Home My Public Portal AboutOrd. 765 - Eliminating The City of McCall Area Of City Impact Joint Planning and Zoning CommissionORDINANCE NO. 765 AN ORDINANCE OF THE CITY OF MCCALL, VALLEY COUNTY, IDAHO, AMENDING TITLE 3, CHAPTER 1, OF THE MCCALL CITY CODE, ELIMINATING THE CITY OF MCCALL AREA OF CITY IMPACT JOINT PLANNING AND ZONING COMMISSION; PROVIDING FOR OTHER MATTERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of McCall, Idaho is a municipal corporation organized and operating under the laws of the State of Idaho; and WHEREAS, pursuant to Title 67, Chapter 65, Idaho Code, the City of McCall has the authority to create a planning commission; and WHEREAS, the Mayor and Council have determined that good cause exists for amending the McCall City Code to eliminate the City of McCall Area of City Impact Joint Planning and Zoning ,Commission. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, Valley County, Idaho, as follows: SECTION 1: Title 3, Chapter 1, Section 030 of the McCall City Code is hereby amended to read as follows: 3-1-030: COMMISSIONS CREATED: (A) There is created a Planning and Zoning Commission the jurisdiction of which consists of matters relating to lands within the City limits of the City of McCall and matters entrusted by the Idaho Code to the Planning and Zoning Commission of the City, referred to in the rest of this Title as the Planning Commission and/or the Commission. SECTION 2: Title 3, Chapter 1, Section 040 of the McCall City Code is hereby amended to read as follows: 3-1-040 QUALIFICATIONS; TERM OF OFFICE: (A) The Planning Commission shall consist of five (5) members appointed by the Mayor with the consent of the Council and without respect to political affiliation. All members shall be residents of the City or have resided in the McCall Area of City Impact for a period of at least two (2) years prior to appointment. The commission membership shall be made up of members from the McCall Area of City Impact and the McCall city limits in approximately the same ratio as the population of the City of McCall and the McCall Area of City Impact, respectively. As an example, if the population of McCall were 2,000, and the_population in the McCall Area of City Impact were 500, then the Commission would be made up of 4 members who reside within the city limits and one member who resides in the McCall Area of City Impact. (B) Members of the Commission may be removed for cause by a majority vote of the Council. Chronic absenteeism shall be considered cause for removal. In the event of the death, resignation or any other vacancy in said commission, the Mayor and Council shall fill such vacancy in the manner prescribed by law. SECTION 3: Title 3, Chapter 1, Section 060 of the McCall City Code is hereby amended to read as follows: 3-1-060. COMPENSATION; REPORTS; MEETINGS. (B) The Commission shall hold at least one meeting each month on a regular day and at a regular time fixed in its By -Laws. Pending adoption of such By -Laws by resolution of the Commission approved by resolution of the Council, the Commission shall hold a meeting on the first Tuesday of each month at 7:00 p.m., unless there is no business to transact. The Commission shall meet at such other times as may in its judgment be necessary. SECTION 4: Title 3, Chapter 1, Section 070, Subsection A of the McCall City Code is hereby amended to read as follows: 3-1-070 DUTIES: The duties of the Commission are to: (A) Recommend a comprehensive plan for the development of the planning jurisdiction, the laying out, widening, extending and locating of streets, roads and highways for the relief of traffic, for density of population and development of land within the jurisdiction of the planning jurisdiction, for the future growth, development and beautification of the planning jurisdiction with respect to its public buildings, streets, parks, grounds and lands consistent with the future growth and development of the planning jurisdiction, all in order to promote the public health, safety and welfare of the inhabitants thereof, and to give suggestions and advice to individuals concerning landscaping or location of buildings, structures or works to be erected, constructed or altered by or for such. SECTION 5: This ordinance or a summary thereof, shall be published once in the official newspaper of the City, and shall take effect upon its passage, approval, and publication.
