HomeMy Public PortalAboutORD16130BILL NO. 2021-008 SPONSORED BY Councilmember Lester ORDINANCE NO. 1(0130 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 14.32 ACRES LOCATED IN THE 3700 BLOCK OF WEST EDGEWOOD DRIVE FROM C -O, C-2, RA -1 AND RU TO PUD PLANNED UNIT DEVELOPMENT, APPROVING A PRELIMINARY PUD PLAN FOR THE PROPERTY, AND APPROVING THE FINAL SUBDIVISION PLAT OF AMERICARE SUBDIVISION. WHEREAS, it appears that the procedures set forth in the Zoning Code relating to zoning have in all matters been complied with; and WHEREAS, the Robert and Joan Kauffman Trust U/T/A dated March 20, 2008, owner of the real estate described in section one, having submitted to the City Council a plat of said real estate, being located in Jefferson City, Cole County, Missouri; and WHEREAS, it appearing that said plat has been fully and properly signed and accepted by the owner of said subdivision, known and referred to as Americare Subdivision. That all taxes have been paid, that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said subdivision, and that in all respects the requirements of the Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Property Description: Part of the West Half of the Northwest Quarter of Section 16, and part of the East Half of the Northeast Quarter of Section 17, all in Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri, more particularly described as follows: From the Northeast corner of Section 17, Township 44 North, Range 12 West; thence S0040'48"W, along the Section line, 913.06 feet to a point on the southerly right- of-way line of West Edgewood Drive as per Book 428, page 207, Cole County Recorder's Office and the POINT OF BEGINNING for this description; thence southeasterly, along the southerly right-of-way line of West Edgewood Drive, on a curve to the left having a radius of 1101.74 feet, an arc length of 503.46 feet (chord of said curve being S81 °47'59"E, 499.09 feet); thence SO4053'27"E, 55.00 feet to a point in a creek bed; thence along the creek bed the following courses: S77042'26"W, 47.92 feet; thence S49042'26"W, 179.54 feet; thence S74057'02"W, 63.25 feet; thence S63009'16"W, 110.22 feet; thence S45°38'12"W, 169.96 feet; thence S59042'01 "W, 45.68 feet to a point on the aforesaid Section line; thence S8301 1'53'W, 126.09 feet; thence S41026'43"W, 94.02 feet; thence S20050'16"W, 96.89 feet; thence S54057'33"W, 24.85 feet; thence S75013'50"W, 246.90 feet; thence S80°53'06"W, 141.60 feet; thence S53052'55"W, 170.92 feet; thence S69°05'11 "W, 69.96 feet; thence N21 °47'27"W, 62.87 feet; thence N05038'54"W, 72.11 feet; thence N19013'04"E, 18.12 feet; thence N15050'40"W, 95.42 feet; thence N32026'33"W, 67.50 feet; thence N79001'04"W, 37.87 feet; thence N18025'46"W, 85.39 feet; thence N48003'1 5"W, 22.63 feet; thence leaving the creek bed, N55053'20"E, 985.94 feet to a point on the aforesaid southerly right-of-way line of West Edgewood Drive; thence southeasterly, along the southerly right-of-way line of West Edgewood Drive, on a curve to the left having a radius of 1101.74 feet, an arc length of 202.77 feet (chord of said curve being S63026'11"E, 202.48 feet) to the POINT OF BEGINNING. Containing 14.32 acres. Section 2. The real estate described in Section 1 is rezoned from C -O, C-2, RA -1 and RU to PUD. Section 3. The Preliminary PUD Plan, on file as Case No. 21004 in the Jefferson City Planning Division, is hereby approved for the property described in Section 1. Section 4. Permitted Land Uses: Permitted uses for the property shall be limited to assisted and independent senior living facilities. Signage and lighting shall adhere to the allowances of the C-1 zoning district. Section 5. Common Areas and Public Land. No common areas are proposed and no lands are dedicated to public use within this PUD Plan. Section 6. That the Final Subdivision Plat of Americare Subdivision, lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat attached hereto and made a part of this ordinance, is hereby approved and accepted by the City Council of the City of Jefferson, Missouri. Section 7. The Mayor and City Clerk are hereby authorized and directed to endorse acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of Jefferson. Section 8. This Ordinance shall be in full force and effect from and after the date of its passage and approval.
