There will be a Meeting of the Town Commission of THE TOWN OF GULF STREAM, FLORIDA AT THE TOWN IIALL Friday,April 8 19 83 , at 9:00 A.M. Deputy Town Clerk. PUBLIC MEETING April 8, 1983 Present: William F. Koch, Brian Pfeifler Alan I. Armour Robert J. Dixson Absent: Joel Hunter Jr. Mayor Commissioner Commissioner Commissioner Vice Mayor Also Present: Town Attorney John Randolph, Town Manager William Gwynn, Gene Caputo, Executive Manage- ment, Planning Board Members Thomas O. Boucher and Charles E. Eaton, Police Chief James Greer. The meeting was called to order at 9:00 A.M., and Roll Call was taken. Mayor Koch stated that this meeting was called for the final adoption of the Zoning Ordinance. Town Attorney Randolph, by way of review, stated that the Town Commission has been considering the amendments to the Zoning Ordinance, and has hired a Consultant to assist in the preparation of the zoning changes. It is a completely new Ordinance. The previous Zoning Ordinance is being repealed and a new Ordinance is being adopted. Pursuant to State Statute, they have had two advertised Public Hearings. This is the last Public Hearing, and notices have been sent to property owners in the Town regarding the new Ordinance. At this time he read into the record Ordinance #p1 -83: AN ORDINANCE OF THE TOWN OF GULFSTREAM, PALM BEACH COUNTY, FLORIDA, RESCINDING ORDINANCE NO. 108 OF THE TOWN, AS AMENDED, IN ITS ENTIRETY, AND ADOPTING A NEW COMPREHENSIVE ZONING ORDINANCE TO PROMOTE THE HEALTH, SAFETY, MORALS AND GENERAL WELFARE OF THE INHABITANTS OF THE TOWN OF GULFSTREAM, FLORIDA, REGULATING THE USES OF LAND, WATER, BUILDINGS, AND STRUCTURES WITHIN THE TOWN OF GULFSTREAM, REGULATING THE LOCATION, HEIGHTS, SIZE OF BUILDINGS AND STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, THE DENSITY AND DISTRIBUTION OF POPULATION AND FOR SAID PURPOSES CREATING DISTRICTS AND ESTABLISHING THE BOUNDARIES THEREOF, AND ADOPTING A MAP OF SAID DISTRICTS, DEFINING Public Meeting April 8, 1983 Page 2 CERTAIN TERMS USED, ESTABLISHING A BOARD OF ADJUSTMENT AND TOWN PLANNING BOARD, PROVIDING FOR THE ENFORCEMENT AND AMENDMENT THEREOF, PROVIDING FOR PENALTIES FOR THE VIOLATION OF ITS PROVISIONS, PROVIDING FOR SEVERABILITY, PROVIDING AN EFFECTIVE DATE. The adopting Ordinance itself has been posted on the Bulletin Board and the Ordinance text has been on file with the Town Clerk for anyone to review prior to this date. Mr. Gene Caputo, Executive Management, stated that at the meeting of the Planning Board they had discussed two small items which are being presented today as suggested amendments to the final Ordinance. 1. Establishment of a new definition for guest houses (this is for clarification). 2. Location of fences, hedges and walls along property lines which abut the Intracoastal Waterway, Atlantic Ocean, or any other similar water body. This paragraph sets forth that a maximum height of four feet be the restriction placed upon these fences for the purpose of water visibility and waterfront view. Commissioner Dixson stated that these are merely refineaents of the substantive content which is already in the Ordinance. Commissioner Pfeifler stated that they should eliminate the height of the fence in regard to the Atlantic Ocean. There followed discussion. Commissioner Pfeifler moved that they strike the words "The Atlantic Ocean" from Item 2, seconded by Commissioner Armour. Discussion followed. Motion failed by a 3 to 1 vote. Commissioner Armour suggested that the Ordinance remain as it is, and then allow a variance, if necessary. Motion was made and seconded to approve the changes to the Zoning Ordinance. Motion passed. ( Public Meeting April 8, 1983 Page 3 In answer to a question from member of the audience, Commissioner Dixson stated that the Zoning Ordinance, as now proposed, provides greater protection and assures, to the extent possible within the law, not only the preservation of the character of the community, but the assurance that in the foreseeable future there can be no substantive changes in the character of the Town of Gulfstream. . A member of the audience questioned the Commissioners' action in regard to the purchase of the Phipps property. There followed discussion. Town Attorney Randolph stated that it is not unusual for a town function to be a permitted use within a residential area. It is analagous to a permitted use of a church or a school within a residential area. Any decision will be done through public hearing. Mr. Caputo made a general presentation for the public regarding some