The meeting was called to order by Mayor Koch at 9:00 a.m.
The minutes of the Commission Meeting of May 14, 1982 were approved by the
Commission.
Town Manager Gwynn presented the Financial Report making note that on the
statement Cash Projection, it shows that in the two month period, June through
August, we will be redeeming one of the Certificates of Deposit. He also
noted that the correction on the spread sheet, Revenues and Expenditures, All
Funds, Year to Date, Total All Funds, it reads, $507,006 and should read
$517,879, changing the bottom NET REVENUE from $114,095 to $124,968. Upon
motion made and seconded the Commission approved the Financial Report.
Chief Greer presented the police report for the month of May 1982. He stated
there had been two burglaries in the past month and the perpetrator had been
identified. Mrs. La Porte gave her praise and respect for the work of Chief
Greer and his department in handling her case.
With regard to the plans submitted by the Gulf Stream School, discussion was
held concerning the parking facilities, the landscaping and the new building
under consideration. Mayor Koch stated that it should be understood that
the master plans submitted would be filed with the Town and if one building
is built, they will have to remove an existing building and that the land-
scaping as noted will be done. Also that there will be no more than maximun
250 students with no more employees than they have at present.
Mayor Koch explained the former Drainage Agreement between the Town and the
Little Club and informed the Commission that he has contacted the Little Club
to enter into a new agreement which has to be done within the next two years.
The new contract would stipulate that Gulf Stream would only pay 35% of the
Operating cost. However, when someone builds on one of the five empty lots,
an additional 2% would be added tgrthose lots. Upon motion made and seconded
the Conmssion approved the new agreement between the Town of Gulf Stream and
the Little Club.
Resolution 82 -6 was read by Manager Gwynn concerning the transferring of the
8th Street Bridge in Delray to Delray Beach. Motion was made and seconded
to approve this Resolution.

Mrs. Gwynn gave an explanation of existing problems regarding the clearing of
lots with fences around then and asked for a legal opinion. Miss Hackett
read Section 8 -7 and stated that she feels the problem warrants further study
before the Town enters any property.
A discussion was held by the Commissioners with regard to the setback regula-
tions. Mr. Dixson stated he would like a legal opinion on the existing build-
ings which may be in violation of the setback regulations. Mr. Koch said that
upon the completion of the Ordinance revisions, the Town would, among other
things, spell out exactly what requirements are necessary to clarify the set-
back definitions and regulations. Following a brief discussion, Mr. Pfeifler
made a motion to drop the subject, which motion was seconded and passed with
Mr. Koch abstaining and Mr. Dixson casting a negative vote.
Mr. Armour reported on the dredging of the Town's canals progress and informed
the Commissioners that 90 property owners have been contacted and 52 checks
have been received to date. It was decided that telephone calls will be made
to those who have not responded.
Mrs. La Porte volunteered to work on the Library and suggested more shelves
should be added to house the books.
After discussion with regard to dangerous hedges and shrubs which could be
hazardous to drivers, it was decided to make telephone calls to the specific
property owners to see if the problems can be resolved.
There being no further busines, the meeting was adjourned at 10:00 a.m.

AGREEMENT
THIS AGREEMENT entered into as of this gTH day of
OCTOBER , 1982, by and between the TOWN OF GULFSTREAM, FLORIDA,
(hereinafter referred to as "the Town ") and THE LITTLE CLUB, INC.
of the Town of Gulfstream, Florida (hereinafter referred to as
"the Little Club ").
facts:
This contract is entered into based on the following
WITNESSETH, That:
WHEREAS, the Town is in need of additional drainage
facilities; and
WHEREAS, the Little Club owns and is presently using
an electrical pump which has a capacity in excess of the Little
Club's present drainage requirements.
NOW, THEREFORE, the parties hereto do mutually agree
as follows:
1. The Little Club hereby agrees that it shall provide
to the Town for a period of ten (10) years from the execution of
this contract use of the electrical pump and drainage facilities
connected thereto now in its possession for use by the Town as
a drainage facility.
2. Such a use shall be limited to the capacity of the
pump and drainage facilities in excess of the needs of the Little
Club.
3. The Town hereby agrees to pay as its prorata share
of the use of such facilities, a base of 35 percent of the cost
of operation, maintenance, repair and replacement of the drainage
facilities including the electrical pump, culvert and any other
items necessarily connected to or a part of the drainage facility.
In recognition of the fact that five lots which are subject to
the terms of this agreement are vacant, the Town agrees to pay
to the Little Club, as the Town's prorata share, an additional 2%
for each lot upon which a dwelling is constructed. In no event
shall the Town pay a prorata share in excess of 45% of the cost
of operation, maintenance, repair and replacement of the
drainage facilities. The cost of use shall include reasonable
depreciation expenses of the pump and other depreciable com-
ponents of the system. Cost of replacement shall include purchase
price and installation and labor charges for any of the components
�,. replaced due to damage, wear, accident, or any other cause.
ii 4. The Little Club hereby agrees to pay as its prorata
share the remaining 5
g percent of the cost of operation, maintenancE
repair and replacement of the drainage facilities, including the
electrical
Pump, culvert, and any other items necessarily connected
to or a part of the drainage facility, said amount to be reduced
1 by 2% for each one of the five lots, upon which a dwelling is
I constructed. In no event shall the Little Club's prorata share

