Call to Order and Introduction of Members, Ex -Officio Members and Staff Chairman Hake called the meeting to order at 7:30 a.m. and introduced Board members and asked staff to introduce themselves. A quorum was present to hear the items on the agenda. The following members were designated to vote: Hake, Crabtree, Lacy, and Keating. Mr. Michael and Mr. Cartwright were not designated as eligible to vote due to not being connected to the virtual meeting through video. Those wishing to speak to the Board were sworn in. 2. Procedures Explained Chairman Hake explained the procedures of the meeting. Mr. Barron entered the following documents as exhibits for all items under consideration at the meeting: 1. Communications Received Communication email was provided 6. New Business — Public Hearing Case No. B21001 — 4024 Catalina Drive; Side Setback Variance. Application filed by MRA Construction LLC, applicant, Aaron and Lisa Washburn, property owners, requesting a 3.25 foot variance to the 10 foot side yard setback of the RS -2 district to permit a 6.75 foot side yard setback to permit a garage and pool house addition. The property is located on the north side of Catalina Drive 300 feet east of Welling Green Court and described as Lot 83 of the Emerald Ridge Subdivision, Section 2. Ms. Lewis explained that the property consists of a single family residential home located within an established residential neighborhood. The property owners desire to construct an addition to the house on the side of the structure. In order to accommodate the proposed addition, the property owner has applied for a variance to the side setback requirement.. Mr. Randy Allen- 1805 Greenberry Rd, stated that drew up plans for MRA Construction, and then MRA Construction submitted the application on the homeowners behalf. Ms. Lewis stated the home was constructed in 2001. The setbacks for the RS -2 zoning district are 25' in the front 30' to the rear and 10' on each side. The proposed building addition is 14 feet wide by 57 feet deep, and would function as both a garage and pool house addition. The building addition would intrude 3.25 feet into the side setback area. She stated that a building permit for the construction was issued on 11/18/20. A subsequent survey revealed that the building addition failed to meet the side setback requirement. The Chair opened the public hearing and asked for anyone wishing to speak in favor, opposed, or give any comments on the request. With no one coming forward to speak on the request, the chair closed the public hearing. Ms. Lewis told the committee the required findings appear to be met. The setback variance is requested in order to permit a garage and pool house addition, which is a common feature in the neighborhood. Given the large separation from the adjacent house, the setback variance should not create any obvious safety concerns or major impacts on the use of adjacent property. Mr. Crabtree moved and Ms. Keating seconded to approve the requested variance of 3.25 feet to the 10 foot setback to permit a side setback of 6.75 feet. Application filed by Jefferson City School District for a conditional use permit to expand public high school facilities on approximately 8 acres to accommodate the construction of a sports complex. The property is generally bounded by Stadium Boulevard to the south, Adams Street to the west, Oberman Place to the north, and Jackson Street to the east. PUBLIC NOTICE By publication in the newspaper, letter to adjacent and affected property owners within 185 feet, and by property sign posting. NATURE OF REQUEST The applicant is requesting approval to expand public high school facilities onto adjacent property across Jackson Street. Public schools, including associated facilities such as parking lots and sports fields, are a conditional use of the RS -4 zoning of the property. ZONING AND SURROUNDING LAND USE The subject property is zoned RS -4 Medium Density Residential STAFF ANALYSIS Following the 2019 tornado, the Jefferson City School District proceeded with acquisition of properties within this area with the stated purpose of expanding the high school complex. Acquisition of property and the future athletic field use of the property was pursued in a very public manner, with regular stories within the newspaper and other media regarding the School District plans for the property. Site Plan: The proposed Conditional Use Permit outlines redevelopment of the area with High School Athletic Fields. The site plan shows development of a soccer field on the southern portion of the property and baseball field on the northern portion of the property. A pedestrian walkway would be placed between the two fields. Seating for fans and a concession stand are included within the plans. Traffic: Traffic access to the site would rely primarily on the existing traffic circulation and parking associated with the Jefferson City High School. Most traffic activity is anticipated to be along the Jackson Street corridor. Traffic volumes for the sports complex, while difficult to quantify, are not expected to exceed traffic volumes generated by the existing high school use and would likely occur at off peak times (different times from the normal morning/afternoon traffic associated with the school). Final review of traffic circulation plans, driveway locations, pedestrian circulation, etc, would be conducted administratively during review of the final site plan for the development. Case No. B21002 April 13, 2021 Planning Staff Report Page 2 Properties not yet acquired: Two single family residential properties that have not been acquired are contained within the area identified for property acquisition by the School District. Two public street right of ways also exist within the proposed redevelopment area. 419 Union Street — this property was heavily damaged by the 2019 tornado and the house was demolished (via a city -initiated process) in late 2020. The School District is currently pursuing acquisition of the vacant lot through eminent domain. Acquisition of this property is necessary in order to accommodate the proposed baseball field development. 