Financial Report for the month of December, 1982. Audit Report. Adopt pay scale according to classification. 4. Presentation of Police Report. Police Business, i.e., position of Captain. boat seizure - Delray Beach. 5. Resolution #83 -1. A resolution supporting Ocean Ridge's stand against the relocation of the Ocean Avenue Bridge in Ocean Ridge. 6. Discuss Dredging project. 7. Meeting for Public Hearing regarding Zoning Project. 8. Planning Board Chain Mr. William Mayer - Variance request. 9. Presentation by any Commission member of items they may wish to discuss. 10. PUBLIC REQUESTS OR CODM]ENTS from the floor. COMMISSION MEETING January 14, 1983 PRESENT: William F. Koch, Jr. Mayor Joel Hunter Vice Mayor Robert Dixson Commissioner Brian Pfeifler Commissioner Alan I. Armour Commissioner ALSO ATTENDING: Town Manager William Gwynn, Town Clerk Barbara Gwynn, Town Attorney John Randolph, Robert Moody and Paul Brener, of the firm of Ernst & Whinny, Auditors. Planning Board Commissioners William Mayer and Thomas 0. Boucher The meeting was called to order by Mayor Koch at 9:00 A.M., and Roll Call was taken. Commissioner Hunter questioned whether the detailed dialogue contained in the minutes of the meeting of December 14, 1982, regarding the property immediately south of the Somerset multi - family buildings, was necessary to be inserted. Commissioner Dixson concurred and stated that since all of the material appears on the recorded tape, there was no need to have it in the minutes of the meeting. Commissioner Dixson stated that in regard to the December 10 and December 14, 1982 meetings, the subjects are merely mentioned and there is no mention of the recommendations that were actually made to and for the use of the zoning study group. Because of the length of the discussions and since it appears in the recording of the meeting as well as the notes of Mr. Caputo, the detail of such discussion is omitted. The minutes of said meetings of December 10 and December 14, 1982 were, therefore, approved, with said changes. Town Manager Gwynn presented the Financial Report for the month of December, 1982. This report is made a part of the minutes. The Audit Report, which had previously been distributed to the Commissioners, was discussed, and Town Manager Gwynn introduced Paul Bremner and Robert Moody, from the firm of Ernst & Whinny, Auditors. Commissioner Hunter requested that they give a report, since this is their first year as auditors, and Mr. Moody gave a detailed report, with suggestions, recommendations and comments. Mayor Koch complimented them on their work. Motion was made and seconded to accept said audit report. Motion passed. Motion was made and seconded to adopt the pay scale for the fiscal year October 1, 1982 to September 30, 1983, restating the salaries by classification that had been previously approved by the Commission. This schedule is made a part of the minutes. Motion passed. Commission Meeting January 14, 1983 Page 2 Motion was made and seconded to have Commission approval for competitive bidding for items $1,000 or over. Motion passed. Chief Greer presented the Police Report for the month of December, 1982. This report is made a part of the minutes. The Chief reported on the Crime Watch program. Town Manager Gwynn presented a request from Police Chief Greer for the promotion of Lt. James Mahoney to the position of Captain, effective February 1, 1983. It was moved and seconded that the proposal of the Chief and Town Manager to create the position of Captain in the Police Department be approved. Motion passed. It was moved and seconded that a salary not to exceed $23,000 be established for the position of Captain in the Police Department. Motion passed. It was moved and seconded that the proposal of the Chief and Town Manager for the promotion of Lt. James Mahoney to Captain be approved. Motion passed. It was moved and seconded to adopt Resolution 83 -1, titled: A Resolution of the Town of Gulf Stream, Florida, opposing the re- location of the Ocean Avenue Bridge (State Road 804) in the Town of Ocean Ridge, Florida, and urging that no further costs be expended on the proposed project, and supporting the repair and replacement of the existing bridge. Said motion passed unanimously. It was noted that people in the audience also supported the Resolution. Commissioner Armour reviewed the matter of the dredging project and advised that if they are to continue, it is necessary to hire an engineer to conduct a survey of the canal; also to obtain necessary permits to dredge the canals, to allow the engineers to contract for the dredging, and prepare resolutions as previously discussed. Town Attorney Randolph explained the Consultants Competitive Negotiations Act, and he recommended that the bids be opened. Mr. William Mayer, Chairman of the Planning Board, presented a variance request on the Staley property, 2435 North Ocean Boulevard, and recommended that it be approved. Mayor Koch disqualified himself and refrained from voting. After a review, there being no objections, the Commission approved the request. Commission Meeting January 14, 1983 Page 3 Commissioner Dixson raised the question of reviewing individually the content of the Licensing Ordinance. Mayor Koch suggested that they request Town Attorney Randolph to review same and give his opinion in memorandum form. There being no further business to cane before the Commission, the meeting adjourned at 10:15 A.M. General Comment. Add "or designee" after each reference to a Town Official throughout the ordinance. All references to "gross acre" - revise to "net acre". 