ROLL CALL The f ollowing Councilmembers were present for roll-call: Present: Fitzwater, Graham, Hensley, Hussey, Kemna, Lester, Schreiber, Vogt, Ward, and Wiseman Absent: None ADOPTION OF THE AGENDA A motion was made by Councilmember Graham and seconded by Councilmember Hussey to adopt the agenda. The motion passed unanimously. MISCELLANEOUS AGENDA ITEMS a. Chesney Schulte, Communicable Disease Coordinator for the Cole County Health Department joined the meeting via Webex with the following pandemic updates: • On any given day, positive COVID-19 cases remain between 0 – 10 in Cole County. • There is one COVID patient at each of the local hospitals. • 34.2% of Missouri residents have received at least their first vaccine dose. • A Cole County Central Vaccination Site has been set up in the Capital Mall (in the old Party City location). All local hospitals, Cole County Health Department, and the Community Health Center are partnering to provide vaccines at the location. The site will be open Monday thru Thursday, 9:00 A.M. – 3:00 P.M. Citizens can register for the vaccine through the Vaccine Navigator website: https://covidvaccine.mo.gov/events/#region_f or by calling the COVID-19 Hotline: 877-435-8411. b. Mayor Tergin presented the “Arbor Day” Proclamation to Todd Spalding, Director of the Parks, Recreation, & Forestry Department. PUBLIC HEARINGS a. Rezoning 0.17 Acres Located at 718 Lafayette St. from RS -4 Medium Density Detached (Single Family) Residential to N-O Neighborhood Office i. Associated Pending Bill 2020-074. 2 FIRST REGULAR COUNCIL MEETING, APRIL 19, 2021 A Staff presentation was made by Sonny Sanders, Director of Planning and Protective Services. There being no one to speak on the bill, Mayor Tergin declared the evidentiary portion of the public hearing concluded. 2020-074 sponsored by Councilmember Graham, entitled AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 0.17 ACRES LOCATED AT 718 LAFAYETTE STREET FROM RS-4 MEDIUM DENSITY DETACHED RESIDENTIAL TO N-O NEIGHBORHOOD OFFICE. There being no objection, bill 2020-074 was read third time by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16116. Republic Services Driver, James Ousley was recognized for his Lifesaving Efforts. ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF a. There were no City Council Committee announcements at this time. 3 FIRST REGULAR COUNCIL MEETING, APRIL 19, 2021 b. Mayor Tergin announced the Mayor’s Cup Golf Tournament scheduled for June 4th to benefit the Kiwanis Club. c. Police Captain Deric Heislen announced the Drug Take Back event scheduled for April 24th from 10:00 A.M. – 2:00 P.M. This will be a drive-thru event in the alley behind the Police Department. d. Todd Spalding, Director of the Parks and Recreation Department, announced the next Team Up Clean Up Day scheduled for April 22nd from 4:00 P.M. – 7:00 P.M., at Memorial Park. Additional Earth Day activities will be on site as well. JC Parks and Central Missouri Community Action invite citizens to come help clean up the community. More information can be found at https://www.facebook.com/JeffCityParks. e. Mayor Tergin announced the Downtown Association’s Clean up scheduled for April 24th at 8:30 A.M. Participants will meet at the Madison Street parking garage. A breakfast will be served after the event. Studio 573 is also planning a clean up event in their neighborhood at 11:00 A.M. the same day. LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE Stacy Landis, Student Representative, was unable to attend. PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS There were no presentations at this time. CONSENT AGENDA a. Minutes of City Council Meetings: April 5, 2021 b. Authorize a Permissive Use Right-of-Way at 1515 E. High St. for an Expansion of an Existing Parking Lot. Councilmember Lester recommended amending the April 5th minutes as follows: Councilmember Ward announced a Neighborhood Clean-up Day on April 25th. The event is organized by Old Munichburg Association, two Southside Neighborhood Watch groups, and Building Community Bridges. Councilmember Fitzwater recommended amending the April 5th minutes as follows: Detective Jason Bowman, President of the Fraternal Order of the Police (FOP), Detective Jason Ambler, Executive Vice President of the FOP, and Fireman James Noah representing Fire Fighters Local Union 671 each made presentations in favor of bill 2020-062 on the informal calendar. Councilmember Ward motioned and Councilmember Hussey seconded the motion to approve the above listed items with the recommended changes. DUNKLIN STREET Ryan Moehlman, City Attorney presented the resolution. Councilmember Hussey motioned to adopt RS2020-40. Councilmember Graham seconded the motion. The resolution was adopted by the following roll -call vote: Aye: Fitzwater, Graham, Hensley, Hussey, Kemna, Lester, Schreiber, Vogt, Ward, and Wiseman Nay: None RS2020-41 sponsored by Councilmember Hussey A RESOLUTION AUTHORIZING THE CITY TO ENTER INTO REAL ESTATE SALE AGREEMENTS WITH 318 JEFFERSON STREET LLC AND CENTRAL MISSOURI REALTY COMPANY 8 FIRST REGULAR COUNCIL MEETING, APRIL 19, 2021 Britt Smith, Public Works Operations Director, presented the resolution. Councilmember Hensley motioned to adopt RS2020-41. Councilmember Hussey seconded the motion. The resolution failed by the following roll-call vote: Aye: Lester Nay: Fitzwater, Graham, Hensley, Hussey, Schreiber, Vogt, Ward, and W iseman Abstain: Kemna – Employment with Seller Conflict Councilmember Wiseman suggested a Parking Garage work session for further discussion. Staff will coordinate a work session. PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS Doug Mueller addressed the City Council with a concern. City Code Enforcement has approached Mr. Mueller about his temporary sign violating City Code on multiple occasions. He’s not sure the difference between his signage and temporary realtor and political signs. Mayor Tergin suggested Mr. Mueller speak with Sonny Sanders, Director of Planning and Protective Services to discuss the issue and determine a solution. Dr. Bryan Pope addressed the City Council, praising outgoing Councilmember Hussey for his hard work and dedication to Ward 3, and the City as a whole. COUNCIL AND STAFF DISCUSSION OF PRESENTATION TOPICS There was no discussion at this time. NEW BUSINESS There was no new business at this time. APPROVAL OF 4/5/2021 CLOSED SESSION MINUTES Councilmember Hussey motioned and Councilmember Ward seconded the motion to approve the April 5, 2021 Closed Session Minutes. The motion passed by the followin g roll-call vote: Aye: Fitzwater, Graham, Hensley, Hussey, Kemna, Lester, Schreiber, Vogt, Ward, and Wiseman Nay: None UNFINISHED BUSINESS Mayor Tergin recognized out going Councilmembers Graham and Hussey with key to the city plaques and kind words. City Councilmembers took turns wishing them well and thanking them for their years of service to the City. 9 FIRST REGULAR COUNCIL MEETING, APRIL 19, 2021 ADJOURNMENT SINE DIE A motion to adjourn was made by Councilmember Hussey, seconded by Councilmember Graham, and approved unanimously at 8:12 P.M. ADMINISTRATION OF OATH OF OFFICE TO NEWLY ELECTED OFFICIALS The Honorable Jon E. Beetem, Presiding Judge, 19th Judicial Circuit swore in the following: Gaylin Carver, City Prosecutor David Kemna, Ward 1 Councilmember Laura Ward, Ward 2 Councilmember Scott Spencer, Ward 3 Councilmember Derrick Spicer, Ward 4 Councilmember Mark Schreiber, Ward 5 Councilmember The Honorable S. Cotton Walker swore in Scott Evans as the Municipal Judge earlier in the day due to a scheduling conflict.
