2. Approval of Minutes:
Commission Meeting November 9, 1984.
Upon a motion by Vice Mayor Hunter and seconded by Commissioner
Armour, the minutes were unanimously approved.
3. Financial Reports, November, 1984.
Manager Gwynn presented the report and gave a summary of the bond
issue cost profile for each of the projects. He also distributed
the Town's audit report and indicated that a representative from
Ernst & Whinney would be present at the January meeting for any
discussion on the report.
4. Presentation of Police Reports.
Chief Greer presented the report for November, 1984 and summarized
the various items listed on the report, which included the removal
of the beached sailboat, a commendation for Sgt. Hatton, the Town's
pet identification program, the deferred compensation program, and
the Mrs. Scherer case.
5. Presentation by the Planning and Zoning Board
(a) P.B. #84 -19 (Ref. 84 -5)
A request by Mr. and Mrs. George Patterson for an
amendment to a previously approved site plan re-
lating to the relocation of the proposed driveway
and the placement of a fence and gate along the
property line on property located at 3268 N. Ocean
Blvd.
Upon presentation of the request by Mr. Mayer, a
motion to approve the amendment was made by Com-
missioner Dixson and seconded by Commissioner
Armour. The Commission unanimously approved the
request.

(b) A recommendation from the Planning Board requesting
the Commission to draft a seawall restoration ordinance.
Mr. Mayer indicated that the Planning Board is considering
the preparation of an ordinance which would deal with the
preservation and /or restoration of sea walls. The proposal
would be reviewed at the next Planning Board meeting with
recommendations to be presented to the Commission shortly
thereafter.
6. Bond Issue Project Report.
(a) Municipal Complex
Mr. Caputo stated that Mr. George Gentile was present to
discuss the current project status.
Mr. Gentile stated that the final plans were completed
and were ready for bidding.
The Commission authorized the necessary advertising and
set bid opening for January 30, 1985, at 2:00 P.M.
Mr. Gentile indicated that the current schedule points
to a March 1, 1985 approximate construction date.
(b) Dredging
Mr. Caputo reported on the rock still existing in canals
E & F, and the seawall situation at the Ross and Francis
properties.
Mr. Arthur Strock was present and discussed the rock
problem in detail. He further stated the following:
- The rock layer was not indicated on the original
profiles. These profiles were completed by
another firm and the current contract was based
on those profiles.
- The contract has been complied with or will be
by the time of certification by the engineer.
- Subsurface mud will show at the base of seawalls
because dredge depths are based on average tidal
elevations. Therefore, a low tide below mean
low tide level will expose a certain amount of
mud.
- Because of too many unknown variables as to the
question of bulkhead stability, the rock in
canals E & F should not be dredged.
Following a lengthy discussion, Vice Mayor Hunter
moved to leave the rock in the canals and that a
thorough final report, including depth profiles, be
submitted by Mr. Strock. This motion was seconded
by Commissioner Pfeifler and passed by the Commission
on a 4 -1 vote with Commissioner Armour dissenting.

(c) Roadway Drainage
Mr. Caputo stated that questions regarding puddling
in driveways were still being received. He asked that
the Commission set policy regarding the matter. After
a brief discussion the Commission determined that the
Town would resolve the swale problem on Cardinal Circle
along with the minor problems existing elsewhere in
Town along the sides of pavement. However, the problem
of water collecting in private driveways would be re-
solved or repaired by the individual residents.
7. SECOND and FINAL reading of Ordinance No. 84 -7. Re: Satellite
antenna revisions.
Upon the reading by Manager Gwynn, a motion to approve by
Commissioner Armour and seconded by Commissioner Dixson, the
Commission unanimously approved the ordinance.
8. Resolution No. 84 -10
A resolution requesting the City of Riviera Beach to withdraw
its pending lawsuit and cease its efforts to block the funding
of a resource recovery in Palm Beach County.
9. Comments and recommendations from Commission members.
There were none.
10. Public requests or comments from the floor.
The Gulf Stream School asked about directional signs and slow/
children signs. The Commission had no objection to the place-
ment of these signs subject to the approval by the Police
Department.
Mr. Scott Tiernan asked about the Town cleaning up the public
beach. The Commission informed him that the portion of the
beach he was referring to is privately owned and the Town
cannot spend public funds on private properties.

There being no further business, the meeting was adjourned at
11:00 A.M.

Upon review of the attached letter from Mr. Schenk concerning the actions
of Sgt. Herbert Hatton, it is with extreme pride that I concur with Mr.
Schenk's suggestion and recommend that a formal commendation be presented
by the Town of Gulf Stream. Sgt. Hatton's knowledge of lifesaving techniques
and his "take- command" presence are public proof of his professional ability
and therefore very deserving of a meritorious award.
I am sure that after reading the attached letter you will all agree with me,
and wish to make it known to the residents of Gulf Stream that their Police
Department consists of such men as Sgt. Hatton - a police officer any Town
would be proud of, as we are.