2. Page 3, item 11. Remove "and easily" from definition of Awning. 3. Page 5, item 23. Rewrite definition of Building Height to read as follows: The vertical distance measured from the point of first floor base flood elevation of the building site to the highest finished roof structure including any roof -top super- structure or appurtenance. 4. Page 6, item 34. Add "and /or" to statement of .... recreational and /or athletic .... . 5. Page 6, item 38. Add "or ownership by" to statement .... designed for rental to or ownership by tenants .... . 6. Page 9, item 64. Rewrite definition of Family to read as follows: One (1) or more persons related by blood, marriage, adoption, or guardianship, or not more than three (3) persons not so related, occupying a dwelling unit and living as a single housekeeping unit in a dwelling. 7. Page 13, new item. Net Acre, or Net Land Area. sitting as the Zoning -1- The total land area of a building site, exclusive of all public rights -of -way, easements, submerged lands, or any lands deemed by a government agency as unsuitable or inappropriate for development. B. Page 14, item 111. Add Town of Gulf Stream to definition of Public Agency. 9. Page 17, item 139. Rewrite definition of Structure Height to read as follows: The vertical distance measured from the point of base flood elevation to the highest point of a structure. For a roof -top superstructure, height shall be measured from the highest point of the roof to the highest point of such structure. 10. Page 19, item 154. Add .... which is granted by the Town Commission sitting as the Zoning -1- V 11. Page 20, item V A (Second Revise "upon" to "on ", and add "facts and ". Paragraph) 12% Page 22, item VII,C.1 Add "guest houses" to accessory uses. 13. Page 23, item VII,G.1 Add "or structure ". 14. Page 24, item M. Rewrite to read as follows: Walls, fences, and Hedges. All walls or fences outside of building lines of the property shall not be over eight feet (8 ft.) in height. No height limitation is placed on hedges. However, in the event that a wall, fence, or hedge is erected or located on a corner lot, a vehicular and pedestrian visibility triangle shall be provided for a minimum distance of ten (10) feet in both directions from the intersecting corner point of property lines. The maximum height of any wall, fence, or hedge within said visibility triangle shall be two and one -half (2 1/2') feet. 15. Page 25, item VIII,B.4. Add, "activities ". 16. Page 25, item F.1. Page 27, item L.1. Change "total lot area" to "net land area ". 21. Page 28, item M. Rewrite to read as follows: Walls, Fences, and Hedges. Construction in coastal areas of the Town must comply with all of the provisions of the "Palm Beach County Coastal Construction and Excavation Setback Ordinance No. 72 -12" and the Construction Control Line - established by the State.of Florida Bureau of Beaches and Shores, which ordinance or its successor shall prevail in the absence of a conflict- ing Town ordinance. 24. Add to end, "and shall be located in such a manner so as not to face any public street or roadway, or shall be adequately screened or buffered so as not to be visible from any public street or roadway. 25. Page 36, item K.9. Add, "wherever practical ". 26. Page 42, item e. Add, "plus any additional costs by the Town of processing the application or hearing and de- ciding upon the request. Said additional costs shall be paid to the Town by the applicant prior to the issuance of a certificate of occupancy. ". 27. Page 43, item 7. SECTION XII - CERTIFICATES OF OCCUPANCY It shall be unlawful to use or permit the use of any building or premises thereon hereafter created or erected, changed or converted wholly or partly in its use or structure until a certificate of occupancy to the effect that the building or premises or part thereof and the proposed use thereof con- -3- form to the provisions of the ordinance shall have been issued; provided that under the rules and regulations of the Town Commission a temporary certificate of occupancy for a part of a building may be issued; provided that upon written request from the owner, or applicant, the Town shall issue a certificate of occupancy for any building or premises existing at the time of the passage of this ordinance certifying after inspecting the use of the building or premises and whether such conforms to the provisions of this ordinance. 