MINNEAPOLIS 26, MINNESOTA WEst 9-0477 October 1, 1959 Mr. Kenneth Fortin Chairman of Planning Commission Medina, Minnesota Sewerage Swimming Pools Drainage Dear Ken: As perhaps you noted in the newspaper, a special hearing was held at the Capitol Friday, September 25, to consider the major sanitary problem that is developing in the Twin Cities area. Indications are that major preventive measures must be taken to avoid pollution of water supply wells in this region. At the conference, the Board of Health made available mater- ial that might be included in the municipal well ordinances. Attached is a copy of this provision. You will note that a copy of this letter along with the at- tachment is being sent to Mr. Al Tesch and Mr. Alex Schumacher in order that your Planning Omission might discuss this matter at your next meeting. If there is any question, please call me in the next few days at your convenience. With my present schedule, I will be away from the office for a few days starting October 8, and in the mean time I want to assemble anything you may need for your meeting on Monday, October 19. MINNEAPOLIS 26, MINNE.SOTA WEst 9-0477 September 30, 1959 Mr. Kenneth Fortin Chairman of Planning Commission Medina, Minnesota Sewerage Swimming Pools Drainage Dear Ken: When we were last together you asked me regarding the hand- ling of requirements for the rezoning of an area in the Village of Medina for present zoning restrictions. A study of this mat- ter reveals that on page Z-35 of the Zoning Code, the Village Council shall require a report from the Planning Commission on any proposed amendments before the Council take action on the suggested rezoning. The Planning Commission shall make a ten- tative report, and it shall also hold a public hearing before submitting its report to the Village, Council. The procedure just outlined is set forth in Section 30, which reads as follows: Report by Planning Commission - Public Hearing: The Village Council shall require a repost from the planning commission on any proposed amendment before taking final action thereon. The planning commission shall thereupon make a tentative repoAtt and shall hold a public hearing thereon with notice the same as required for the public hearing by the Village Council, before submitting its final report. Such final report shall be submitted with- in sixty (60) days after the time of referral of the proposed amendment to it, unless the board agrees to an extension of time. It is to b n ted furthermore that action by the Village Council may a public hearing. This procedure is out- lined in subsection b at the top of page Z-36 which reads as follows: Action by the Village Council - Public Hearing: After receipt of the required final report from the plannin commission on a proposed amendment, or, after sixty (60) days after the time of referral of the amendment to the commission, in the event no such report is received, the Village Council shall hold a public hearing, after which 2 the proposed amendment may be passed or disaproved. Not less than ten (10) dayst notice of the time and place of the public hearing shall -fist be carried in a news- paper published in Hennepin County. Parties at interest, citizens or their agents, shall be given an opportunity to be heard. A two-thirds (2/3) vote of all the mem- bers of the Council shall be required for passage of an amendment. We also discussed the procedure fo�lowed in Minnetonka Vil- lage. In discussing the Minnetonka method today with Clerk Thimsen, he reported that the Planning Conmission advertises a public hearing and after this is held, reports to the Council which then takes up the matter at an open meeting. Any citizen interested in the matter is free to check• with the Village Clerk as to when the rezoning question will be considered by the Council, and may appear before that body to talk on the question. The Minnetonka Council does not advertise in its official news- paper as to when the rezoning matter will be considered, but this usually follows shortly after the Planning Commission has reported to the Council. In Eden Prairie Township, where we are working closely wit_1 the Planning Commission and with the Town Board, the method of rezoning includes the hearing procedure, and is identical with that in the Medina zoning code.
