SPECIAL CXMSSION MEETING
August 24, 1983
Present: William F. Koch, Jr. Mayor
Alan I. Armour Commissioner
Robert J. Dixson Commissioner
Absent: Brian Pfeifler Commissioner
Joel Hunter Commissioner
Also Present: William Gwynn, Town Attorney, James Greer, Police Chief,
Barbara Gwynn, Town Clerk, Cynthia Harms, Secretary.
The meeting was called to order at 9:00 A.M., and Mayor Koch stated that
since they now have a quorum, the following items would be brought before
the Conmtission for consideration.
Gulf Stream Bath and Tennis Club, 925 North Ocean Boulevard. The matter
was considered for addition of shed and renovation of pantry. Motion
was made and seconded to approve said request. Motion passed.
Anthony Pugliese, 1511 North Ocean Boulevard. Request for portico and
study, and variance request. The plans were examined. Motion was made
and seconded for approval of said request, subject to the approval of
the State of Florida Department of Natural Resources. Motion passed.
Since there are two vacancies on the Planning Board at the present time,
the following names were presented for appointment:
Larry Stahl
Thomas E. Brandt
Motion was made and seconded to approve said appointments. Motion passed.
There being no further business to cane before the Commission, the Special
Meeting was adjourned at 9:12 A.M.

Dredging Project Report
A. Estimated Cost of Dredging (7 canals)
Depth Volume Cost
6' MLW 51200 cubic yards $ 369,920 plus $25000 set up fee
These costs are estimated on a charge of $8.50 per cubic yard. The
$25000 set up fee is for mobilization, demobilization, site preparation
& restoration (per report A.V. Strock, Engineer)
Note: There are three private canals which cannot be included in assess-
ment nor bond issue, nor contract the Town will award. It can be negoiated
at same time the town lets their contract by the private canal owners
B. Estimated Time
Once dredging contract has been awarded it will take approx ten(10)
weeks to complete project.
Method of Assessing Cost
A. Common cost of set up fee ($25000) to be equally divided between each
canal to be dredged. If seven canals are dredged cost per canal would
be $3572.00 per canal. The per canal cost would then be equally divided
by the number of lots which have seawalls abutting the canal. This cost
would be added to the dredging cost.
B. Dredging Cost
Each canal has a different amount of silt to be removed. The volume
can be measured. Cost of dredging a canal can be assessed in any
method the commission prescribes.
Examples:
(1) Method A
Cost to be assessed on a front foot basis of property
bounding or abutting upon the improvement (See Schedule 1)
(2) Method B
Cost be assessed as follows
308 of cost of each canal be equally divided between each
lot owner on canal, 708 of cost of each canal be assessed
on a front foot basis as described in #1 above (See Schedule
2)
3) Method C
Any other method the commission prescribes.
C. Attached Table shows cost per canal (Schedule 3)
D. Engineer Costs
1. Cost of project Engineer, Arthur Strock & Associates, paid for
by Town. Approx cost $25,000.
Miscellaneous Remarks
A. The Town owns approx. 845 running feet of seawall on Canal "A "(A
private canal).
Based on AVS ( Strock) 1100 cubic feet of silt are to be removed.
The Town's cost would be $4802 plus a portion of set up fee.

B. If the three private canals wish to be dredged the common set up cost of
$25000 should be shared with them.
C. Note a few lots only have 25 or less feet on canal which should be taken
into consideration when choosing the method of assessment. These canals
are at the mouth of the canal. (Normally there is shoaling at the mouth
due to a build up of silt as it enters canal)
IV. Assessment Procedure Steps (Covered by Chapter 170 of the Florida Statutes
& Letter of Town Attorney dated 12/9/82). (Letter Attached)
A. Once a Method of assessment is established & a dredging permit is let
& conditionally accepted, The Town commission must follow the procedure
as set forth below-
1. Pass a resolution setting forth
a. Nature of project - canals to be dredge etc.
b. Total estimated cost of the project.
c. Method & time of payment.
2. At the time of the adoption of the resolution an assessment plan
is required & be on file with the Town Clerk.
3. A public hearing date must be set and said notice be published
once per week for the two weeks prior to meeting.
We should notify each property owner by mail of information in
resolution & cost to him.
4. Conduct public hearing.
5. After hearing from all parties affected adopt the resolution with
changes if necessary.
6. The clerk will then create an assessment roll & notify all property
owners affected. A time & place must be set again for affected
property owners to be heard. All assessments must be recorded in
a special book, known as a "Improvement Lien Book."
7. Assessments must be paid as stipulated in resolution.
NOTICE This is rough resume of the procedure - it is
covered by Florida Statute Chapter 170 -- -(See
Town Attorney Letter of 12/9/82).

