission will make specific funding and program recommendations to the City Council. q. Needy and Objectives The CDBGAB may conduct community development needs assessments and review community development objectives as deemed necessary by the CDBGAB or required by regulations. 5. Citizen Participation Plan 8 The CDBGr1B shall review the Citizen Participation Plan for adoption by the City Council annually and recommend such changes as deemed appropriate to the City Council. 6. Itehahilttation Loan Review and Approval The CDBGAB will also act as the Loan Review Cornmittee. Final approval approval of all loan and grant assistance will be made by the CDBGAB. An applicant whose application has been denied by the CDBGAB may appeal the Board's decision to the City Council. C. Communications Publishing The Citizen Participation Plan The CDBGAB shall work with the City staff in the publishing and distribution of the Citizen Participation Plan. 2. Information Bulletins The CDBGAB shall publish timely information bulletins concerning their activities and Housing and Community Development activities in the City, as deemed necessary. 3. Minutes City staff shall provide for the taking of Minutes at meetings of the CDBGAB. The Minutes shall be provided to members within a reasonable period of time and made available for public inspection. 4. Staff Commwtication When .information is requested by the CDBGAB from the City staff, that information shall be provided to the CDBGAB , in written form with Minutes, or in the packet of information provided to the CDBGAB prior to each CDBGAB meeting. 5. Local Press The CDBGAB will work with City staff to provide timely reports to the local press on housing and community development activities. 6. Community Groups 9 The CDBGAB shall determine methods of providing information to community groups which are active in housing and community development or other activities relating to citizen involvement, affirmative action, etc. D. Public Hearing and Meetings: Grant Application The CDBGAB when requested shall assist the City Council in conducting the public hearings on the grant application for funding of the Community Development Block Grant and HOME programs. 1 Public Meetings All CDBGAB meetings are open to the public. The role and responsibilities of the Commission are covered under Section III of this plan. Minutes or summaries of the meetings shall be provided by the City. 2.
