LaPorte who had resigned earlier. Motion was made and seconded to adopt Resolution #82.3. A Resolution of Appreciation to former Vice Mayor Joan S. LaPorte. Resolution 82.b A RESOLUTION OF APPRECIATION OF THE T0M OF GULF STREAM, PALM BEACH COUNTY, FLORIDA. c Comni.ssioner Pfeifler reported on the March 9, 1982 Planning Board committee Meeting. He informed the Commission that they have now completed Phase one by changes in the Zoning Ordinance as directed by the Commission and was now requesting the Commission's desire whether to proceed with Phase Two. He noted three areas felt by the Planning Board in need of completion as soon as possible: 1. To clean up inconsistencies and ambiquities in the Town's present ordinances. 2. To draw up an Official Town Base Map. 3. To make a Re- Zoning change which first requires changing the Land Use Plan. Gene Caputo then gave a breakdown of costs to complete this Phase explaining the total package to cost fron $12,000 to $15,000. The following is a breakdown of charges: 1. The Official Town Base Map - $1,000. This would include the total cost of any resurveying. The Map would include 8 areas that contain specific references that would locate them in one central place. 2. Clean Up the Ordinances - approximately $5,000 to $5,500. This would include Mr. Caputo's and Mr. Randolph's fee. 3. Re- Zoning would cost between $5,000 and $6,000. Commission Meeting March 12, 1982 Page Two After a general discussion, the Commission instructed Commissioner Hunter and Manager Gwynn to review the Town's financial status and report to the Commission at the next regular meeting whether they can proceed with the entire Second Phase or to take one step at a time. Commissioner Dixson wanted his position to be very clear that the total job the Committee has undertaken be "completed as soon as possible for the protection and interest of the people of this Community ". The Commission agreed. Mr. Jerry Church, City Engineer for the City of Delray Beach explained to the Commission the problem concerning the right turn lane at AIA and 8th Street. He noted that the present plan regarding sharing cost with Delray Beach to install this extra lane would only be a temporary measure and inadequate for a complete solution as envisioned by the Department of Transportation and denied by the City of Delray Beach. It was the opinion of the Commission that this project be done according to the D.O.T.'s specifications and that it is their responsibility. They explained their support for Delray's Engineer and thanked him for his work on this project. The Commission elected not to take any action at this time. The Minutes of the Commission Meeting on February 12, 1982 were approved by the Commission. Manager Gwynn read a letter received by Commissioner Hunter from Governor Graham regarding the burdenson paperwork, etc., in the annual financial reports. Manager Gwynn was also instructed to send copies of this letter to the Florida Municipal League. This letter is a part of the Minutes. Manager Gwynn also read a letter to Mr. Hunter from the American Institute of Certified Public Accountants, also concerning the auditing procedure. Manager Gwynn explained they are still inquiring about other accounting firms to audit the books next year. He would report on this at a later date. He then presented the Financial Report for the month of February 1982. Upon motion made and seconded, the Commission approved the Financial Reports. Commissioner Armour explained the problems and cost concerning dredging all canals in Town. The total cost would run approximately $675,000. The Commission felt this is another very serious problem and something should be done. He also daid there are two ways to do this: 1) Approve the expenditure of approximately $3,700 right now, this would provide a survey of the canals, and 2) then decide if they were going to create a tax district or assess the property owner. The Commission instructed the "Financial Advisors" to review the budget and report at the next meeting if they could spend $3,700 so this project could proceed during this fiscal year. The Commission then discussed the proposed Water Rate increase by the City of Delray Beach. Mayor Koch explained they have requested a $6.73 per month basic charge for all household units with a highter charge for nonresidential users. The per thousand water rate would go from 604 to 654. He explained his objections to the nonresidential charge since this is not in the original contract and he would meet with Delray's representatives to discuss this further. The Commission discussed the possibility of absorbing a part of the increase by keeping the same usage rates, which would be approximately $9,000 to $10,000 per year. The Commission instructed the "Financial Advisors" to review the current budget and report at the next meeting. The increase is to be effective April 1, 1982, subject to Delray's final adoption. Connission Meeting i March 12, 1982 C . Page Three A letter from Mr. Henry Wright was then discussed. This letter is a part of the Minutes. The Camdssion approved his request to change the name of the street at the west end of Old School Road and which runs perpendicular to