Home My Public Portal AboutORD16135BILL NO. 2021-007 SPONSORED BY Councilmember Fitzwater ORDINANCE NO. jj /R/3 - AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A SANITARY SEWER AND DRAINAGE EASEMENT ON THE PROPERTY ADDRESSED AS 282 MADELINE'S PARK CIRCLE, IN THE CITY OF JEFFERSON, MISSOURI. WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the owners of 282 Madeline's Park Circle, have petitioned the City Council to vacate a sanitary sewer and drainage easement; and WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue the sanitary sewer and drainage easement for public use as described in Section 1 of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as a sanitary sewer and drainage easement the area described as a portion of property addressed as 282 Madeline's Park Circle, in the City of Jefferson, Missouri and forever vacate the following described sanitary sewer easement in said City: Part of Lot 25 of Madeline's Park Subdivision of record in Plat Book 12, Page 221, Cole County Recorder's Office, being situated in part of the East Half of the Northeast Quarter of the Southeast Quarter of Section 4, Township 44 North, Range 12 West in the City of Jefferson, Cole County, Missouri, more particularly described as follows: From the southeasterly corner of said Lot 25, also being a point on the northerly right-of-way line of Madeline's Park Circle, thence N10012'03"W, along the easterly line of said Lot 25, 189.58 feet to a point on the southerly line of a Sanitary Sewer and Drainage Easement shown on the plat of said Madeline's Park Subdivision; thence S73044'26"W, along the southerly line of said Sanitary Sewer and Drainage Easement, 55.66 feet to the POINT OF BEGINNING for this easement vacation description; thence S00°38'26"E, along the easterly line of a 35' Sanitary Sewer and Drainage Easement shown on the plat of said Madeline's Park Subdivision, 28.60 feet; thence S89021'34"W, 5.00 feet; thence N00°38'26"W, 28.60 feet; thence N89021'34"E, 5.00 feet to the point of beginning. Containing 142 S.F. Section 2. The statutory right of reversion in the owners of the abutting property is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this ordinance, in the right of way vacated. Section 3. This Ordinance shall take effect and be in full force from and after its passage.
