AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING THE RIGHT-OF-WAY IN INLOT 610 FROM ADAMS ST TO MONROE
ST AND THE 20 FT ALLEY FROM MILLER ST THAT ATTACHES PERPENDICULARLY
TO THE HANDLEY WAY ALLEY.
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the
owners of land adjacent to and abutting upon an alley known as Handley
Way to the south of Inlots 605-608 and an unnamed alley abutting Inlots 610
and 612 in the City of Jefferson, have petitioned the City Council to vacate a
portion of the right of way; and
WHEREAS, it has further been shown that it would not inconvenience the public or the
citizens of the City to discontinue a portion of the right-of-way for public use
as described in Section 1 of this Ordinance; and
WHEREAS, it has further been shown that it would not inconvenience the public or the
citizens of the City to discontinue a portion of the street right-of-way for public
use as described in Section 1 of this Ordinance, subject to the reservation of
an easement 15 feet in width centered over the existing sewer line located
within the vacated right-of-way for the maintenance, repair, location and
relocation of the sanitary sewer facilities now existing or hereafter to be
constructed within said easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue as right-of-way and forever vacate the
following described right-of-way in said City:
The 20 foot wide public alley, south of McCarty Street and north of Miller Street,
between the easterly right-of-way of Monroe street and the westerly right-of-way of
Adams Street, currently known as Handley Way and the 20 foot wide public alley in
the easterly 20 foot of inlot 610 which is from the northerly right-of-way of Miller
Street to the southerly line of said alley known as Handley Way, in the City of
Jefferson, Missouri.
Section 2. A sanitary sewer easement 15 feet in width being centered over the
existing sanitary sewer is hereby retained as a perpetual easement for the construction,
maintenance, repair, relocation and operation of the sanitary sewer, and no new
permanent buildings or structures shall be located within or upon said easement without
the prior written consent of the City.
Section 3. All existing utilities, telecommunications, and cable companies with
facilities existing on the date of this Ordinance within the vacated area described in Section
1 are hereby granted a revocable license to continue the maintenance, repair, and
operation of such facilities in their existing locations.
Section 4. The statutory right of reversion in the owners of the abutting property is
hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor and
the Clerk of the City are hereby authorized to execute all necessary instruments required to
confirm the reversionary rights of the owners of property abutting on the area vacated, as
described in Section 1 of this ordinance, in the right-of-way vacated, subject to the
easement retained in Section 2.
Section 5. This Ordinance shall take effect and be in full force from and after its
passage.
