ORDINANCE NO.
17
AN ORDINANCE RELATING TO GENERAL OFFENSES: AMENDING
CHAPTER 1 OF TITLE V OF THE VILLAGE CODE OF McCALL,
IDAHO, BY THE ADDITION OF A NEW SECTION 5-1-57 OF
THE VILLAGE CODE OF McCALL, IDAHO, TO PROHIBIT HUNT-
ING WITHIN THE CORPORATE LIMITS OF THE CITY OF
McCALL, PROVIDING DEFINITIONS AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF McCALL, IDAHO, AS FOLLOWS:
Section 1,. ' That Chapter 1 of Title. V of the Village
Code of McCall, Idaho, be, and the same is'hereby amended by
the addition thereto of a new section to be known and desig-
nated as Section 5-1-57 of the Village Code of McCall, Idaho,
and to read as follow:
5-1-57: Section 1. Hunting Prohibited.' It shall be un-
lawful for any person to engage in hunting or take wildlife
within the corporate limits of the City of McCall.
Section 2. Definitions.' (a) "Wildlife" shall mean
any .form of animal life, native or exotic, generally liv-
ing in a state of nature.
(b) "Take" shall mean hunt, pursue, catch, capture,
shoot, trap, kill, or. ze or any attempt to so do.
• (c) "Hunting" shall mean chasing, driving, flushing,
attracting,. pursuing, .worrying, following after or on the
trail of, trapping, shooting at, stalking, or lying in
wait for,' any wildlife whether or not such wildlife is
then or subsequently captured., killed, taken, or wounded..
Such term does not include stalking, attracting, searching
for, or lying in wait for, any wildlife by an unarmed person
or solely for the purpose of watching wildlife or taking_
pictures thereof.
Section 3. Penalty. Any person who violates the pro-
visions of this Section shall be deemed guilty of a mis-
demeanor and upon conviction. thereof, shall be punished by a
fine of not more than three hundred dollars ($300.00) or
by.imprisonment of not more than six'(6) months in the County
jail, or by bc,th such fine and imprisonment.

guilty of a misdemeanor and
upon conviction_ thereof, shall
be punished by a fine of not
more than three hundred
dollars ($300.00) or ,by im-
prisonment of not more than
six (6) months in the County
jail, or by both such fine and
imprisonment. ,
