2. Approval of Minutes: May 10, 1985.
Upon a motion by Mr. Dixson and second by Mr. Armour, the minutes were
approved as submitted.
3. Staff Report.
a. Financial Report.
Mr. Gwynn presented the report and indicated that for this time of the year,
budgetary revenues and expenditures are in line.
Upon a motion by Mr. Hunter and second by Mr. Armour, the financial report
was unanimously accepted.
b. Police Report.
Chief Greer presented the report and indicated that there had been no
significant problems.
Mr. Armour asked to have a representative of the Florida Marine Patrol
present as soon as possible to discuss the boat traffic problem.
Mr. Hunter suggested that the Town seek the assistance from the Coast
Guard Auxillary and U.S. Power Squadron.
After a brief discussion and upon a motion by Mr. Armour and second by Mr.
Hunter, the Commission unanimously accepted the Police Report.

c. Manager's Report.
Mr. Gwynn read a letter from Palm Beach County regarding road capital
improvement funds and the interlocal gas tax agreement.
Following a brief discussion and upon a motion by Mr. Armour and second
by Mr. Dixson, the Commission unanimously approved the agreement.
Mr. Gwynn mentioned the schedule for upcoming budget meeting. The prelim-
inary meeting has been set for June 24, 1985 at 3:00 P.M. and the Public
hearings set for 5:01 P.M. on September 3 and September 10, 1985.
d. Bond Issue Project Report.
Mr. Randolph introduced Mr. Gary Ward, Engineer, and indicated that they
would meet with Murphy Construction to resolve the problems which remain
with the dredging project.
e. Town Attorney Report.
Mr. Randolph indicated that he had presented his report in the discussion
of previous agenda items.
4. Planning & Zoning Board Report.

A request by Mrs. Cecile M. Merritt for site plan review for the construction

Mr. Mayer presented the Planning & Zoning Board Report and indicated that the
Board had recommended approval of the request.
Following a brief discussion and upon a motion by Mr. Armour and second by Mr.
Hunter, the Commission unanimously approved the request.
5. Commissioner Comments /Recommendations.
Several beachfront residents were present to discuss their opposition to the
Town Ordinance which prohibits dogs on the beach.

Following considerable discussion the Commission agreed to abolish the dog
ordinance and instructed Mr. Randolph to rewrite all the ordinances dealing
with animals.
Mr. Gwynn read a letter from Mr. Malmstrom regarding burglaries in Place
Au Soleil. The matter was referred to the Police Department for review.
7. Adjournment.
There being no further business, the meeting was adjourned at 10:30 A.M.

To The Town Council,
I am a resident of Gulfstream, Florida and am concerned
about the ordinance making it illegal to walk your pet on the
beach. I, for one, am against this ordinance. I think that the
ocean residents should be able to walk there pets on the
beach with leashes as they have been in the past. There are
residents who have lived here longer than this ordinance who
have been walking there pets for years without any trouble at
all.
It is a privledge to live in this fine town and I think
there are better ways to spend the police forces time ,which
will ensure our residents safety than patroling the beach for
violations of this law. I believe owners of pets are
responsible for there pets actions and should be under their
control. This is accomplished by the leach law.
I am in favor of recending this ordinance.

Dear Mayor Koch:
I am writing this letter to protest vehemently regarding
your ordinance prohibiting dogs on the beach. It is my under-
standing that you are currently considering a leash law in place
of a restriction in allowing domestic animals on the beach.
Many of us have animals for either protection, security, or
just outright playmates for our small children. The inability
to allow these animals on the beach to play with the children
due to the nagging complaints of a minority of the residents of
this Town is both annoying and outrageous.
Although I have been a resident for over three years, you
have not once heard from me regarding the Town's management
philosophy as it relates to me and the other residents. However,
at this time I must tell you that this ordinance creates a
sense of outrage, and I urge you to correct it before it becomes
a major, contended issue in the not - too - distant future.
I am sure a leashing requirement would more than satisfy
an underlying concern for the safety of those residents that do
not care for dogs or other animals and will allow those of us
with dogs the freedom to both enjoy our pets and comply with a
more reasonable limitation on their whereabouts.

