Section 29 "Rates" of Ordinance #74 -5 to provide for an increase in
the permitted rates and charges to subscribers to cable television
services.
7. Resolution 82 -10. A Resolution of the Town of Gulf Stream amending
the present pension plan of the Town by providing that contributions
of employees shall be voluntary rather than mandatory.
8. Report from Mr. William Mayer, Chairman of the Planning Board re-
garding variance requests from Mr. O'Boyle, and the Gulf Stream
Bath and Tennis Club.
9. Discuss letter to Mayor Koch from Commissioner Pfeifler. Letter
attached.
10. Discuss the letter to Mayor Koch from Commissioner Dixscn.
11. Discuss rate increase for trash pick -up.
12. Presentation by any CmT fission member of items they may wish to

The meeting was called to order by Mayor Koch at 9:00 a.m.
The minutes of the Regular Commission Meeting of September 10, 1982 were
approved with the correction on the bottom of page 3, last paragraph, the
final sentence should read, "It was suggested that a broader and represent-
ative participation be developed in the work of the committee." The min-
utes of the Special Advertised Budget Hearing Meeting of September 10, 1982
were approved and the minutes of the Special Advertised Budget Hearing Meet-
ing of September 16, 1982 were approved with the letter from Vice Mayor
Hunter to Mayor Koch being deleted from the minutes.
Town Manager Gwynn presented the Financial Reports for the month of Sept-
_ ember 1982. Upon motion made and seconded, the Commission approved the
f Financial Reports.
Chief James Greer then presented the Police Report for the month of Sept-
ember 1982. This report is made a part of the minutes.
It was moved and seconded to adopt Ordinance #82 -3, an Ordinance titled,
AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA
PROVIDING THAT CARDINAL CIRCLE, A STREET WITHIN
THE TOWN BE MADE A ONE WAY STREET GOING LVESTERLY
AND NORTHERLY AUTHORIZING THE POLICE DEPAMEW
OF THE TOM OF GULF STREAM TO POST THE NECESSARY
SIGN; PROVIDING AN EFFECTIVE DATE.

It was moved and seconded to adopt Resolution #82 -10, a Resolution titled,
A RESOLUTION OF THE TOWN OF GULF STREAM, PALM
BEACH COUNTY, FLORIDA, AMENDING THE PRESENT
PENSION PLAN OF THE TOWN BY PROVIDING THAT
CONSTRIBUTIONS OF EMPLOYEES SHALL BE VOLUNTARY
RATHER THAN MANDATORY.
Notion passed.
Mr. William Mayer, Chairman of the Planning & zoning Board presented three
items for consideration.
1. A recommendation from the Board that the Commission approve plans sub-
mitted by Mr. Martin O'Boyle, Lot 5, Hidden Harbour Estates, a variance is
required due to the encroachment of the rear setback line. This request
has been advertised and all affected residents notified. After a review
of the plans and there being no objections, the Commission approved the
plans.
2. A request from the Gulf Stream Bath and Tennis Club to place two sheds
on their property.
A. One on Shore Road next to the Tennis Court, no action necessary
by the Commission since this building is within the proper set-
back line.
B. This building is next to Jamaica Square Apartments and north of
the Bath and Tennis Club. After a general discussion, the Comm-
ission expressed their concern for the residents that occupy the
apartment immmediately adjacent to the shed and felt that all
residents of the Jamaica Club should be contacted and a letter
received from each one stating that they do not object to this
request.
3. A letter from Mr. & Mrs. John McGeary, owners of Lot 16, Gulf Stream
Properties, requesting a letter from the Commission that their platted lot
is buildable being grandfathered in before the recent zoning change to
20,000 sq. feet. The Commission instructed the Town Clerk to write Mr. &
Mrs. McGeary advising them that they mist submit site plans to the Plann-
ing Board following which its action will be referred to the Commission
whereupon they will issue a final ruling.
Mr. Pfeifler's letter to Mayor Koch concerning the future needs of the Town
were discussed. These needs consist of an upgrading of facilities and
improvements of various situations and conditions. Mayor Koch stated a
special meeting will be held in November to consider all aspects of the
matter. It was also decided that members of the Civic Association be con-
tacted and invited to offer their input.

It was moved and seconded to raise the Trash rates effective October 1, 1982
to $7.00 a cubic yard. Motion passed.
Mayor Koch presented Mrs. Joan LaPorte with a plaque for her outstanding
service as Conudssioner, Police Commissioner and Vice Mayor for the Town
of Gulf Stream 1973 -1982. She was given a standing ovation by all present.
There being no further busines, the meeting was adjourned at 10:15 a.m.

I have reviewed the minutes of October 8, 1982. The only
correction I would suggest is on Page 2, paragraph 3 where
you reflect that the Town Clerk was instructed to write Mr.
and Mrs. McGeary advising them they must submit site plans
to the Planning Board and if a variance is required, the
Board will then come before the Commission with a recommenda-
tion to approve plans. I am not sure what the tape reflects
in regard to this matter so I cannot comment as to whether or
not these minutes are correct. However, I would advise that
it is not appropriate for the Commission to determine that
the Board will come before them with a recommendation to
approve the plans. The more appropriate action is for the
Board to make a recommendation to the Commission whereupon
the Commission will either accept or reject the recommendation.

