FEBRUARY 11, 1983

ALSO ATTENDING: Town Manager William Gwynn, Town Attorney John Randolph,
Police Chief James Greer, William Mayer and Thomas Boucher,
Planning Board Members, Franklin O'Brien, Civic Association,
Gene Caputo, Executive Management, Town Clerk Barbara CAYmn.
The meeting was called to order by Mayor Koch at 9:15 A.M., and roll call was
taken.
The Minutes of the Joint Meeting of the Town Commission and Planning Board of
January 12, 1983, the Comprehensive Zoning Meeting of the Town Con¢nission and
Planning Board of January 12, 1983, and the regular Commission Meeting of
January 14, 1983 were approved
Town Manager Gwynn presented the Financial Report for the month of January,
1983. This report is made a part of the Minutes. He also read the engagement
letter from Ernst & Whinny, Public Accountants, regarding the nature of ser-
vices of said firm to the Town of Gulf Stream if they were appointed auditors
for the current year. Motion was made and seconded and passed to accept their
letter appointing Ernst & Whinny as auditors for the fiscal year ended Sept-
ember 30, 1983 and to make said letter a part of the record.
Police Chief Greer presented the Police Report for the month of January, 1983.
Commissioner Armour suggested that a report be made as to the subject of the
speed of boats on the Intracoastal Waterway. Chief Greer stated that he had
talked with the Marine Patrol and the Sheriff's Office regarding jurisdiction,
and sign have been ordered.
Town Manager Gwynn read a letter from Neil E. McMillan, Attorney, regarding
the withdrawal of the City of Boca Raton from the Southeastern Palm Beach County
Hospital District, requesting the Town of Gulf Stream to oppose said action.
Resolution was made and seconded to oppose said withdrawal. Motion passed.
Town Attorney Randolph was instructed to forward a letter to the Southeastern
Palm Beach County Hospital District advising them of same.
Mr. Donald Dayton, Chairman of the Long Range Planning Board, which has been
appointed by the Civic Association, appeared before the Commission, and gave a
lengthy talk. He stated that the Town is in need of some capital improvements,
and that a bond issue would be welcome. He then listed the items that had been
considered and gave approximate amounts.

The Phipps property - strongly recommended that it
be purchased
Develop plans to use the property
Building, landscaping, parking and resurfacing
Water situation - purchase from the Golf Club the
pipe under the Waterway
Fire protection - need more water storage for the
condominiums
Storage tank and pressure tank
Suggest a second line under the Intracoastal
Drainage - need study (possibly storm sewers)
Roads - resurfaced
Canals - need to be dredged

Conmi.ssioner Hunter connnended the Conmittee as to the excellent job that they
have done. There was much discussion about the Phipps property, and as to
the question of financing the purchase of same. Town Attorney Randolph stated
that there would be any number of financing alternatives available. He also
thought that they should appoint an engineering firm as soon as possible to
study the problem. Mayor Koch is to obtain information, and report back at
the next meeting. Commissioner Hunter suggested that Mayor Koch also be
authorized to talk to the representatives of the owners and report on same.
Commissioner Armour stated that he did not agree that the dredging issue should
be tied in with the bond issue, because of the time and increased cost involved.
The Town Manager is to be in charge of carrying the program forward.
William Mayer Chairman of the Planning Board, stated that they had received a
variance request from Lawrence Eaton, 3777 Gulf Stream Road, for a swhmting pool
11 feet from the rear property line. There was no objection from the Planning
Board. Motion was made and seconded to approve said variance request. Motion
passed.
Gordon Ripma, Land Ventures, Ltd., requested permission for a trailer tie -down
and facade in front of trailer and sales office. Commissioner Dixson thought
there should be a time limit. Motion was made and seconded that they accept
the recommendation of the Planning Board to allow the trailer and facade for
one year or sooner, if the four buildings are sold earlier. Mayor Koch and
Commissioner Hunter abstained from voting. Motion passed.
Mr. Mayer also stated that they had a request from Mr. Ripma regarding signs.
There was discussion regarding same, and Mr. Ripma was advised to submit the
drawing to the Planning Board, and have them make recommendation to the Commission.

Mr. Gene Caputo, Executive Management, appeared before the Commission, and
stated that the Zoning Ordinance has been completed. He explained about the
Comprehensive Plan Amendment, presented a chart, gave the proposed schedule,
and explained the State requirements. The following dates were set for reading
of the Ordinance:
First Reading - Thursday, February 24, 5:00 P.M.
Final Reading - Monday, March 14, 5:00 P.M.
Town Manager Gwynn read a letter received from the law firm of Byrd, Devitt & Otto,
representing the Estate of Cecile J. Johnson, stating their objection to the
proposed change in zoning on the theory that an existing platted lot should be
able to build.without going through a special permission procedure. Said letter
was noted.
There being no further business to come before the Commission, the meeting
adjourn ed at 10 :55 A.M.

SPECIAL COMMISSION MEETING
FEBRUARY 11, 1983

ALSO PRESENT: William Mayer and Thomas 0. Boucher, Planning Board,
Franklin O'Brien, Civic Association, Town Manager William
Gwynn, Town Attorney John Randolph, Town Clerk Barbara Gwynn.
The Special Meeting to consider engineers for the project of dredging of the
waterways was called to order by Mayor Koch at 8:30 A.M.
Commissioner Armour explained that each applicant in the interview has been
asked to submit a competitive type of package, giving the project costs, etc.,
all of which are negotiable.
Representatives of the following firms appeared before the Commission, and
gave a summary of their work and the costs involved, and they were questioned
by members of the Commission:
Arthur V. Strock
AB2MT Consultants, Inc.
Shermetta Associates, Inc.
Malek and Associates
Shalloway, Inc.
Commissioner Armour asked that the procedure be clarified, and Town Attorney
Randolph explained that the firms should be short- listed as to rank. Town
Manager Gwynn and Commissioner Armour would be empowered to negotiate with
the first choice. If, after negotiation, it is thought that they have a
favorable choice, they will have the contract approved by the Commission.
If it is not approved, then they will go to the next choice on the list
and on down the list until they have a favorable choice.
The firms were considered after the presentations, and ranked as follows.
according to secret ballots of the Commission:
1. Arthur V. Strock
2. Shalloway, Inc.
Tied for 3. AB2MT and Shermetta Associates, Inc.
4. Malek and Associates.
It was decided that since Arthur V. Strock was the first acceptable firm on
the list that Commissioner Armour and Town Manager Gwynn would negotiate the
matter with said firm.
There being no further business to come before the Special Commission Meeting,
said meeting adjourned at 9:12 A.M.

Gentlemen,
I, Lawrence C. Eaton, of 3777 Gulfstream Road, Gulfstream, Florida,
respectfully request a zoning variance of four feet fran the
back yard setback line for the purpose of building a swinnrring
pool.
C) This will mean that instead of fifteen feet from the property
line it would consist of eleven feet in term of the setback.
It should also be noted that my property line has a cinder block
wall allowing a maximrmr of privacy from the abutting neighbor.
I feel that due to the original changes in the zoning ordinance
that I have been placed in a position of hardship and therefore
do request that I be granted a variance in order that I may have
the privilege of enjoying a swimming pool in my back yard.
Attached hereto, please find plan of the property construction.
