Also Present: William F. Gwynn, Town Manager, James Greer, Police Chief,
John Randolph, Town Attorney, William Mayer, Lawrence Stahl,
and Thomas E. Brandt, Members of the Planning Board,
Barbara Gwynn, Town Clerk, Cynthia Harms, Secretary.
In the absence of Mayor Koch, the meeting was called to order by Acting Mayor
Hunter at 9:00 A.M., and Roll Call was taken. Motion was made and seconded to
approve the minutes of the Special Meeting of September 8, 1983, Commission
Meeting of September 9, 1983, and Budget Hearing of September 15, 1983, with
the following changes:
Commission Meeting, September 9, 1983: The last line of the third
paragraph, page 3, following the word "that ", strike the words,
the bond issue would not pass and insert no such contribution
should be made, for to provide for such would adversely affect the
success of the passage of the bond issue now being studied ".
Page 2: Bottom of the page - figure should be $25,000 instead of
$2,500.
Motion passed.
Town Manager Gwynn presented the Financial Report for the month of September,
1983. This report is made a part of the minutes. Motion was made and seconded
to approve said report. Motion passed. He stated that the Auditors will be
starting to work on Monday, and report should be ready for the December meeting.
Chief Greer presented the Police Report for the month of September, 1983. This
report is made a part of the minutes. The Chief requested the Commission's
advice as to how to proceed regarding the violation of the Alarm Ordinance,
particularly in regard to one resident, where the fines have accumulated to
approximately $150. Town Attorney Randolph gave the different methods whereby
the matter could be handled, either the Chief could issue a sumnns for
violation or by civil court procedure. There was continued discussion. It
was decided to wait until the resident returns in January to have the Chief
approach him on a personal basis. Mr. Hunter suggested that the Chief and
Town Counsel confer and make a recommendation as to how these matters should
be handled in the future. Mr. Hunter assured the Chief that he has the backing
of the Commission in enforcing the Ordinance, which was concurred by all members.

Mr. Lawrence Stahl, member of the Planning Board, gave the report for said Board.
Patterson, 3268 North Ocean Boulevard, Variance request. Motion was made
and seconded to approve the request for a variance. Motion passed.
Eavenson, Lot 64, Place Au Soleil. New site plan meets all setbacks.
Notion was made and seconded to approve site plan. Motion passed. The
fee of $100 is to be decided by the Planning Board.
Van Iennep, 3370 North Ocean Boulevard - Variance request - set back - garage.
Notion was made and seconded to approve. Motion passed.
Little Club - Water tank - whether to be advertised. Since the Town is the
adjoining property owner, it is not necessary to advertise.
Gulf Stream Golf Club - Mr. Mayer requested that a temporary Certificate of
Occupancy be issued because there has been much discussion by surrounding
residents regarding the landscaping. There was discussion about the height
of the hedges. The Planning Board will coordinate the matter. Mr. Dixson
stated that it has been made clear to him by members of the Board of Governors
of the Gulf Stream Golf Club that the community should be assured that they
will take every reasonable means to continue their reputation as an important
and good neighbor in the community.
Mr. Hunter stated that this is an important matter of concern to not only
residents adjoining the Golf Club, but the community as a whole. It is
entirely proper for the matter to come before the Commission for discussion,
but as a matter of procedure he suggested that things be kept in the Planning
Board. The Planning Board will be clothed with more authority and dignity
and can always come to the Commission for advice and consultation. It was
noted that the matter was discussed and the procedure which had been suggested
was approved.
Gray - Indigo Point, Place Au Soleil. Request for pool and landscaping
approval. It meets all the requirements. Notion was made and seconded to
approve the site plan. Notion passed.
There was discussion about the procedures of the Planning Board to be in conformity
with the new Zoning Ordinance.
Town Manager Gwynn presented Ordinance 83 -2 on Second and Final Reading as follows:
AN ORDINANCE OF THE TOWN OM14ISSION OF THE TOWN OF GULF STREAM,
FLORIDA, PROVIDING THAT A FEE OF ONE HUNDRED SEVENTY FIVE DOLLARS
($175.00) BE IMPOSED AGAINST ANY PERSON WITHIN THE TOWN WHO CAUSES
EMERGENCY MEDICAL EQUIPMENT AND PERSONNEL OF THE CITY OF DELRAY
BEACH TO BE DISPATCHED WITHIN THE MUNICIPAL LIMITS OF THE TOWN OF
GULF STREAM.