Gentlemen:
I have been asked to provide information relating to the procedures
necessary to accommodate the dredging of certain canals within the
Town. For your information, I am attaching to this letter a copy
of Chapter 170 of the Florida Statutes which sets forth in detail
the legal procedures involved in regard to the improvements con-
templated. Also, I am attaching a section of the Town Charter
relating to this matter.
As you will note it is necessary that the Town first Rase a rpsoll-
tion setting forth the nature of the proposed improvement, des -
.cribing the property 'Co De improved, ine portion of e expense
which is to be paid by special assessment, the manner in which the
assessment shall be made, when the assessments are to be paid and '
what part of the assessment shall be paid by the municipality.
"Me resolution shall state the total estimated cost of the project.
At the time of the adoption of the resolution there shall be on
file with the Clerk an assessment plat showing the area to be
assessed, with plans and specifications, and an estimate of the
,cost of the proposed improvement.VaThe resolution shall be pub-
lished once a week for a period of two weeks in a newspaper of
general circulation in the community. Upon the adoption of the
resolution the Town shall cause an assessment roll to be made and
upon completion of the assessment roll the Town shall, by resolu-
tion fix a time and place at which affected property owners may
appear and be heard as to the propriety and the cost of the improve-
ments. Ten days notice shall be given of this hearing to the
affected property owners and the time and place of the hearings
shall be published twice with the last publication to be at least
one week prior to the date of the hearing.

The Town Commission, at the hearing referenced above, shall meet
as an equalizing board to hear and consider any and all complaints
as to the assessments and upon completion of this task shall, by
resolution or ordinance, confirm-the assessments. After confirma-
tion the assessments shall be recorded in a special book known as
the "Improvement Lien Book ". The special assessments shall there-
after be payable at the time and in the manner stipulated in the
resolution and, if not paid, shall remain liens against the pro-
perty which may be foreclosed in the manner provided by law.

The Department Heads, along with recomlendations from several
Commissioners, presented a proposed budget of $1,121,000.00, which
would have required an increase in Town taxes of approximately 1278 over
the 1982 taxes. The majority of the Commission felt this was excessive,
therefore, during the July 18th hearing, the Commissioners reduced the
proposed budget by $284,400.00. This was achieved by reducing some of the
proposed capital improvements expenditures, such as reworking the water
main connections on A -1 -A at the north end of the system with Boynton
Beach, and on the south end with Delray Beach. Also, we deleted from the
capital projects section several improvements to the "Phipps" property,
recently purchased by the Town. We vetoed the proposal to purchase a
police boat and to add an extra policeman to patrol the waterway on the
weekends. The Countission also denied a motion to include a 208 pay in-
crease for the Police Department. Some of these worthwhile capital im-
provements will be included in the bond issue which will be voted on this
winter.
On July 21, 1983, we held our second meeting, and further reduced the
proposed budget by an additional $ 103,000.00. This was partially achieved
by reducing capital expenditures for consulting engineering fees and re-
ducing all employee salary increases from a proposed 108 to 88. Even with
the 88 increase, our patrolman's starting salary will be above the present
county mean average of $19,651 per police salary survey 1983, ( see en-
closed fact sheet ).
The tentative budget now stands at $733,310.00, which would require a tax
millage of 5.4076. This would be an increase of 25.98 over last year's
millage.

to Gulf Stream in area and population.

Both of these meetings were well attended by the public and their ocnments and
suggestions were a big help to the Cannission in dealing with this issue.
By now, you should have received a notice from the Palm Beach County Property
Appraiser's office advising you of the tentative millage rate and the dates and
place of the first public hearing on this budget. This meeting will be held
Thursday, September 8, 1983, at 5:01 P.M., at the Town Hall, 246 Sea Road, Gulf
Stream, Florida. We urge you to attend.
I personally feel that we can further cut the budget at that time and still
maintain the high quality of service that we have had in the past.
Enclosed is a copy of the proposed budget for the year 1983 -84, as copared with
the 1982 -83 budget. Also enclosed is a fact sheet that relates to certain items
for the budget.
