COUNCIL MINUTES
December 9, 1967
The Council of Bal Harbour Village met Saturday,
ber 9, 1967 at 9:30 A. M. in the Village Hall.
Present were: Messrs. Beatty, Hart and Printup.
Absent: Messrs. Taplin and White.

Also present were W. H. Webb, Village Manager; Mary T.
Wetterer, Village Clerk; and Thomas H. Anderson, Village
Attorney.
In Mayor White's absence, the meeting was conducted by
Assistant Mayor Printup.
On motion of Mr. Beatty, seconded by Mr. Hart and unan-
imously voted, the minutes of the previous meeting of November
25, 1967 were approved as submitted.
The Village Clerk reported that the results of the Charter
Amendment Election to permit the levy of a Resort Tax not to
exceed 2% were as follows: For the Amendment: 105 by machine,
1 by absentee, total of 106. Against the Amendment: 14 by
machine. The results of the election were certified by herself
and election clerks Jacqueline Beatty and Margaret Zill. On
motion of Mr. Hart, seconded by Mr. Beatty, and unanimously
voted the election results were ratified and Mr. Anderson was
instructed to draw a formal resolution covering same.
The Village Manager suggested to the Council that they de-
fer appointing an Authority that would administer the Resort
Tax or take any action regarding the levy of a Resort Tax un-
til he had some working details and figures.
Request of the Americana Hotel by letter for use of the
garage space for convention purposes from January 21-25, 1968
was approved on motion of Mr. Hart, seconded by r. Beatty, and
unanimously voted.
Mr. Beatty asked the status of the request of some of the
Bal Harbour Club members to permit surfing of the members in
front of the Beach Club and Mr. Webb said the matter had been
turned over to the Board of Governors who would have to init-
iate the request for a change in the Ordinance.
Mr. Anderson appraised the Council of a lawsuit instigated
by Morse, Surf, and Yellow Cab Companies against the White Cab
Company for them to cease their operations in Bal Harbour under
the ten permits granted them by the Council. Mr. Anderson
said they contend that these ten permits should be taken from
White Cab Company and given to the Morse, Surf and Yellow Cab
firm. He said he had entered into the suit to maintain the
permits as issued by the Council and with the Council's per -

mission would take the matter to the Florida Supreme Court if
necessary. The Council agreed to Mr. Anderson's proposal.
There being no further business before the meeting on
motion of Mr. Hart, seconded by Mr. Beatty and voted, the meet-
ing was adjourned at 10:00 A. M.

The Council of Bel Harbour Village met Saturday, January 27, 1968 at
9:30 A. M. in the Village Hall.
Present were; Messrs. Beatty, Hart, Printup, Taplin and White
Also present were: W. H. Webb, Village manager; Mary T. Wetterer,
Village Clerk; and Thomas H. Anderson, Village Attorney.
On motion of Mt. Beatty, seconded by Mr. Hart, the minutes of the
previous meeting of December 9, 1967 were approved as submitted.
Mayor White announced that the Council would consider the Resort Tax
and asked for any remarks from those present in the audience. Tr. Lawrence
Cliff, speaking for the Ba1 Harbour Resort Association, asked that the Tax
be deferred until after the special session of the Florida Legislature Ends
to see what taxes will be levied for education. After discussion it was
'roved by Mr. Hart, seconded by Mr. Beatty, and unanimously voted that the con-
sideration of a Resort Tax be deferred until the February meotino at which
time the Council would have a definite plan for spending this money and the
amount needed. It was also the opinion of those present that the estimated
expenditures would include an amount for the 'r,eautification of Collins
Avenue, but pane for ,any typr>, advertieinn as that was provided by the
individual properties.
The Village Manager advised the hotel owners and managers present that
they should check their outfalls intn the ocean end make any necessary repairs
es this now fell under the jurisdiction of the Internal Improvement Board.
Mr. Webb told the Council that Mr. C'Cnnnor of the Kenilworth House had
asked him to accompany him to Tallahassee to see Governor Kirk about the
erosion problem. It was moved by Mr. Hart, seconded by Mr. Taplin, and unanimously
voted to approve this expenditure.
