Gwynn; Town Clerk Barbara Gwynn; Chief James Greer; Attorney Maureen Hackett; Residents of the Town of Gulf Stream The meeting was called to order by Mayor Koch at 9:00 A.M. Upon changes made and agreed upon by the Commission, motion was made and seconded to accept amended minutes to the January 8, 1982 Commission meeting. Town Manager Gwynn then presented the Financial Reports for the month of January, 1982. Upon motion made and seconded, the Commission approved the Financial Reports. It was noted at this time that the City of Delray Beach may impose a rate increase on water useage. Gulf Stream would then, in turn, increase their rates in proportion to Delray's increase. The Conrtnmissicn would keep the residents informed of this matter. Chief James Greer then presented the Police Report for the month of January, 1982. He reminded the Commission and residents of the Crime Watch Program to be held February 23, 1982 at 10:00 A.M. at the Gulf Stream Golf Club. He also made mention that he and Town Clerk, Barbara Gwynn, had net with John Wilson, Department of Transportation. The State will be repainting the double yellow lines on AlA and placing "S" curve signs at various parts of AIA. The results of the Planning Board Meeting of February 11, 1982, were then presented by Commissioner Dixson. He stated that approximately 25 changes were presented to the Planning Committee for review to correct those internal inconsistencies of the entire Code of Ordinances, which changes would begin the second phase. After review of these changes by the manbers of the Planning Board, they would set a second meeting and then report to the Commission their recommendations. The Commission then discussed the matter of dredging the canals. Town Manager Gwynn read a letter from Shalloway Engineers, Inc., who were requesting a joint project between their clients and the residents of Gulf Stream, living along the canals, to dredge the canals which would cost less for those involved. There was a discussion to create a taxing district for residents along the canal to bear the cost so those residents not residing along the canals would not bear the responsi- bilities of the cost. Commissioner Armour presented his findings of the operation involved in dredging the canals. He stated he would do further research, particular- ly that of the costs, and report his findings at a later Commission meeting. It was pointed out that only water front property owners would pay the costs involved. Page Two Commission Meeting February 11, 1982 The Commission then discussed the need to appoint someone to the Commission to fill the vacancy of Joan LaPorte. Commissioner Armour recommended to the Commission to consider Brian Pfeifler for the vacancy. There was then discussion among the Town Commission concerning Section 3.06(c) of the Town Charter as to the wording and of the appointment to the vacancy of the Commission seat until the next election. It was further discussed that under the Hone Rule, the Town is given the right to appoint someone to fill a vacancy until the next general election. The Commission instructed Attorney Maureen Hackett, to bring this question to Attorney John Randolph for his legal opinion and for him to advise the Commission of this matter at the next Commission meeting. After much discussion among the Commission members and comments from the residents, motion was made and seconded to appoint Brian Pfeifler as Commission member. There was discussion among the Commission and residents regarding dissatisfaction. with Leadership Cablebision. Town Clerk Barbara Gwynn was instructed to write a letter to Leadership Cablevision in reference to the complaints received. Mr. Henry Wright, resident, voiced his problem of Old School Road being under water after a rain due to improper drainage. It was suggested that he check with his neighbor to obtain an easement to run a culvert to the pond to drain the water fron the street. Commissioner Armour stated that after the meeting, he would go with Mr. Wright to look over the matter to see what could be done about the problem. Y. BYRD, OF COUNSEL We represent the Estate of Cecile J. Johnson which has certain property located within the Town of Gulf Stream boundaries. We are aware that the Town of Gulf Stream is considering new zoning changes concerning the size of building lots in the town. We feel that the proposed changes are too restrictive insofar as existing platted lots are concerned and we, accordingly, object on behalf of the estate to the proposed change on the theory that an existing platted lot should be able to build without going through a special permission procedure.