Motion was made and seconded to approve said Ordinance No. 83 -2 on Second
and Final Reading. Motion passed.
Town Manager Gwynn presented Ordinance 83 -3 on Second and Final Reading as
follows:
AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA AMENDING THE OFFICIAL ZONING ORDINANCE OF THE TOWN AT
SECTION VIII - "RM" MULTIPLE - FAMILY RESIDENTIAL DISTRICT; PROVIDING
FOR SIDE YARD REQUIREMENTS WITHIN SAID DISTRICT; PROVIDING FOR
SEVERABILITY{ PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE.
Motion was made and seconded to approve Ordinance 83 -3 on Second and Final
Reading. Motion passed.
A recommendation to increase the trash charges due to Palm Beach County's Trash
Disposal increase was discussed at this time. Town Manager Gwynn explained the
background of the matter, stating that starting October 1, 1983, the County Dump
has started charging on a cubic yard basis and every truck is being weighed. The
raise has gone from $1.00 to $2.75 per cubic yard. It is recommended that the
Town's charges be raised from $7.00 to $9.00 per cubic yard. Motion was made
and seconded to approve said recommendation. Motion passed.
Town Attorney Randolph stated that he had drafted Ordinance 83 -4, in regard to
billing customers a late fee for failure to pay water bills in a two -month
period. He explained the contents of same in regard to shut -off charges and
penalties, and notice to property owners. There was discussion about the pro-
visions, after which Town Manager Gwynn presented Ordinance 83 -4 on First Reading,
as follows:
AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA, PROVIDING FOR THE DISCONTINUANCE OF WATER SERVICE TO
PREMISES FOR WHICH A WATER BILL REMAINS UNPAID FOR A PERIOD OF
THIRTY DAYS AFTER THE BILL IS RENDERED AND MAILED; PROVIDING
FOR A PENALTY ON UNPAID WATER BILLS; PROVIDING FOR A LIEN;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PRO-
VIDING AN EFFECTIVE DATE.
Motion was made and seconded to approve Ordinance 83 -4 on First Reading. Motion
passed.
Conuissioner Armour gave a report regarding the dredging project. Reports have
been given to the Department of Environmental Regulation and approval is
anticipated by the end of October. There will be a meeting November 21, 1983
at 10:00 A.M., at Gulf Stream Golf Club, and notice will be sent out to all
waterfront property owners, with photograph showing the condition of the canal.

A representative from Arthur Strock & Co. will be present to give the
Engineer's report. He also suggested the Town set up a maintenance
dredging program in the future for the canals. There was discussion about
the three privately owned canals.
Town Manager Gwynn presented Resolution 83 -8, which had been received from
the Town of Ocean Ridge. Mayor Koch had requested that it be presented, and
he is in favor of its adoption.
A RESOLUTION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, SUPPORTING THE TOWN OF OCEAN RIDGE IN ITS EFFORTS
AT BEACH RESTORATION.
There was discussion regarding said Resolution, and Town Attorney Randolph
explained the purpose of the Resolution. Motion was made and seconded to
approve said Resolution. Notion passed unanimously.
Town Manager Gwynn presented a water bill which Mrs. Winifred Jackson,
3054 Gulf Stream Road, had requested be read to the Commission, with the
notation, "This is an impossible bill ". Said bill was for August and
September, total charge $254.88. Town Clerk Barbara Gwynn explained that
Earl Harvel has checked said meter and the water had gone through the meter
and the money is owed. The meter is back to normal now. It was concluded by
the Commission that the bill must be paid.
There being no further business to come before the Commission, the meeting was
adjourned at 10:55 A.M.