of the changes, explaining that as early as 1974 it was a requirement of the State of Florida for each municipality to pass and adopt a Comprehensive Development Plan, and then to update all zoning requirements and land development regulations, so as to be consistent with the adopted plan of the community. The Zoning Ordinance and Zoning Map are implementing the designers of the Town, stating that they do not want it to change. He stated that there are changes in the Ordinance that further the goal of the Plan, also that they have now established a site plan review process. Town Attorney Randolph stated that those were general statements in regard to the changes. They are on file with the Town Clerk and have been available for review by the public. Motion was made and seconded to adopt the Zoning Ordinance with the refinements and revisions stated by Mr. Caputo. Motion passed unanimously. Commissioner Armour commended the Committee, Law Staff, and the City Commission for their support and dedication in this Plan, which will certainly be a benefit. The meeting was called to order at 9:40 A.M., and Roll Call was taken. Motion was made and seconded to approve the Minutes of the Commission meeting of March 11, 1983, Second Public Hearing Comprehensive Zoning of March 14, 1983, Special Commission Meeting of March 23, 1983, and the Special Commission Meeting of March 31, 1983. Motion passed. Town Manager Gwynn presented the Financial Report for the month of March, 1983. This report is made a part of the Minutes. Motion was made and seconded to approve said report. Motion passed. Police Chief Greer presented the Police Report for the month of March, 1983. This report is made a part of the Minutes. In accordance with State Statute, he made the quarterly report to the Commission in regard to the seized boat, and the funds are being handled by the Town Manager. On behalf of the Crime Stoppers, Chief Greer' thanked the Gulfstream Civic Association for donation which was given to them at the annual meeting. He explained that this organization gives out the funds for the anonymous tips. Mr. William Mayer, Planning Board, gave a report re: plans for a tennis court on the property of Mr. and Mrs. Thomas Brandt. The Planning Board recommended a variance on the property. Discussion followed. Town Attorney Randolph stated that it is necessary to comply with the terms of the Ordinance that Commission Meeting April 8, 1983 Page 2 sets up the Board of Adjustment and requires advertising for thirty days, and get a variance under the terms of the ordinance which is in effect. Mayor Koch stated that the request from the Planning Board will be denied and Petitioner is asked to come in with the required papers and follow the prescribed procedure. Mr. Charles Eaton, Planning Board, spoke regarding the drainage system at the Little Club. He stated that there is only one pump, and in the event of a malfunction, there would be a serious problem. The Club has completed a study, which has been presented to the Commission, and it is the recommendation of the Planning Board that the Town Engineer check out their findings. Mayor Koch suggested that the Engineer hired to do the Master Study could make a report on this matter, which was agreed. Mr. Gene Caputo, Executive Management, reported that with the completion of the Zoning Ordinance, the amount of funds that were established for the purpose of completing the Zoning ordin- ance and donated to the Town by the Civic Association have been expended. The project is not totally complete because of the requirements of the State of Florida, Local Government Compre- hensive Planning Act to complete the evaluation and review report. It is estimated an additional $2,000 to $3,000 is needed. He stated that the Planning Board (L.P.A) must, by law, review the proposed changes to the Plan, and the Evaluation and Review Report is an amendment to the Plan. This is to be done every five years. It was agreed that this amount would have to be paid. Town Manager Gwynn read a letter from Villa D'Este regarding storm drains that get clogged by pine needles. Discussion followed. It was decided to put the matter on a regular mainten- ance program of the Town Sanitation Department. Town Manager Gwynn stated that he had received much correspondence regarding a coalition of small towns, so that their voice will be heard at the State level, through the League of Cities Association. The City Manager of Holmes Beach is attempting to form a group and have a spokesman. He asked for