INTERLOCAL AGREEMENT
WHEREAS, Chapter 336.025, Florida Statutes was enacted by the Florida
Legislature and took effect on March 14, 1983; and
WHEREAS, said statute authorizes a 1, 2, 3 or 4 cent local option gas
tax to be levied upon the sale of motor fuel and special fuel within the
county; and
WHEREAS, said statute in Section 3(a)1 contemplates an interlocal
agreement by and between Palm Beach County and the municipalities located
therein to establish a distribution formula for dividing the proceeds of said
tax among county government and all eligible municipalities within the
County; and
WHEREAS, representatives of Palm Beach County and the various
municipalities have met and negotiated mutually acceptable terms and
conditions for said interlocal agreement which are set forth herein; and
WHEREAS, this agreement must be approved and executed not later than
July 15, 1984.
NOW, THEREFORE, IT IS HEREBY AGREED on this f day of, 1984,
by and between PALM BEACH COUNTY, hereinafter referred to as "COUNTY" and THE
TOWN OF GULF STREAM, hereinafter referred to as "THE MUNICIPALITY" for and in
consideration of the mutual covenants contained here that:
I. This agreement is entered into with the specific contemplation
that the Board of County Commissioners of Palm Beach County will enact an
appropriate ordinance to levy a four cent local option gas tax within Palm
Beach County, with said tax being imposed effective on September 1, 1984 and
to remain in effect for a period not to exceed ten (10) years from said date.
In the event the Board of County Commissioners of Palm Beach County fails or
refuses to enact said ordinance, this agreement shall be null and void.
2. The term of this agreement shall be for the period of duration

of the ordinance identified in paragraph 1 hereof. Upon expiration of the
period of said tax provided for in said ordinance, this agreement shall
terminate except that if the Board of County Commissioners reimposes said tax
as provided in Section 1(b) of said statute, this agreement may be renewed as
provided therein.
3. All proceeds of the tax collected pursuant to said statute shall
be divided between Palm Beach County and the cities as follows:
A. The COUNTY shall receive two - thirds (2/3) of all sums
collected.
B. The cities collectively shall receive one -third (1/3)
of all sums collected.
All money shall be collected and distributed to the respective
parties as provided in Chapter 336.025(2), Florida Statutes.
4. Each MUNICIPALITY eligible to participate in the distribution of
the proceeds of said tax shall receive a pro rata share of the aforecited 1/3
MUNICIPALITY share pursuant to a formula that will be based 70% on lane
miles, located within a MUNICIPALITY for which the MUNICIPALITY is
responsible for maintenance and 30% upon the population of the MUNICIPALITY
based upon the most recent University of Florida Population Estimate. Said
formula is:
30% x (city population) + 70% x (city lane miles) = Local Distribution
(sum of city population) (sum of city lane miles)
Exhibit "A" attached hereto and incorporated herein by reference
identified each eligible MUNICIPALITY'S pro rata share of the MUNICIPALITIES
1/3 share. Said distribution may be amended not more than once annually by
the MUNICIPALITIES preparing a new Exhibit "A ", based upon changes in the
foregoing criteria, and submitting same to the County Attorney who shall in
turn transmit same to the Department of Revenue.
5• This is one of several interlocal agreements between the COUNTY
ki
and various MUNICIPALITIES providing the same terms for the division and
distribution of the proceeds of the gas tax. All such agreements shall be
deemed as one agreement (the Interlocal Agreement) for the purposes of
paragraph (3) (a)1 of Section 336.025, Florida Statutes, and the Interlocal
Agreement constitutes an interlocal agreement between PALM BEACH COUNTY and
MUNICIPALITIES located therein representing a majority of the incorporated
area population within Palm Beach County.
6. This agreement may be modified or amended only by a written
agreement executed by all parties hereto. The foregoing terms and conditions
constitute the entire agreement between the parties hereto and any
representations not contained herein shall be null and void and of no force
or effect.
7. This agreement may be executed in counterparts and each fully
executed counterpart shall be deemed an original instrument.
WHEREFORE the parties hereto have hereunder set forth their hands and
seals on the date first above written.