Dear Bill:
As Chairman of the Long Range Planning Committee, I have accumulated
a list of recommendations by fellow commissioners. I have ranked the
suggestions in order of priority as a starting point for discussion.
Cost estimates are the next matter to be investigated since only a
few recommendations have been costed out. Listed below are the recom-
mendations received:
1. Pay out bank loan.
2.
Road resurfacing and improvements.
3.
Water system improvement (replacement of
meters.)
4.
Purchase of additional property for the
construction of storage facilities for
police and maintenance equipment.
5.
Purchase of water mains from the Gulf
Stream Golf Club.
6.
Improvement of the AIA -8th St. intersection.
7.
Improvement of the Town drainage system.
8.
Fire protection service (Joint venture be-
tween coastal cities.
9.
Re- zoning expences.
10.
Sidewalk along AIA.
11.
Telephone and Florida Pacer and Light line
placed underground.
12.
Further investigation of paramedical services.
I feel the list constitutes a starting point for our discussion and
any additional recommendations from the Commissioners or residents are
welcomed.

Leadership Cablevison hereby requests Town Commission approval at its
monthly meeting September 10, 1982 to increase its connection and monthly
service rates effective as follows, effective October 1, 1982 pursuant
to Section 29, Ordinance No. 74 -5, as amended by Ordinance No. 79.8.

A draft ordinance incorporating these rate changes is enclosed for
your consideration.
As you will recall, the last rate increase granted Leadership Cablevision
by the Town was on June 1, 1979. During the succeeding period of over
three years our company has experienced substantial increases in many
operating costs -- such as technical and installation labor, power, tele-
phone, rent and gasoline -- due to inflationary factors beyond our control.
We have finally reached a point where we must now pass along at least some
of these increased costs to our subscribers. We would also call your
attention to the fact that since June 1979 Leadership Cablevision his
added a number of new program channels, including WTBS, Channel 17 as part
of its basic service package.
The rate increases requested are being implemented October 1, 1982 in all
the other localities where Leadership Cablevision currently is franchised/
licensed to operate -- i.e. the City of Delray Beach, Town of Ocean Ridge
and unincorporated Palm Beach County. Although prior approval of the
localities was not needed due to rate deregulation, Leadership Cablevision
has notified the appropriate authorities of its intention to raise its rates.

AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA,
AMENDING SECTION 29, "RATES" OF ORDINANCE NO. 74 -5
TO PROVIDE FOR AN INCREASE IN THE PERMITTED RATES
AND CHARGES TO SUBSCRIBERS TO CABLE TELEVISION
SERVICES, PROVIDING AN EFFECTIVE DATE.
WHEREAS, Fairbanks Cable of Florida, Inc. (d /b /a Leadership Cablevision)
cable television services to residents of Gulf Stream, FL
pursuant to a franchise granted by the Town by Ordinance No. 81 -3
on July 31, 1981 and
WHEREAS, the rates and charges for cable television services
have remained unchanged since ordinance No. 79 -8 was adopted by the Town
on June 8, 1979; and
WHEREAS, based upon the increased costs of operation since that
time and other factors, Fairbanks Cable of Florida, Inc. (d /b /a Leadership
Cablevision), has adequately demonstrated the need to increase the said
rates and charges:
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN
OF GULF STREAM THAT:
Section 1. Section 29, "Rates" of Ordinance No. 74 -5 of the
Town of Gulf Stream, Florida, is deleted in its entirety and the following
is substituted in its place and stead:

(b) In addition to the reconnection charge set forth
above, subscribers previously disconnected for
nonpayment of service fees will be charged an
additional $5.00 upon reconnection.
(c) The Company is granted the privilege of making
additional installation charges based on time
and material for custom installation charges as
defined in this Ordinance. The amount of the
Company's compensation shall be subject to ap-
plicable federal, state and local law and re-
gulations. All rates shall be uniform through-
out the City. No changes in rates charged to
subscribers shall be made except as authorized
by the City after an appropriate public hearing.
(1) "Standard Installation" shall mean any
installation wihch requires no more than
100 feet of lead -in -type cable, where
entry into the structure is made through
an outside wall, where internal wiring
can be affixed to the surface of the wall
or base - board, and where the method of
outside installation, either aerial or
underground, is the same as is employed
in the distribution line serving the
subscriber.
(2) "Custom Installation" shall mean any installation which
employs outside construction methods, either aerial
or underground, different from that employed in the
distribution line serving the subscriber, where inside
wiring involves installation of
cable or wire in any attic, crawl space
or within the dead space area of any wall,
or requires more than 100 feet of lead-in -
type cable, or requires additional ampli-
fication equipment to provide proper service.
Section 2. This ordinance shall become effective immediately
upon passed on second and final reading.

RESOLUTION NO. 82 -10
A RESOLUTION OF THE TOWN OF GULF STREAM, PALM
BEACH COUNTY, FLORIDA, AMENDING THE PRESENT
PENSION PLAN OF THE TOWN BY PROVIDING THAT
CONTRIBUTIONS OF EMPLOYEES SHALL BE VOLUNTARY
RATHER THAN MANDATORY.
WHEREAS, a meeting of the Town Commission of the Town
of Gulf Stream, Florida, was held on the 10th day of September,
1982, and
WHEREAS, there was presented to the Town Commission the
need to amend the IDS Prototype Pension Plan used by the Town
for the benefit of the employees of the Town.
WHEREAS, it was determined that the Plan should be
amended so as to provide for voluntary contributions to the Plan
instead of mandatory contributions by employees;
NOW, THEREFORE, be it resolved by the Town Commission
of the Town of Gulf Stream, Florida;
Section 1.
The
IDS Prototype Pension
Plan is hereby
amended in the manner
and
form represented by
the document attached
hereto and executed by the Mayor of the Town of Gulf Stream.
Section 2. The purpose and intent of this Amendment is
to implement employee voluntary contributions instead of mandatory
contributions.
Section 3. All other portions of the IDS Prototype
Pension Plan shall remain intact and unchanged.