ii be less than 55% of the cost of operation, maintenance, repair
and replacement of the drainage facility.
5. All costs of operation, maintenance, repair and
replacement of the drainage system shall be ordinary and reasonable.
All costs of maintenance, repair, or replacement shall be reported
by the Little Club to the Town in monthly intervals. The Town
shall inform the Little Club of any expense it determines to be
unreasonable and the parties shall at that time attempt to negotiate
to determine reasonable expense. In the event agreement is not
reached after thirty (30)days, the parties shall submit the con-
troversy to arbitration.
6. This contract is based on the present requirements
of the parties with regard to drainage facilities and shall be
renegotiated in the event either party's requirement changes
substantially during the term of this contract.
7. In the event the Little Club sells or substantially
changes the use of the property upon which the drainage system is
located, it may cancel this contract upon six (6) months' notice
to the Town.

8. the Town acknowledges that the Little Club has
not made any representation to it concerning the adequacy of said
drainage system and the Town agrees to defend and hold harmless
the residents against said Club arising out of the use of the
above described drainage system by the Town.
IN WITNESS WHEREOF, the Town and the Little Club have
executed this Agreement as of the date first above written.

RESOLUTION NO. 82 -6
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF
GULFSTREAM, FLORIDA, EXPRESSING ITS STRONG OPPOSITION
TO THE TRANSFER TO THE CITY OF DELRAY BEACH OF THE
RESPONSIBILITY FOR OPERATION AND MAINTENANCE OF
NORTHEAST EIGHTH STREET FROM SWINTON AVENUE TO SR
AIA INCLUDING THE DRAWBRIDGE OVER THE INTRACOASTAL
WATERWAY AND URGING RECONSIDERATION AND THE
RESCINDING OF THIS TRANSFER; PROVIDING FOR FURNISHING
COPIES OF THIS RESOLUTION.
WHEREAS, the Town Commission is in receipt of certain information from the City of
Delray Beach, Florida, stating that it has received correspondence from the Palm Beach County
Department of Engineering informing that, pursuant to Florida Statutes Section 335.04, the Board of
County Commissioners of Palm Beach County has adopted Resolution R -81 -621 transferring certain
roads "functionally classified" as city streets from the County to the City of Delray Beach, Florida;
and,
WHEREAS, this proposed transfer of streets from the County will result in the transfer
of responsibility to the City of Delray Beach for maintenance and operations of certain streets,
including Northeast Eighth Street from Swinton Avenue to SR AIA, which includes a drawbridge over
the Intracoastal Waterway; and,
WHEREAS, the estimated annual cost for operation and minor repairs to the Eighth
Street bridge is $120,000.00, which is approximately .1 mil of the City of Delray Beach's total
property tax; and,
WHEREAS, such an expense will impose an extreme hardship on the City's taxpayers, and
may force the City of Delray Beach to undertake drastic measures to abate this additional expense;
and,
WHEREAS, this section of Northeast Eighth Street, including the drawbridge, serves
primarily to link U.S. 1 with SR AIA, is used as the primary access point for the residents of the
Town of Gulfstream, and serves only a secondary function as a city street for the City of Delray
Beach; and,
WHEREAS, apparently there is no other drawbridge in Palm Beach County that is
required to be maintained and operated by a municipality, with the attendant overly burdensome
cost; and,
WHEREAS, the Town Commission of the Town of Gulfstream, Florida, wishes to express
its strong opposition to the transfer of maintenance and operation responsibility from the County to
the City of Delray Beach of Northeast Eighth Street, with its drawbridge, and to urge that Palm
Beach County rescind that portion of their Resolution No. R -81 -621 attempting to transfer Northeast
Eighth Street to the City of Delray Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF
GULFSTREAM, FLORIDA, AS FOLLOWS:
Section I. That the Town Commission of the Town of Gulfstream, Florida, does hereby
express its strong opposition to the transfer from Palm Beach County to the City of Delray Beach of
the responsibility for the operation and maintenance of Northeast Eighth Street from Swint

Avenue to SR AIA, including the drawbridge over the Intracoastal Waterway, and hereby urges t o
he
Board of County Commissioners of Palm Beach County to reconsider this matter and to rescind that
portion of their Resolution No. R -81 -621 which attempts the transfer of the subject public right of
way.
Section 2. That the Town Clerk is hereby authorized and directed to furnish copies of
this Resolution to each member of the Board of County Commissioners of Palm Beach County, the
County Administrator, the County Engineer, the City of Delray Beach, and all other appropriate
public officials and agencies.
