HomeMy Public PortalAboutResolution 89-29051 RESOLUTION NO. 89 -2905 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING CONDITIONAL USE PERMIT 89 -1012 TO ALLOW THE DEVELOPMENT OF A COMMERCIAL SHOPPING CENTER AT THE NORTHWEST CORNER OF ROSEMEAD BOULEVARD AND LAS TUNAS DRIVE WHEREAS, a noticed public hearing was conducted on September 5, 1989 in accordance with State Law; and WHEREAS, an Environmental Impact Report prepared in accor- dance with State Law has been completed and certified on January 3, 1989; and WHEREAS, an appropriate General Plan Amendment and Zone Change have been approved; and WHEREAS, the Planning Commission reviewed the proposed commercial shopping center at a duly noticed public hearing on August 8, 1989 and adopted a Resolution recommending approval of said project; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon the findings and conditions of ap- proval enumerated in Resolution 89- 1511PC, the City Council hereby approves Conditional Use Permit 89 -1012. SECTION 2. In addition to conditions enumerated in the above referenced Planning Commision Resolution the following two conditions of approval shall apply. 1. If the Temple City Community Redevelopment Agency ( "Agency ") or the property owner(s) owning property contiguous to the Site as defined in the Disposition and Development Agreement between the Agency and Champion /LBS Development Company Associates, ( "Devel- oper") redevelop all or any portion of the property between the westerly boundary of the Site and the Eaton Wash for commercial retail uses or financial institu- tional uses, Developer agrees to grant a non - exclusive easement(s) for ingress and egress over the portion of the Site which is common area for passenger vehicles and pedestrians in favor of the owner(s) of such property, their successors and assigns, tenants, subtenants, licensees and invitees. Such grant shall be conditioned upon a reciprocal grant of non - exclusive easements for such ingress and egress from such property owner(s) in favor of Developer. Resolution No. 89 -2905 Page 2 2. If the Agency or the property owner(s) owning property contiguous to the Developer Parcel as described in the Disposition and Development Agreement between the Agency and Developer redevelop all or any portion of the pro- perty between the northerly boundary of the Developer Parcel and Hermosa Drive for commercial retail or finan- cial institutional uses, Developer agrees to grant a non - exclusive easement for ingress and egress over the portion of the Developer Parcel which is common area for passenger vehicles and pedestrians in favor of the owner(s) of such property, their successors and assigns, tenants, subtenants, licensees and invitees. Such grant shall be conditioned upon a reciprocal grant of non- exclusive easements for such ingress and egress from such property onwer(s) in favor of Developer. SECTION 3. Conditional Use Permit 89 -1012 shall include the following legally described properties: Lots 69, 70, 71, 72, 73, 74, 75, 76, 103, 104, the south 26 feet of Lot 105 and the east 16 feet of Lot 102 of Tract 3623, Book 40, Page 52 of Maps as recorded in the office of the Recorder, County of Los Angeles, State of California. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 19th day of September, 1989.