the authority from the Commission to participate. The Liaison would be the Town of Palm Beach, and he listed the small towns that would be represented. Motion was made and seconded to join said group. Motion passed. Commission Meeting April 8, 1983 Page 3 Town Manager Gwynn read a letter received from Mr. Lee Burke, who stated that as a resident of Town of Gulfstream he was concerned about the placement of the City's insurance coverage with the Florida League of Cities Self Insurance Program. He stated that it was imperative that the City immediately take steps to ascertain that the self insurance program currently used is in a solvent fiscal condition and able to provide the City the insurance coverage for which it is paying. Commissioner Dixson stated that they have to be morally certain of the financial security of the insurance coverage and they are not exposed to any possible risks. Discussion followed. The matter will be looked into and report made on same. There being no further business to come before the Commission, the meeting adjourned at 10:20 A.M. N. m� �z �OzN N u !2 7 N E v U N v c W O 3 i v ORDINANCE NO. 1 -83 AN ORDINANCE OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, RESCINDING ORDINANCE NO. 108 OF THE TOWN AS AMENDED, IN ITS ENTIRETY, AND ADOPTING A NEW COMPREHENSIVE ZONING ORDI- NANCE TO PROMOTE THE HEALTH, SAFETY, MORALS AND GENERAL WELFARE OF THE INHABITANTS OF THE TOWN OF GULF STREAM, FLORIDA; REGULATING THE USES OF LAND, WATER, BUILDINGS AND STRUCTURES WITHIN THE TOWN OF GULF STREAM; REGULATING THE LOCATION, HEIGHT, SIZE OF BUILDINGS AND STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, THE DENSITY AND DISTRIBUTION OF POPULATION AND FOR SAID PURPOSES, CREATING DISTRICTS AND ESTABLISHING THE BOUNDARIES THEREOF AND ADOPTING A MAP OF SAID DISTRICTS; DEFINING CERTAIN TERMS USED; ESTA- BLISHING A BOARD OF ADJUSTMENT AND TOWN PLANNING BOARD; PROVIDING FOR THE ENFORCEMENT AND AMEND- MENT THEREOF; PROVIDING FOR PENALTIES FOR THE VIOLATION OF ITS PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, authority is conferred upon the Town of Gulf Stream lin the interests of promoting the health, safety, morals and general welfare of the residents of the Town of Gulf Stream, Florida to set forth the districting or zoning of the Town, for the purpose liof regulating the location of residences and other uses of pro - Iperty, and for the purpose of regulating the height of buildings !land other structures, and the dimensions of lots and yards in � I Iconnection with buildings and other structures, and for the purpose !of regulating the alignment of the buildings or other structures near street frontages, and regulating the types of buildings in conformity with building restrictions established by subdivision ;plats and the like; and WHEREAS, such authority was exercised by the Town Commission th the enactment of the Zoning Ordinances which became Ordinance o. 108 of the Gulf Stream Code of Ordinances; and WHEREAS, it is deemed necessary by the Town Commission of the Ilown of Gulf Stream to rescind the terms and provisions of Ordinance No. 108, as amended, and to adopt a new comprehensive zoning ordi- nance for the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE (TOWN OF GULF STREAM, FLORIDA, as follows: , Section 1. That the Zoning Ordinance adopted the 17th day of May, 1952 and all amendments thereto be and the same are hereby repealed. Section 2. That the Town of Gulf Stream, Florida Comprehensive Zoning Ordinance, together with the official Zoning Map, copies of which are filed with the Clerk of the Town be and the same are hereby adopted as the Comprehensive Zoning Ordinance of the Town of Gulf Stream. Section 3. That the copy of the Zoning Ordinance, known as the "Town of Gulf Stream, Florida, Comprehensive Zoning Ordinance" and also the "Official Zoning Map" of the Town of Gulf Stream be and the same are hereby adopted by reference. Section 4. That any person violating any provision of this Ordinance shall be punished by a fine of not less than twenty- five ($25.00) dollars, and not exceeding five hundred ($500.00) dollars, or by imprisonment for a term not exceeding six (6) months, or both by such fine and imprisonment. Section 5. That should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part thereof other than the part declared to be invalid. Section 6. That permission to codify this Ordinance is hereby granted. Section 7. That this Ordinance shall take effect immediately upon its passage and approval as provided by law.