Dear Mr. Greer:
We, Susan and I are writing you this letter in order to inform
you of the life saving actions that Sargent Herbert Hatton per-
formed on Sunday morning, November 11, 1984.
On that Sunday morning my wife and I were awaken as usual by
our 2'h year old daughter, Angelina at around 8:00 a.m. I had
gotten up first, dressed and went to the family room to lay
back down on the couch. Shortly there after my mother, Betty,
awoke and feed Angie. We are temporarily living with my parents
until our house is completed in Royal Palm Beach. Susan also
awakened, dressed and dressed Angie for the day with the inten-
tions of going shopping that morning. At around 9:00 or shortly
after Angie went outside to play with our dog. She returned
back in the house after a few minutes outside.
Susan at this time pulled the sales adds from the paper and began
looking through them with Betty in the kitchen. In the mean time
I was still laying on the couch in the Family Room. Angie had
again left the house to play with the dog outside. After about
five minutes, Betty decided to check on Angie. She walked out-
side and did not immediately see her, so she proceeded around
the side of the house. At that point she saw Angie floating
face down in the pool. She immediately ran to the pool and re-
moved her. At this point she began to carry Angie around to the
back yard while screaming as loud as she could. It was at this
point that the surrounding neighbors and Susan and I heard her.
Panic had set in. Although Betty has been trained in CPR and
life saving technics it was Susan, also panic striken, who first
began to work on Angie by laying her on the grass and pressing
on her back.to expell water. It was at this time Sargent Hatton

His first obstical was the dog which immediately ran to attack him.
Ignoring the charging dog he proceeded straight for Angie. At
that point of reaching Angie he immediately took control of the
situation by announcing in an authoritative voice, that he was a
police officer and trained for this emergency. His next command
was for someone to restain the dog. As I was approaching from the
house he looked up at me and told me to call for the paramedics.
He also ordered Betty to get a blanket to wrap Angie in.

During this period, Angie's condition was no pulse, her lips
and hands were blue, her face was colorless and felt very cold.
He immediately began CPR and then mouth to mouth resisatation.
After two or three breaths she began to breath. Only a little
water was expelled at this time. Once she was breathing on her
own, she was picked up by Susan and moved to the front yard
where the paramedics were arriving.
There the paramedics took over and began to check Angie. Their
one comment during that time was that the quick response in
getting her to breath again probablly saved her life in the
condition she was in. She was in a state of being hypothermia.
At the hospital her temperature was 92

condition with no visible signs of mental or physical effects
from the near drowning. Susan and I and especially Angie as
well as the family, sincerely thank the life saving techniques
that Sargent Hatton performed. His quick and decisive actions
saved Angie's life. We feel he deserves some type of commendation
for his actions. His moving into the house on Saturday was a
blessing to all of us.

Subject: Storm
On November 22, 1984, as you are aware, a furious storm swept through
Palm Beach County with little or no warning.
This was a holiday weekend and most employees were off duty. Sgt. Herb
Hatton and Town Clerk Barbara Gwynn responded to the Town Hall and implemented
Hurricane Emergency Procedure. All employees of the police department including
the Chief of Police who was away on Holiday, were notified. Two off duty patrol-
men responded to the Town Hall. Barbara Gwynn then notified Clarence Sova who
then called one of his employees and they all responded to the Town Hall.
Barbara Gwynn contacted most of the residence in the low lying areas of the Town
of Gulf Stream and notified them of the severity of the storm and received
a positive response. Sgt. Herb Hatton and the police officers increased
patrol activity and security precautions. Clarence Sova with his assistant
checked out all the Hurrican Preparedness equipment and found some to be in
disrepair. All the equipment was brought up to normal operating condition and
implemented. Also, Public Works employees cleaned trees and debris found in
the road with the assistance of the police department and kept traffic and fire
lanes open.
Throughout this whole emergency situation, all persons involved acted in a
highly professional manner executing and implementing current emergency evacu-
ation procedures, and are a credit and an asset to the Town of Gulf Stream.

