RESOLUTION NO. 90 -2942
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY SUSPENDING AND TEMPORARILY
REVOKING CONDITIONAL USE PERMIT 82 -668 FOR
TEMPLE GARDEN RESTAURANT LOCATED AT 9669 LAS
TUNAS DRIVE (WANG)
SECTION 1. Based upon testimony received at a noticed
public hearing and upon facts contained in the staff report, the
City Council hereby suspends Conditional Use Permit 82 -668 and
prohibits the Temple Garden Restaurant from reopening until such
time that the required on- premises trash enclosure is installed
and made operational.
SECTION 2. This suspension and interim revocation of Condi-
tional Use Permit 82 -668 is based upon the following findings of
fact:
1. The Conditional Use Permit as granted is being exercised
contrary to the terms and conditions of such approval in
that a specific condition imposed by the City Council on
November 7, 1989 specified that an on- premise trash
enclosure be installed and no such trash enclosure has
been installed. Said condition is contained in Resolu-
tion No. 89 -2914.
2. That the use for which the approval was granted is being
exercised so as to be detrimental to the public health
and constitutes a nuisance in that the absence of an
on- premise trash enclosure has resulted in healthful
conditions at the common trash enclosure area.
SECTION 3. The City Clerk shall certify to the adoption of
this Resolution.

I certify that the foregoing Resolution, Resolution No.
90 -2942 was duly adopted by the City Council of the City of
Temple City at their regular meeting held on the 6th day of
March, 1990, by the following vote:
AYES: Councilmember- Breazeal ,Gillanders,Swain,Froehle
NOES: Councilmember- Atkins
ABSENT: Councilmember -None
