COMMISSION MEETING JULY 9, 1982 PRESENT: WILLIAM KOCH, JR. JOEL HUNTER ALAN I. ARMOUR ROBERT DIXSON BRIAN PFEIFLER Also Attending: Town Manager William E. Gwynn; Town Clerk Barbara Gwynn, Attorrney John Randolph; Lieutenant James Mahoney; Plann- ing Board members William Mayer, Kenneth Rubsamen; Assis- tant Town Clerk Nancy Adams; residents of the Town of Gulf Stream. The meeting was called to order by Mayor Koch at 9:00 A.M. The minutes of the Comrnission Meeting of June 18, 1982 were approved as corrected. The Financial Report for June, 1982 was approved. Attorney Randolph mentioned that the County would not be returning any funds from the Road and Bridge Fund this year and said he felt that Kelton & Assoc- iates in their report will give an opinion of the status of the Road & Bridge Fund allocations and upon hearing from them the individual municipalities will then decide upon legal action. Lieutenant Mahoney presented the Police Report for the month of June, 1982. This report is made a part of the minutes. Commissioner Dixson co viended the Police Department for a very fine piece of work on solving the burglary cases which occurred in June. Town Manager Gwynn presented the first reading of Ordinance 82 -2, concerning flood insurance. Motion was made and seconded to approve this Ordinance on first reading. Motion was passed. AN ORDINANCE OF THE TOWN 00x7MISSION OF THE TOWN OF GULF STREAM, FLORIDA, AMENDING CHAPTER 6 OF THE CODE OF ORD- INANCES RELATING TO FLOOD CONTROL BY AMENDING SECTION 6 -22 THEREOF TO PROVIDE AND DEFINE THE AREAS OF SPECIAL FLOOD HAZARD IDENTIFIED BY THE FEDERAL EMERCENCY MANA- GEMENT AGENCY THROUGH A SCIENTIFIC AND ENGINEERING RE- PORT ENTITLED "THE FLOOD INSURANCE STUDY FOR THE TOWN OF GULF STREAM" DATED 9/30/82 WITH ACCOMPANYING FLOOD INS - SURANCE RATE MAPS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR EFFECTIVE DATE. Ca44ISSION MEETING July 9, 1982 Page 2 Mr. Robert Dittman explained the Variance Request on Mr. Barry Eavenson's C ' property located in back of Place Au Soleil on the north side. Following is a general description of the requests. 1. A Variance is needed as to the side yard setback on the north side of the property reducing side yard setback from 15' to 121. 2. A rear yard setback Variance is needed to fit a house on the property reducing the rear setback from 15' to 15 %, whichever is greater, to 15'. 3. "A provision in the Town's Ordinances is ambiguous as to whether lots in the Town are required to have a continuous width of 100'." Thus, the third Variance he is seeking is to determine that the provision of the code requiring a 100' front yard width shall not apply to the totality of the depth of the property. 4. A Variance is needed that the Platting requirements of the Code be exempted provided that the deed restrictions to be used on Parcel B, reviewed by Mr. Randolph and filed with the Town Clerk on July 9, 1982, as modified by the July 8, 1982 written agreement between Mr. Eavenson and Place Au Soleil Hone Owners Association, shall be made a condition of the Variance waiving platting requirements on Parcel A. Attorney Randolph stated his concern was the dividing of the Parcel B into _ several different sub lots and without any provisions as to what would happen to those because they would be undersized and he wanted some deed restrictions to protect the Town with regard to those. He said these deed restrictions do that and these properties can only be sold to the adja- cent homeowners and can only be used for recreational purposes, incidental to the main use and those uses would have to be approved by the Town. Discussion was held and the motion was made and seconded to approve the recomiendation of the Planning Board to accept the Variance request. The motion was passed. Mayor Koch stated that he felt Commissioners should refrain from attending Planning Board Meetings in the future as members may be asked to go to court. Attorney Randolph pointed out that other muncipalities have a pol- icy whereby if it's a body that recommends to the Commission, then the Commissioner himself would not attend those meetings because there could be some accusation at a later time that the Commissioner had made up his mind prior to the recommendation. Mr. Dixson felt he had been attending some meetings in a sincere attempt to provide the committee with his ex- perience and his long years with zoning matters in a purely objective manner and as a volunteer property owner, not as a member of the Camiss- ion. He stated he would be guided by Counsel's recommendation. Attorney Randolph said he thought it was good that Commissioners refrained from attending Planning Board Meetings as other communities follow this policy. It was the consensus of the ComLission