FLORIDA, AMENDING ORDINANCE NO. 83 -1 ,
THE ZONING ORDINANCE OF THE TOWN OF
GULF STREAM, SO AS TO PROVIDE FOR CERTAIN
DEFINITIONS OF ANTENNA, ANTENNA STRUCTURE,
BROADCAST RECEIVING ANTENNA, COMMUNICATIONS
ANTENNA, MAST AND SATELLITE TELEVISION
ANTENNA SYSTEM; PROVIDING FOR GENERAL
PROVISIONS AND REGULATIONS RELATING
TO ANTENNAS AND ANTENNA SYSTEMS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, FLORIDA, as follows:
Section 1. Section IV of Ordinance No.83 -1 relating
to definitions is hereby amended by adding the following defini-
tions:
"Antennas
a. Antenna. A device for radiating and /or receiving
television or radio signals.
b. Antenna structure. An antenna consisting of
two or more radiating elements, generally similar
which are arranged in such a manner as to obtain
direction radiation patterns. It includes any
structural members which are necessary to maintain
the proper electrical relationships between
the radiating elements, including the mast
or other structure used to support the array
as a whole, but does not include the transmission
line which supplies energy to or receives energy
from the array as a whole.
C. Broadcast receiving antenna. An outside antenna
used for the reception of signals transmitted
by stations licensed by the Federal Communications
Commission in the Radio Broadcast Services,
including AM, FM and TV.
d. Communications antenna. An outside antenna
used for the transmission of signals by stations
licensed by the Federal Communications Commission
in the several radio services other than the
Radio Broadcast Services, and /or for the reception
of signals transmitted by such stations.
e. Mast. A pole, or a tower, used to support
a broadcast receiving antenna or a communications
antenna and maintain it at the proper elevation.
f. _Satellite television antenna system. A system
of equipment designed to receive satellite
television and radio signals for distribution to
private residences including both single- family
dwellings and multi - family dwellings. Satellite
television antenna system includes the terminology
"Television Dish" or "Television Disc ". Satellite
television antenna system does not apply to
Cable Television Systems which are governed
by separate franchise and Federal regulations."

Section 2. Section X of Ordinance No. 83 -1 relating
to General Provisions is hereby amended by repealing Subsection H
thereof and replacing same in its entirety with Subsection H
set forth below:
"H. Antennas and Antenna Systems /Structures
1. Broadcast receiving antennas or communication
antennas shall be attached to the main building
or structure and shall not extend more than
five (5') feet above the highest portion of
the roof in any zoning district upon site plan
review and approval by the Town Commission
and upon issuance of a building permit by the
Town.
2. Satellite television antenna systems may be
permitted in any zoning district upon site
plan review and approval by the Town Commission
and the issuance of a building permit by the
Town.
3. Satellite television antenna systems shall
not exceed twelve (12') feet in diameter or
width.
4. Satellite television antenna systems shall
be considered as accessory structures and shall
be subject to the applicable site plan review
requirements and regulations of this Zoning
Ordinance.
5. Unless specific approval is granted by the
Town Commission, satellite television antenna
systems shall be ground mounted and located
in such areas as to be screened or buffered
from view from adjacent properties, rights -of -way,
the Intra - Coastal Waterway, and /or the Atlantic
Ocean.
6. There shall not be more than one satellite
television antenna system, broadcast receiving
antenna, or communication antenna per residential
building or condominium association on any
platted lot or parcel.
7. Upon receipt of site plan approval and prior
to the issuance of a building permit for satellite
television antenna, the Town Commission shall
review the installation plans, which plans
must be signed and sealed by a professional
engineer registered in the State of Florida
who shall certify that the proposed satellite
television antenna system is wind resistant
with an ability to withstand winds up to one - hundred
forty (140) miles per hour. The calculations
and said certification by the engineer shall
be submitted along with the plans.
Section 3. If any provision of this Ordinance or
the application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this Ordinance
which can be given effect without the invalid provisions or
applications and to this end the provisions of this Ordinance
are hereby declared severable.

Section 4. This Ordinance shall be codified and
made a part of the official Code of Ordinances of the Town
of Gulf Stream, Florida.
Section 5. This Ordinance shall take effect immediately
upon its passage and approval as provided by law.

A RESOLUTION OF THE TOWN OF GULF STREAM
REQUESTING THE CITY OF RIVIERA BEACH TO
WITHDRAW ITS PENDING LAWSUIT AND CEASE
ITS EFFORTS TO BLOCK THE FUNDING OF
RESOURCE RECOVERY IN PALM BEACH COUNTY;
REQUESTING THE CITY OF RIVIERA BEACH TO
LIMIT ITS LEGAL ACTIONS TO THOSE DIRECTLY
RELATED TO THE DISPUTE OVER SITE SELECTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Town of Gulf Stream has
determined that the financing of a Resource Recovery project
for Palm Beach County is in the public interest; and
WHEREAS, the City of Riviera Beach has filed
suite to prevent the bond sale to provide the financing for
resource recovery, which said lawsuit could jeopardize the -
entire project:
WHEREAS, the proposed bond issue for resource
recovery contains no funds for any other purpose such as site
selection or land purchases; and
WHEREAS, if the City of Riviera Beach should be
successful in blocking the financing of resource recovery for
Palm Beach County, the result will be continued landfilling
for an extended time period and possibly the elimination of
Resource Recovery in Palm Beach County as an alternative method
of solid waste disposal.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF
GULF STREAM, that:
Section 1. The Town of Gulf Stream hereby
requests the City of Riviera Beach to withdraw its pending
lawsuit and cease it efforts to block the funding of Resource
Recovery in Palm Beach County.
Section 2. The Town of Gulf Stream hereby
requests the City of Riviera Beach to limit its legal actions
to those directly related to the dispute over site selection,
such as environmental permits and zoning.
Section 3. This Resolution take effect immediately
upon its passage.
