RESOLUTION NO. 90 -2926
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY DENYING AN APPEAL OF THE
PLANNING COMMISSION DECISION APPROVING ZONE
VARIANCE 89 -1009 AT 5832 ALESSANDRO
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY
RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. Based upon a public hearing to consider the
appeal of the Planning Commission's approval, City Council made
the following findings:
1. There are no exceptional or extraordinary circumstances
or conditions applicable to the property which do not
generally apply to other properties in the same zone in
that the subject lot is 50 feet wide, is rectangular in
shape and is generally level, similar to other R -2 zoned
lots; and
2. That such a variance is not necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other properties similarly situated in that
other comparable lots are required to provide the mini-
mum driveway width in order to provide adequate ingress
and egress; and
3. That the granting will be materially detrimental to the
public welfare and injurious to the adjacent property in
that the proposed 11' 6" driveway will negatively impact
abutting properties and could result in on street park-
ing problems because of poor access; and
4. That there are no special circumstances as provided in
Section 65906 of the California Government Code in that
the subject site is 50' x 180' deep and possesses no
unusual characteristics which would differentiate it
from other lots along Alessandro Avenue and elsewhere
throughout the City..
SECTION 2. Accordingly, Zone Variance 89 -1009 is hereby
denied.
SECTION 3. The City Clerk shall certify to the passage of
and adoption of this Resolution.

City at a regular meeting held on the 2nd day of January, 1990 by
the following vote:
