AN ORDINANCE OF THE CITY OF McCALL, IDAHO, RELATING TO THE
PHYSICAL LOCATION OF WATER METERS; AND REQUIRING ACCESS; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL,
IDAHO, AS FOLLOWS:
Section 1. The Council finds that the standard configuration of water connections has
changed in accord with the City's Water Master Plan and that an amendment to
the City Code is necessary accordingly.
Section 2. The McCall City Code, Title 6, is amended in pertinent part as shown below, in
the form with as required by Idaho Code new language underlined, and matter to be deleted
struck through:
6-2-170: METER REQUIRED: All water service connections shall be metered with a
water meter at or near the curb stop between the curb stop and the improvements on the
premises, in a meter pit meeting the standard established by the Public Works Department,
and equipped interior to the structure on the lot with a remote electronic data transmission
device read out mounted on the exterior of the structure.
(A) The City shall install meters on all existing services not currently metered, and

owner of the premises structure to which the service is provided or to be provided
connected shall permit City crews to enter the premises for purposes of making the
installation at a reasonable time during City working hours; any owner who fails to
cooperate with the City in this regard shall, at the option of the City, be subject to:
1. Disconnection of the service; or
2. Billing for the water service at twice the average bill for users of the
same class; er
3. City provision at the customer's expense of a meter exterior to the

1. The customer provides a source of heat to the meter and the
connection from meter to structure, and
2. Permits installation of a remote rc\ad out or data panel on the
Structure.
(B) All construction to which a service connection is made after the effective date of this
ordinance shall be equipped at owner's expense with
1. a water meter meeting City specifications located in the meter pit a crawl

2. a remote, electronic read out or data transmission device collection panel

location which is accemiblc ymr round.
Such specifications shall be obtained from the Public Works Director, and locations

meter of freezing or of cold weather.

(D) All water use connections or taps to the user service shall be drawn downstream (on
the user side) of the meter, including but not limited to lawn irrigation. Existing taps
on services positioned upstream of the meter shall be modified at owner expense to
comply with this paragraph.
{E)[D] Cross connections are strictly prohibited, and any service with a cross connection or
potential cross connection shall be protected by a back -flow prevention device
acceptable to the Public Works Director.
{F {E] The water service connection between the curb stop and the place of use by the
customer is the property of the customer: provided that the City owns and is
responsible for maintenance of the meter and meter pit. The City owns and is
responsible for connections between the meter and the curb stop in the standard
configuration where the curb stop and the meter are proximate to each other. The

the owner of the real estate under circumstances where a meter is located within a
structure or at a location interior to the premises as is common to facilitate delivery to

The owner's water connection property shall be maintained by that owner.
Section 3. This Ordinance shall be in full force and effect from and after its passage,
approval and publication as required by law.

1. That pursuant to the provisions of Section 50-207, Idaho Code, I keep a correct journal of the
proceedings of the Council of the City of McCall, Idaho, and that I am the statutory custodian of all laws, ordinances
and resolutions of said City.
2. That the attached Ordinance No. 717 is a true and correct copy of an ordinance passed at a regular
meeting of the Council of the City of McCall held on October 9, 1997, and duly recorded in my office; and
3. That said regular meeting was duly convened and held in all respects in accordance with law and to
the extent required by law, due and proper notice of such meeting having been given; that a legal quorum was
present throughout the meeting and that a legally sufficient number of members of the Council voted in the proper
manner and for the passage of said ordinance; and that all other requirements and proceedings incident to the proper
adoption and passage of said ordinance have been duly fulfilled, carried out and observed; and that I am authorized
to execute this certificate.