Old School Road to "Wrightway" at his expense. The Commission agreed to approve drainage plans as submitted by Harvel & Deland for a drainage problem existing at the end of Old School Road and Orchid lane. Residents affected by this problem are to be notified and a public hearing will be held at the next commission meeting. An assessment will be paid by the benefitting property owner. A motion was made to deposit with the City of Delray Beach $6,022.50. This is according to the water agreement between the two com=ities. Town Manager Gwynn read a letter from Leadership Cablevision regarding the fact that they have added additional lines for complaints. This letter is made a part of the minutes. Town Manager Gwynn read a letter addressed to LaHermitage, the new condominium development on the corner of AlA and Sea Road concerning the fact that they are not in the Town of Gulf Stream yet they are advertising that they are within the town limits of Gulf Stream. A copy of this letter was also sent to Alice Scaggs, Director of Consumer Affairs. This letter is made a part of the minutes. Approval was granted to Mr. Dittman to replace a water hydrant located on his property. Approval must first be granted from the Town's fire marshall before replacing the hydrant. Chief Greer gave the monthly police report. The report is made a part of the minutes. He also discussed the problem of false alarms noting that several residents are now in violation. The commission agreed the Ordinance must be enforced. While we have not received any previous complaints from municipalities on this requirement,, I will have my staff r j , contact the Comptroller's Office and review this matter to determine the need for the reporting requirements. While there is a legitimate need for the State to receive local government information, particularly so that complete fiscal analyses can be made of legislative bills, I am concerned that the State does not overburden local govern- ments in requiring extraneous information. I will be back in contact with the City of Gulf Stream when our review is complete. The sales brochure which you refer to attempts to give prospective purchasers a generalized understanding of the project's location in the overall context of south Palm Beach County. The brochure not only discusses its proximity to the Town of Gulf Stream but makes mention of it's proximity to Boca Raton, Boynton Beach, Delray Beach and Palm Beach. Obviously, the intent of the bro- chure is not to suggest to prospective purchasers that the project is located in any or all of these communities. It merely seeks to inform prospective purchasers of various cultural, shopping, res- taurants and entertainment complexes and businesses in the surrounding areas. I would anticipate that a developer building a project that was within the Town of Gulf Stream would include in his sales brochure similar information for his prospective purchasers, mentioning the Town of Gulf Stream's proximity to Boca Raton, Palm Beach, etc. Recently, in the Boca Raton area, the Mayor of Boca Raton wrote to various developers building projects in the area west of the City. He requested that they set forth clearly in their sales material that their projects are not within the City of Boca Raton. It was suggested that these developers should designate in their sales material that their projects are "near" Boca Raton. My client has instructed their sales staff to make it clear to prospective purchasers that the project is not in the Town of Gulf Stream and any future sales material that is prepared will clearly set forth that the project is "near" the Town of Gulf Stream. After the February 12 Town Hall Meeting, I spoke to you and your husband about the possibility of changing the name of the street at the end of Old School Road which goes perpendicular to that road to Wrightway instead of being called Old School Road which is quite unusual when it goes at right angles to Old School Road at the circle at the end. I was informed that this had to be, of course, approved by the Town Commission and that it was not a complicated matter. I would like to state that, if the Town Board is willing to make this change to Wrightway, I would be willing to pay all expenses involved in the name change such as putting up the sign, etc. For the record, I am the only person who lives on that street, owning 570 Old School Road which, in effect, could be considered to be on Wrightway and 600 Old School Road which actually is on that road. I realize there is a lot or two lots at the end which are now vacant and owned by someone who lives down by the Hillsboro inlet in Florida. It would seem to me this would be the appropriate time to do this now that a new ordinance is being put through by a committee on the Town Board. Also, I would hope that the Town Commission would consider taking me off of that island I have been living on at the end of Old School Road, per my request at the Town Meeting which I bring up or have brought up yearly for the last six years. I shall be in attendance at the Town Hall Meeting in March and will be glad to answer any further questions the Commission may care to bring up on either one of these matters.
