GWYNN MINUTES Town Clerk BARBARA GWYNN Chief of Police JAMES GREER In the absence of the Mayor and Vice Mayor, Mr. Gwynn called the meeting to order at 9 A.M. 1. Roll Call. Present Others Present Commissioner Armour Bill Gwynn, Town Manager Commissioner Dixson Gene Caputo, Ass't Town Manager Commissioner Pfeifler Barbara Gwynn, Town Clerk John Randolph, Town Attorney Clarence Sova, Public Works Jim Greer, Chief of Police William Mayor, Chairman P & Z Board Absent Mayor Koch Vice Mayor Hunter 2. Appointment of Chairman Upon a motion by Mr. Dixson and seconded by Mr. Pfeifler, Mr. Armour was appointed to chair the Commission Meeting. 3. Approval of Minutes: Regular Commission Meeting August 10, 1984 Special Commission Meeting August 23, 1984 Special Commission Meeting September 6, 1984 a continuation of the August 23rd meeting. Board of Adjustment Meeting September 6, 1984 Special Budget Hearing September 6, 1984 Mr. Dixson offered an amendment to the September 6, 1984, Board of Adjustment Meeting. Upon a motion by Mr. Pfeifler and seconded by Mr. Dixson, all the sets of minutes were unanimously approved as submitted and amended. 4. Financial Reports, August 1984. Mr. Gwynn presented the Financial Reports for the month of August, 1984 and reported that there were no significant transactions. He further stated that there appears to be a possible surplus for the current fiscal year based upon changes in the assessed valuation. This report is made a part of these minutes. 5. Presentation of Police Reports, August 1984. Chief Greer presented the Police Report for the month of August, 1984 ��J Commission Meeting Cont. September 14, 1984 Page 2. which is a part of these minutes. He reported that there has been no crime during the month. 6. Presentation by the Planning and Zoning Board. B.O.A. #4 -84 A request by Michael Daniel, agent for William P. Sellas, for a variance to Section X -I. I. e. of the Zoning Ordinance to allow for the location of an open swimming pool in the rear yard set- back on property located at 570 Banyan Road. Mr. Mayer, Planning & Zoning Board Chairman, presented the petition and recommendation of approval from the Planning & Zoning Board. Upon a motion by Mr. Pfeifler and seconded by Mr. Dixson, the request was unanimously approved. 7. Second and Final reading of Ordinance #84 -3 Upon the reading of Ordinance #84 -3 by title only, a motion was made by Mr. Pfeifler and seconded by Mr. Dixson to approve Ordinance #84 -3. The Commission proceeded to unanimously approve the Ordinance. 8. Second and Final reading of Ordinance #84 -4 Upon the reading of Ordinance #84 -4 by title only. a motion was made by Mr. Pfeifler and seconded by Mr. Dixson to approve Ordinance #84 -4. The Commission proceeded to unanimously approve the Ordinance. 9. First reading of Ordinance #84 -5, an Ordinance prohibiting debris etc. Upon the reading of Ordinance #84 -5 by title only, a motion was made by Mr. Pfeifler and seconded by Mr. Dixson to approve Ordinance #84 -5. The Commission proceeded to unanimously approve the Ordinance. 10. First reading of Ordinance #84-6, an Ordinance prohibiting debris, etc.,on roofs. Mr. Randolph read the Ordinance in full and recommended that it be passed and adopted as an emergency ordinance due to the hurricane season. Upon motion by Mr. Pfeifler, and second by Mr. Dixson, the Commission unanimously approved and adopted Ordinance #84 -6 as an emergency action. COMMISSION MEETING Cont. September 14, 1984 Page 3. 11. Comments and Recommendations from Commission Members. Mr. Dixson asked Mr. Randolph about the status of the satellite antenna ordinance. Mr. Randolph stated that he will research the question of the Town's ability to prohibit them and report back at the October meeting. Mr. Dixson also voiced his concern about a carport which had been erected, which violates Town Ordinances. Mr. Randolph suggested that the Town notify the County Building Department and have them cite the property owner of the violation. A variance could then be requested by the property owner. Mr. Armour asked Mr. Caputo to give a status report on the bond issue projects. Mr. Caputo presented time schedules, which are made part of these minutes. He also presented a letter from the engineer regarding the installation of swales in Place Au Soleil. Because of potential time delays, Mr. Caputo also asked for authority to approve minor change orders without Commission action. Following a brief discussion and upon a motion by Mr. Pfeifler =' and second( by Mr. Dixson, the Commission unanimously approved the request to give Mr. Caputo and Mr. Gwynn the authority to approve change orders up to $5,000 only for the roadway and drainage improvements project. 12. Public requests or comments from the floor. Mr. Ken Bacheller asked about the passage of zoning ordinance requiring additional property setbacks. He was informed that the ordinance was properly advertised and passed in accordance with state law. 13. Adjournment. There being no further business, the meeting was adjourned at 10:10 A.M. Adoption of codes by reference. The Town hereby adopts by reference the provisions of all building codes now in force and effect in Palm Beach County as adopted by the Board of County Commissioners of Palm Beach County, Florida, and the building department of that county, said codes being as follows: (1) The Standard Building Code, 1982 edition and the county amendments as to the Standard Building Code; (2) The National Electrical Code, 1981 edition, and the county amendments to the National Electrical Code; (3) The Standard Plumbing Code, 1979 edition, and the county amendments to the Standard Plumbing Code; (4) The Current Life Saving Code Number 101; (5) The Standard Gas Code, 1982 edition; (6) The Standard Mechanical Code, 1982 edition; (7) Palm Beach County Swimming Pool Code, 1981 edition; (8) Palm Beach County Mobile Home Inspection and Tie Down Code, 1981 edition." It shall be unlawful for any person to stop, stand, park or operate any motor vehicle upon the ocean beaches or the banks and dunes adjacent thereto within the limits of the Town. Provided, however, nothing herein shall prevent official motor vehicles of a government agency from traversing said beaches, banks or dunes in the performance of official governmental duties. Section 2. In any prosecution charging a violation of a provision of this section or other ordinance governing the stopping, standing, parking or operating of a vehicle, proof that the particular vehicle described in the complaint was parked or operated in violation of any such ordinance or regulation, together with proof that the defendant named in the complaint was at the time of such parking or operating the registered owner of such vehicle, shall constitute in evidence a prima facie presumption that the registered owner of such vehicle was the person who stopped, stood, parked or operated such vehicle at the point where, and for the time during which, such violation occurred. Section 3. A person found to be in violation of the terms of this section shall be subject to the provisions of the Code of Ordinances relating to general penalties. Section 4. Temporary storage of materials for periods of time not to exceed forty -eight (48) hours, which storage is necessary for roof construction or roof repairs may be allowed by permit granted by the Town. Section 3. Each day a violation of this code continues to exist shall be deemed a separate violation. Section 4. Anyone found guilty of violating the provisions of this Ordinance shall be penalized pursuant to the provisions of the general penalty provisions of the Code of Ordinances of the Town. Section 5. If any section, paragraph, clause, phrase or term of this Ordinance be declared invalid, the same shall not operate to invalidate any other provisions. Section 6. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream, Florida. Section 7. This Ordinance shall become effective immediately upon first and final reading as a genuine emergency exists because of the fact that the Town is in the midst of the hurricane season and there exists an immediate need for the enforcement of the terms of this Ordinance.