ORDINANCE NO. 83 -3
AN ORDINANCE OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA AMENDING THE
OFFICIAL ZONING ORDINANCE OF THE TOWN AT
SECTION VIII - "RM" MULTIPLE- FAMILY RESIDENTIAL
DISTRICT; PROVIDING FOR SIDE YARD
REQUIREMENTS WITHIN SAID DISTRICT; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, FLORIDA, AS FOLLOWS:
Section 1. Section VIII - "RM" Multiple - Family
Residential District is hereby amended at item "I" thereunder to
read as follows:
"I. Side Yard Required.
1). There shall be side yards of not less
than twenty -five (25) feet or twenty -five
(25) percent of the average footage of the
lot width whichever is greater on each side
of a building, including porches,
projections, cornices and eaves.

2). Where any lot is located on any
street intersection, or where two or more
street lines outline any lot, or where any
lot is located upon any corner, each side of
the lot facing a street shall, for the
purpose of determining setbacks, be deemed to
be the front of said lot. Provided, however,
that this provision shall never be construed
to require any building to be set back along
any street a further distance than the
average setbacks along said street."
Section 2. That should any section or provision of
this Ordinance or any portion thereof, any paragraph, sentence or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part thereof other than the
part declared to be invalid.
Section 3. That permission to codify this Ordinance is
hereby granted.
Section 3. That this Ordinance shall take effect
immediately upon its passage and approval as provided by law.

AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, FLORIDA, PROVIDING THAT A FEE OF ONE HUNDRED
SEVENTY FIVE DOLLARS ($175.00) BE IMPOSED AGAINST ANY
PERSON WITHIN THE TOWN WHO CAUSES EMERGENCY MEDICAL
EQUIPMENT AND PERSONNEL OF THE CITY OF DELRAY BEACH TO
BE DISPATCHED WITHIN THE MUNICIPAL LIMITS OF THE TOWN
OF GULFSTREAM.
WHEREAS, the Town of Gulf Stream has entered into an
Interlocal agreement with the City of Delray Beach, wherein the
Town of Gulf Stream employs the services of the City of Delray
Beach Emergency Medical Service; and
WHEREAS, to provide the above referenced service the
City of Delray Beach charges the Town of Gulf Stream the amount
of ONE HUNDRED SEVENTY FIVE DOLLARS ($175.00) for each occasion
in which the City of Delray Beach dispatches emergency medical
equipment and personnel within the limits of the Town of Gulf
Stream;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, FLORIDA, as follows:
Section 1. In the event, because of an emergency
situation, it is necessary that the City of Delray Beach dispatch
emergency medical equipment and personnel within the municipal
limits of the Town of Gulf Stream, for which a charge of ONE
(HUNDRED SEVENTY FIVE DOLLARS ($175.00) is imposed, it shall be

the responsibility of the party for whom the emergency medical
equipment and personnel were dispatched to reimburse the Town of
Gulf Stream in the amount of ONE HUNDRED SEVENTY FIVE DOLLARS
($175.00) for said services. Said amount shall be paid to the
Town no later than thirty days from the date the emergency
medical equipment and personnel were dispatched for the benefit
of the person for whom the services were employed.
Section 2. In the event it becomes necessary for the
Town of Gulf Stream to take legal action in order to collect the
fee referenced herein from the party responsible therefore, the
Town, in the event it prevails in court, shall be entitled to
court costs and attorney's fees incurred as a result of having to
take said action.
Section 3. Should any section or provision of this
Ordinance or any portion thereof, any paragraph, sentence or word
be declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder
hereof as a whole or any part thereof other than the part
declared to be invalid.
Section 4 That permission to codify this Ordinance is
'hereby granted.
Section 5 That this Ordinance shall take effect
immediately upon its passage and approval as provided by law.