that they follow this advi®e. C, CCn- IISSION MEETING July 9, 1982 Page 3 Comussioner Armour asked the Planning Board members present if when they approve or disapprove plans, do they take into consideration the drainage of the property. Planning Board Chai=nan William Mayer said they do. Comiissioner Armour then discussed the dredging of canals project report- ing that 67% of the residents have responded with checks. He asked the Commission to extend the awarding of contract date for a month. He is writing a letter, enclosing a picture of a canal to those residents who have not responded urging them to send checks in. Co[miissioner Hunter moved, seconded by Co[missioner Pfeifler that Commissioner Armour be granted an extension. Motion was passed. Commissioner Dixson mentioned that the Civic Association had provided money for the improvement of the grounds of the Town Hall and he felt that the grounds have not been inproved. Mayor Koch stated that Mr. Boucher was in charge and is presently out of town and when he finishes the project, then the Town will take over the maintenance. Town Manager Gwynn read a letter from Channel 42, South Florida Telecommtm- iciation, inviting the Cotmissioners to tour their new facilities. The letter is attached to the minutes. Camiissioner Hunter addressed the Budget preceeding his comments with the statement that there is a ccoplicated problem by the so- called "Rollback" provision of the increase in the State Sales Tax of Olt designed to be shared by the State and municipalities provided the municipalities did not increase their take by way of property taxes. An additional can - plication will be the fact that we do not know what our property assess- ments will be and in particular we do not know what portion of this total assessment will be represented by new construction which will be exempt from the "Rollback" provision. He stated the Town is limited to fixing the appropriate rate of mileage of taxation which is applied to the pro- perty. Manager Gwynn said they define the "Rollback" rate as what the Town brings in this year in dollars to equal the same as last year. He also pointed out that when this meeting was scheduled, we had been pro- mised our Certified roll which we have not received. Regarding salaries - at the present time there is a proposed built -in 10% increase in personal compensation benefits for all employees. Manager Gwynn said that pension contributions are currently mandatory. Now, it has been determined from the pension adviser that the Town can amend the plan so it will no longer be mandatory. Commissioner Dixson said the Town is now providing health and accident insurance for our employees at the Town's cost but not including the employees family. Discussion was held and the feeling was that the Town has a competitive plan now and the Cotmissioners were not in favor of including medical insurance benefits for the families of employees. The Commissioners then discussed starting salaries of Patrolmen, step - plans, longevity, attrition and /or merit increases. The various Comm- issioners discussed the pro's and con's including the effect on the morale of the Department. Special attention was given to the actual take -home pay of the officer. Cammissioner Dixson volunteered with the assistance of Chief Greer, to conduct a thorough research of the benefits of a merit increase program for Budget Year 1984. The Commissioners listened to imput from Chief Special Budget Workshop Hearing July 9, 1982 Page 2 Greer as well as Lieutenant Mahoney as to the various budgetary problems and alternatives, with emphasis on maintaining the proficiency of the Department. The Commissioners felt that the Town should be competitive with the other communities and comparable salaries were furnished by Chief Greer from 24 other communities. It was the feeling that it would be impossible to ob- tain one list which would make the desired comparisons, and perhaps a per- centage increase (mare like 731%) would be more appropriate with the under- standing that Cammissi.oner Dixson and Chief Greer would work on a campre- hensive merit plan for the Budget year following the present Budget year. There was a general discussion of the proposed budget as submitted to the Town Commission. After reviewing the budget in detail, the Town Manager was instructed to revise the tentative budget to reflect a 7'h$ across the board pay raise for all employees. It was agreed that the final budget is to be completed as soon as possible after the certified tax roll is received from the County Property Apprai- ser. The Public hearing meetings are set for September 10, 1982 and September 16, 1982 at 5:00 P.M. There being no further business, the meeting was adjourned at 11:25 A.M.
