W + .0 105-172 Date of Adoptìon~'!Y 19, 2005 OPPOSING ANY PROPOSED FEDERAL LEGISLATION ABOLISHING MUNICIPAL CABLE FRANCHISES WHEREAS, the United States House of Representatives Telecommunications Subcommittee is currently holding hearings in regard to proposed legislation that would limit or abolish municipal franchises of cable television; and WHEREAS, the above mentioned subcommittee may have the legislation before the House of Representatives this summer of 2005 for its consideration; and WHEREAS, municipalities award franchises to cable companies; and WHEREAS, the Borough finds that cable fTanchises benefit the Borough and the Borough's residents by: 1. requiring that providers repair any harm that they may cause to the Borough's streets; and 2. requiring providers to relocate lines at their expense when Borough streets are straightened or widened; and 3. requiring bonds, insurance and other security so that the Borough and its residents are protected incase the provider causes damage or goes out of business; and 4. requiring the provider make available cable channels for local government and public access, providing compensation to the Borough for use of public property; and 5. requiring the carriage of local emergency alerts, prohibiting redlining or similar economic discrimination; and 6. providing customer service protections and enforcement mechanisms. WHEREAS, the Borough finds that elimination of the cable franchises and the benefits and protections afforded to the Borough and its residents thereby would be detrimental to the public interest. NOW, THEREFORE BE IT RESOLVED by the Mayor and Borough Council as follows: 1. That the Borough of Carteret hereby formally opposes any federal legislation providing limitations and/or abolishing the award of cable television franchises by New Jersey's municipalities. 2. That a certified copy of this Resolution be forwarded to The Honorable Jon Corzine, Senator, The Honorable Prank Lautenberg, Senator, and The Honorable Robert Menendez, Congressman.