RESOLUTION NO. 83 -8
A RESOLUTION OF THE TOWN OF GULF STREAM, PALM BEACH
COUNTY, FLORIDA, SUPPORTING THE TOWN OF OCEAN RIDGE
IN ITS EFFORTS AT BEACH RESTORATION.
WHEREAS, the Town Commission of the Town of Gulf Stream, is aware
of the concerted efforts of the Town Commission of the Town of ocean Ridge
toward beach restoration; and
W[EWAS, it has cram to the attention of the Town Commission of the
Town of Gulf Stream that the Florida Department of Environmental Regulation
has tentatively denied a permit to Palm Beach County to restore the beaches
through offshore dredging but has tentatively granted a permit for an alter-
native method involving "improvements" to mechanical sand transfer operations
at the South Iake Worth Inlet; and
WHEREAS, the Town of Gulf Stream supports offshore dredging as the most
effective method of beach restoration and opposes "improvements' to the sand
transfer plant which will not improve beach restoration for the beaches south
of the South Lake Worth Inlet;
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, FLORIDA,
Section 1. That the Town Commission of the Town of Gulf Stream, hereby
supports the Town of ocean Ridge in its efforts at beach restoration and
supports said Town in its activities relating to same.
Section 2. That a copy of this Resolution shall be submitted to the
Palm Beach County Commission, the Florida Department of Environmental Regulation,
mmibers of the local legislative delegation and any other entity requesting same.

Gentlemen:
On Wednesday, October 5, 1983, the writer had the privelege to appear
before the Town of Gulf Stream's Planning and Zoning Board to present the
Gulf Stream Golf Club's Landscape Plan for their new maintenance building
seeking at the same time the advice, guidance and approval of the plan.
Present also was the Club's Golf Course Superintendent, Stanley Carr, who
reviewed before the members of the Board, the proposed Landscape Plan.
While describing the plan and the location of various trees and shrubs,
three property owners, Mr. & Mrs. William L. Wallace and Mrs. John K. Whitte-
more, came forward and,joined the discussion. Much to our dismay, the com-
ments of Mr. Wallace dealt primarily with criticism of the esthetic value of
the presence of the maintenance building, and the location of the driveway
entrance on Golf View Road. Mr. Carr and I explained that the planned land-
scaping would without doubt provide adequate screening and would substantially
enhance the appearance of the premises. We suggested that Mr. Wallace defer
his criticism pending completion of the landscaping.. This did not seem to
satisfy him, and he persisted in demanding that the new driveway entrance
be abandoned and sealed off, and suggested that we use an old narrow entrance
to the property located further east. We explained that this would not be
practical, due to the higher elevation of the old entrance, and further of
considerable importance, the fact that the new entrance conforms to County
Regulation which require proper width for the passage of fire fighting equip-
ment and two -way movement of vehicles. We also reminded Mr. Wallace that our
site plans and building design and detail plans had all been submitted and
approved by both the Planning and Zoning Board and by the Town Council, on
the basis of which over a quarter of a million dollars has been expended. He
said he realized his complaint was after the fact, but, regardless, he con-
tinued to press for the closing of the new entrance, and wanted my assurance
that something would be done about it.
I informed Mr. and Mrs. Wal "lace and Mrs. Whittemore that we are now
aware of their concern, and that Gulf Stream Golf Club is most desirous of
being a good neighbor, and that we are doing everything practical to make
our new facility unobtrusive and yet an attractive adjunct to the community.

I believe it is worthy of note here that the Gulf Stream Golf Club has been a
significant contributor to the environment and character of the Gulf Stream
community largely through the unique beauty of its properties for over 60
years. I further stated that Mr. Wallace's request would be given full con-
sideration, and that when estimated costs of the requested revisions were
known, and the feasibility of making such changes had been determined, the
matter would be presented to Club authorities for a decision at its up- coming
Board meeting.
Mr. Stahl then called attention to the fact that our reason for being
there was to consider the Landscape,Plan which was being presented for approval.
Whereupon Mr. Eaton,.Mr. Brandt and Mr. Stahl all expressed their unanimous
consent to the Plan.
When asked about the Certificate of Occupancy, approval for which has
been indicated by the County, Mr. Stahl stated that the Planning and Zoning
Board is not authorized to issue same, but could only recommend to the Town
Council, in whom final authority is vested.
Any delay will work a considerable hardship on Gulf Stream Golf Club,
for there are over thirty major pieces of maintenance equipment sitting out
in the weather awaiting shelter in the new building, and our employees are
operating at a considerable handicap in temporary quarters in a cart storage'
shed. We earnestly urge the Town Council to take immediate affirmative action
in granting our Certificate of Occupancy, as we, in good faith, have fulfilled
all the necessary requirements for the granting of such certificate.
