AN ORDINANCE RELATED TO ZONING; CHANGING ZONE CLASSI- FICATION OF CERTAIN PROPERTY IN THE CITY OF McCALL; AMENDING THE MAP OF ZONING OF TEE CITY OF McCALL; AND DIRECTING THE CITY ENGINEER TO ENDORSE SUCH CHANGES ON SAID MAP. WHEREAS, proper notices of hearing having been given and appropriate hearings thereon having been held as required by law, by the McCall Planning and Zoning Commission and the McCall City Council. NOW, THEREFORE, BE IT ORDAINFD BY THE MAYOR AND COUNCIL .OF THE CITY OF McCALL AS FOLLOWS: Section 1. That the Zone classification of the following_ described real property in the City of McCall now zoned Zone F-Urban Agriculture and Recreation District, be, and the same is hereby changed to Zone C-Commercial District, to -wit: That certain parcel of land located and situated in Section 9, Township 13 North, Range 3 East of Boise Meridian, within the County of Valley, State of Idaho, and more particularly described as follows: Beginning at a pine tree stump on the meander line of Payette Lake, 212 .feet North, la° West from the North- east corner of Block 2 of the Original Plat of the Town of McCall, Valley County, Idaho; and running thence Northerly along the mander line of said Payette Lake and along the East side thereof for a distance of 440 feet; thence Easterly 134 feet; thence turn angle 90° from tangent run Southerly 532.feet with a 10° 9' curve to right central angle 53°40' thence turn angle 96° from tangent at this point and. run Westerly 34 feet to the point of beginning, with the exception therefrom of that certain strip along the Southerly Side of Laid premises heretofore deeded to the Village of McCall, Idaho, for right of way; all of said pre- mises being, lying and situate in the Town of McCall, Valley County, Idaho, (Tax No. 114, 115 and 115a); EXCEPT that particular piece contained therein and described as.follows: Beginning at the intersection of the centerlines of 3rd Street and Lake Street as shown on the official plats of the Village of McCall, Idaho; thence South 77°45' West, 40 feet to a point; thence North 12°15' West, 90.00 feet to the real place of beginning; thence North 12°15' West, 130.0 feet to the water line of Big Payette Lake; thence along the shore North 77° 15' East, 30.0-feet to a point; thence South 12°15' East,• 119.15. feet to,a point; thence South 65°57' West, 36.90 feet to a _point; thence South 73°27' West, 44.0 feet -to the- real place Of' I;e i nning, more particularly • known as Tax No. 115a. Section 2. That the Zone classification of the following described real property in the City of McCall now zoned Zone F-Urban.Agriculture and Recreation District, be, and the same is hereby changed to Zone A -Low Density Residential,. to -wit: That portion of the ST14NEa of Section 7, Township 18 North, Range 3 East, B.M., City of McCall,. Valley County, Idaho, lying South of State Highway 55,•less. that portion of said tract conveyed.in-a Trust Deed dated July 10, 1942, said deed recorded October 20, 1942, in Book 22 of Deeds, Page,53 and less that portion of said tract conveyed in a warranty deed dated February 23, 1964, and recorded in Book 37 of Deeds at Page 74 on March 2,:1964,• in the office of the .Recorder of said,Valley County.:This parcel is 38.9 a.cres, more or less. Section 3. That the Map of Zoning of the City of McCall be, and the same is hereby amended to make the Zone classi- fication changes hereinabove set forth and•the city Engineer is hereby directed to endorse such zone•changes on said -map.
