APPROVING PROFESSIONAL SERVICES CONTRACT-
JAMES F. CLARKIN, III, ESQ.
WHEREAS, the Borough of Carteret is in need of specializedegal services
with regard to the appeal in the matter of Grace Maffia v,. Borough of
Carteret Zoning Board of Adjustment and the Borough of Car:eret, Superior
Court of New Jersey, Law Division- Middlesex County, Docht No. MID-L-
5772-03; and
WHEREAS, James F. Clarkin, III, Esq. presently serves as tLe attorney for
the Zoning Board of Adjustment and possess the requislte e~perience and
expertise to provide said specialized legal services; and

WHEREAS, the Borough Attorney has recommended the aJpointment of
James F. Clarkin, III to prosecute the appeal in the above refererced matter at
a rate not to exceed a maximum cost of $2,536.44; and
WHEREAS, the Chief Financial Officer has certified that f:mtls are or will
be available for said purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of
the Borough of Carteret that James F. Clarkin, III, Esq. is hereby appointed
special counsel to prosecute the appeal on behalf of the C~,ieret Zoning
Board of Adjustment in the above described matter at a maximum cost not to
exceed $2,536.44.
BE IT FURTHER RESOLVED, that this appointment is made as a
professional service as defined byN.J.S.A. 40A:II-2(6).

THE CONTRACTOR does hereby agree to perfonn the following:
PROFESSIONAL LEGAL SERVICE IN THE MATTER OF MAFFIA VS BOROUGH
OF CARTERET ZONING BOARD OF ADJUSTMENT.
NOT TO EXCEED $2,536.44.
according to the tenns set forth in RESOLUTION.
THE BOROUGH does hereby agree to pay the Contractor the sum set
forth in Resolution.