1201 Adams Street — this property sits adjacent to the left field dugout of the proposed baseball field. The site plan proposes a 6 feet tall solid vinyl fence atop a concrete retaining wall and a 30 feet tall protective netting along the property line. Street Street, alley, and utility easements — The vacation of Union Street and Case Avenue would be necessary in order to accommodate the development plan, as well as a number of alley right- of-way and utility easements. Vacation of streets and easements requires action by the City Council. Outdoor Lighting: The athletic fields are proposed to be lighted. The zoning code permits a maximum light height of 80 feet and cannot shed more than two footcandles of light upon the abutting property. Lighted athletic fields are required to be separated from adjacent residential property by a Type C Bufferyard. The Zoning Code allows for exceptions to the dimensional bufferyard requirements in redevelopment situations as long as screening is maintained. The Zoning Code also allows for exception from screening requirements where terrain would negate the benefits of screening. The site plan proposes a solid screening fence adjacent to the 1201 Adams Street property and a row of evergreen trees adjacent to property at 1113 Adams Street, which sits at an elevation about 35 feet above the level of the baseball field. Staff analysis is that the site plan meets the bufferyard requirements for lighted athletic fields, through allowed exceptions associated with redevelopment situations and extreme terrain, with the proposed combination of solid fence screening, installation of trees, and differences in terrain. Noise: Noise regulations, contained in Chapter 21 of the City Code, do not apply to activities conducted by public or private schools upon their property. Final Site Plan: The conditional use site plan is preliminary in nature. Final site details would need to be submitted to city staff for review for conformance with all applicable codes (stormwater, streets and sidewalks, utilities, etc) and administrative approval pending approval of the conditional use permit governing the land use approval and general layout of the proposed development. Page 2 of 10 JCHS SPORTS — BASEBALL AND SOCCER COMPLEX Conditional Use Site Plan EXHIBIT A - PROJECT DESCRIPTION This area bounded by Adams Street on the west, Jackson Street on the east, Stadium Blvd to the south and Woodlawn Ave to the north has historically been identified as an area where Jefferson City High School would expand in the future while the area west of Adams Street is seen as future expansion for Capital Region Medical Center. The current proposed Comprehensive Plan reflects this in the proposed use section. Following a devastating Tornado in May of 2019 which damaged or destroyed most of the structures in this area, the Jefferson City School District took this opportunity to acquire as many properties as possible which would allow for much needed land for expansion. For many years, Jefferson City High School's baseball, softball and soccer teams have had to travel across town on a daily basis for practice and games. This area when analyzed was found to be large enough to allow for construction of a Baseball/Softball field and a Soccer Field, along with a Concessions / Restrooms / Locker Room Building which the sports would share. The School District would like to use this area for the above referenced use, but City Code requires that land which will be used for a Secondary Public School needs to have a Conditional Use approval. As such, the Jefferson City School District is requesting approval of a Conditional Use Permit to allow construction of these facilities to accommodate these sports field uses as a part of Jefferson City High School. The 96 Comprehensive Plan Update identifies this area as Medium Density Residential, however the proposed Comprehensive Plan calls this area to be "Civic / Institutional" and has been identified as an area where the High School will expand to the west and Capital Region may expand to the east. 2. Does the proposed use comply with all applicable provisions of the zoning district regulations and conform to the general intent and purpose of the Zoning Code? Per Exhibit 35-28 of the Zoning Code, a Public Secondary School is a conditional use in a residential zoned area. The proposed use will expand the Jefferson City High School Campus. 3. Does the proposed use comply with all applicable fire, health, building, plumbing, electrical and stormwater drainage regulations? Yes, all regulations will be addressed on the final plans. 4. Is the proposed conditional use materially detrimental to the public health, safety, convenience and welfare or does it result in material damage or prejudice to other property in the vicinity? Jefferson City High School and the existing properties to remain have been a part of this neighborhood for many decades. Most of the traffic and activity will be along the Jackson Street corridor as it is today and should have minimal affect on the remaining properties. 6. Does the proposed use generate pedestrian and/or vehicular traffic which will be hazardous to the existing and anticipated traffic in the neighborhood? These new facilities will use the existing High School parking lots and this traffic will be similar to how it exists today. Most traffic will be along Jackson Street and there should be less "cut -through" vehicular traffic to the west since Union Street and Case Street are being removed. 7.