Dear Mayor Koch:
As President of The Somerset of Gulfstream, Inc., I represent
24 families, all of whom are complaining about conditions on
the beach in the Town of Gulfstream. The flotsam and jetsam
and the enormous amountof seaweed left on the beach has taken
away from its beauty. The owners feel that what should be a
beautiful view for them is ruined by the uncleaned beach. They
feel that since they have to pay part of canal dredging that
they'll never use, that the town should be responsible for
keeping the beach in a clean and acceptable manner. The citizens
that do not live on the ocean use the beaches for their enjoyment.
The towns to our South and most of the towns to our immediate
North do the clean up as a local government obligation. We
strongly advise that money be allocated in the future for the
cleaning of our beautiful beach in a town which prides itself
on its affluent community.

2. Consideration of Telephone System for Municipal Complex.
Mr. Caputo presented the information from the various companies that submitted
proposals as well as the recommendation of the communication consultant.
Following a brief discussion and based upon the recommendation of staff and
the consultant, the Commission unanimously approved the proposal from
Executone of South Florida and directed staff to move ahead with contractual
arrangements.
3. Discussion of Palm Beach County Beaches and Shores Council.
Mr. Gwynn presented a letter regarding the Town's membership on the newly
formed Council.
Following a brief discussion and upon a motion by Mr. Pfeifler and second by
Mr. Hunter, the Commission unanimously approved membership on the Council
subject to Mr. Randolph's review of the County's correspondence and member-
ship agreement.
4. Status of Canal Dredging.
Mr. Caputo deferred comment to Mr. Randolph.
Mr. Randolph reported on the meeting held in his office and will continue to
work with Mr. Caputo toward the resolution of the dredging activity.

5. Review of Proposal FY 85 -86 Budget.
Mr. Gwynn and Chief Greer presented their respective portions of the
proposed budget. There was considerable discussion regarding the
expansion of staff in the Police Department. Consideration was given
to the beach cleaning project as a budget item.
After further discussion, the proposed budget was placed on the
September 3, and September 10, 1985 Public Hearing agendas for further
review.
6. Adjournment.
There being no further business, the meeting was adjourned at 5:30 P.M.

RESOLUTION NO. 85 -2
A RESOLUTION OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, EXPRESSING THE DESIRE OF THE TOWN
COMMISSION TO ENTER INTO THE INTERLOCAL
AGREEMENT RELATING TO PALM BEACH COUNTYWIDE
BEACHES AND SHORES COUNCIL AND TO HAVE A
REPRESENTATIVE OF THE TOWN OF GULF STREAM
APPOINTED TO SAID COUNCIL.
WHEREAS, the Town Commission of the Town of Gulf Stream
recognizes the need for coordinated protection, preservation
and /or enhancement of the beaches and shores along the Atlantic
Ocean in Palm Beach County; and
WHEREAS, the Town Commissioi is in favor of establishing
a council to be a forum for information exchange and cooperative
effort to assist in fulfilling the interest of beach and shore
protection, preservation and /or enhancement; and
WHEREAS, Palm Beach County has proposed an interlocal
agreement to establish a Palm Beach Countywide Beaches and Shores
Council; and
WHEREAS, the Town of Gulf Stream desires to be represented
on said council;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. The Town Commission hereby goes on record
as being in favor of a Palm Beach Countywide Beaches and Shores
Council and its desire to enter into an interlocal agreement
to effectuate same.
Section 2. The Town Commission desires to be a participant
on the above- referenced council and its endorsement of said
council is conditioned upon the Town of Gulf Stream having represen-
tation thereon.
Section 3. The Town Commission hereby adopts by reference
the terms of the interlocal agreement attached hereto.
Section 4. The Town Manager of the Town of Gulf Stream
is hereby authorized to execute the interlocal agreement to
effectuate the above - referenced purposes.

to the Palm Beach County Commission.