29. Add, Application "forms" and obtained from "and filed with the Town Clerk or designee ". Change 3 month residency requirement to 8 months. Change "investigate" to "review ". Rewrite entire Section to read as follows: 1. The Town Commission may from time to time on its initiative or by petition, amend, supplement, change, modify, or repeal the regula- tions, restrictions, or district boundaries herein established. Any proposed amendment, supplement, change, modification, or re- peal shall first be submitted to the Town Planning Board for its recommendation and report to the Town Commission. All such changes and amendments shall be made pursuant to all applicable state laws. 2. Should a proposed zoning amendment be denied, after having a public hearing as provided herein, the Town Commission shall not recon- sider such amendment or request for an amendment for a period of six (6) months after denial, unless the Town Commission determines that the public interest shall require it to do so. B. Filing Fees - Petition for Rezoning. 1. Upon filing a petition or a request for rezoning within the Town the petitioner shall pay to the Town Clerk or designee a fee of two hundred dollars ($200.00) plus any additional costs by the Town of processing the application or hearing and deciding upon the request. Said additional costs shall be paid to the Town by the applicant prior to the issuance of a certificate of occupancy for any development on the property which was rezoned, provided however, that said rezoning request was approved. If said rezoning request is denied, all additional costs shall be- come due and payable immediately. A f] D g 1 � � �e O 0 n. m l 1 O 1 O l RESOLUTION NO. 83 -1 • • • i M kon • r •• u• • • •� i u ��• a u 010 • i ...••• �• •• a n .•.� .Di •. •. �. •«o is • i �• � •r WHEREAS, The Florida Department of Transportation (FOOT) has determined the relocation of the Ocean Avenue Bridge in Ocean Ridge to a location only 700 feet north to align with Second Avenue in Boynton Beach is high priority project referred to as State Job Number 93200 -1504 and has allocated state funds for right -of -way acquisition and applied for Federal Funding for the project assigned Federal Job Number M -3406 (1); and WHEREAS, such relocation would place the intersection of the bridge approach with State Road AlA within 200 feet of the Ocean Ridge Town Hall, Police Department and Fire Department and in close proximity to the entrance and exit to the Boynton Beach Public Beach, causing a serious congestion of traffic; and WHEREAS, such relocation would require the widening of State Road ALA for a distance of 300 feet north of the proposed bridge which would result in the loss of the south egress and ingress to AIA from the Police and Fire De- partment and add an additional lane of traffic to be crossed from the only remaining access to AIA, both of which will seriously affect the operation, effeciency and response time of the police and fire department; and WHEREAS, the Town of Gulf Stream, Florida contracts with the Town of Ocean Ridge, Florida for police, fire and first aid services and vehemently opposes any project or circumstance that may alter the excellent response and quality of service that is currently being received and, WHEREAS, the estimated project will exceed $15,000,000.00 whereas the estimated cost of replacement of the existing bridge would be only ten percent (10 %) if that figure which is of prinary importance and concern esp- ecially in view of the current economic situation; and WHEREAS, the Federal Department of Transportation (FDOT) disclosed that there are 248,500 structurally deficient bridges in need of repair and rehabilitation in the United states at an estimated cost of $47.6 billion with only a fraction of this amount available for the highest priority pro- jects; and WHEREAS, there are five (5) bridges within ten (10) miles, one of which is within one (1) mile of the existing bridge, available as alternate routes during reconstruction or repair of the existing bridge tusking it un- necessary to expend funds for a temporary bridge; and, WHEREAS, destruction of major stands of mangroves and damage to the adjacent woodlands and wetlands would be extensive if the relocation were to be accomplished with the new right -or -way as projected passing thru these endangered areas, NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF GULF ,STREAM, FLORIDA. Section 1. The Town of Golf Stream vehemently opposes the re- location of the Ocean Avenue Bridge (State Road 804) in the Town of Ocean Ridge, Florida. Section 2. The Town of Golf Stream urges that no further funds be expended on the proposed relocation of the bridge, State Job Number 93200- 1504 and Federal Job Number M -3406 (1) for right -of -way, bridge or roadway. Section 3. The Town of Gulf Stream supports the repair or re- placement of the existing bridge in the existing location on Ocean Avenue in the Town of Ocean Ridge and the City of Boynton Beach. Section 4. The Town Clerk is hereby directed to transmit copies of this resolution to the Federal Highway Administration, Federal Department of Transportation, Florida Department of Transportation, Town of Ocean Ridge, Florida and City of Boynton Beach, Florida Section 5. This Resolution shall take effect immediately upon adoption.
