PRESENT: ANNE HEIDEMAN, SUSIE MACKAY, CHRIS CROSBY, FRANK
MIGNONE,CAROLYN SMITH, BOB BRADLEY AND BRUCE WORKMAN.
ALSO PRESENT; PLANNING AND ZONING ADMINISTRATOR AND
PLANNING AND ZONING ASSISTANT SANDIE LARSON.
ABSENT: PENNY ELSENPETER AND DECKER VELIE
Vice -chairperson, Anne Heideman called the meeting to order at 7:32 p.m.
1. MINUTES OF SEPTEMBER 11, 1996
MOVED BY FRANK MIGNONE AND SECONDED BY BRUCE WORKMAN TO
APPROVE THE MINUTES AS PRESENTED.
MOTION PASSED.
2. BRUCE TURNER - 732 HIGHWAY #55 - CONDITIONAL USE PERMIT FOR
LIQUOR STORE/FAST FOOD TAKE-OUT - PUBLIC HEARING - 7:33 P.M.
Loren Kohnen read his memo to the planning commission and mentioned that no rear
yard set -back variance was necessary. He also talked of the added green space on the
east property line, the driveway on the west side of Subway would be closed.
Dave Smith, owner of the Dairy Queen at 752 Highway #55, asked if the road in front of
Subway would be re -built and Loren said yes.
Carolyn Smith asked who would pay for that and Loren said the applicant or the
landowner would.
Bruce Turner said that he now has 517 square feet in his liquor store and 220 square
feet of that is the walk-in cooler, so that it is a very cramped store.
Bruce Workman asked about the fast food.
B. Turner said that he had an agreement with SunBoats of Minnetonka, VFW of
Plymouth, etc to supply them with beverages at outings. He said he would like to have
other things to go with it.
Anne Heideman asked if he would have a franchise.
B. Turner said no.
B. Workman asked if it would be all take-out. He also questioned the traffic.
B. Turner said yes, it would be all take-out. He said he was geared toward deliveries
and figured that the average customer is in the liquor store for 10 minutes and he

wanted to add additional convenience. He was also asked if there would be a full
kitchen and Bruce said whatever is required by the health department would be done.
Frank Mignone wanted it confirmed that he was talking two businesses in the building,
liquor store and take-out/catering.
B. Workman said that the planning commissions job was to make sure that a project is
good for all around.
L. Kohnen said that there is enough parking for the business proposed, but not for sit-
down.
B. Turner said that he is not interested in having any sit-down.
C. Smith said that she has a problem with the traffic on all the little roads and maybe an
exit out the back way like we did with the Mobile station should be looked at and we
should deal with that before we do anything else.
D. Smith asked about the building being two story.
L. Kohnen said that building will look like a tall one story.
B. Turner said that he needs a count room/dry storage area and that this 2nd story is
basically a loft area.
L. Kohnen said that we need to see what the building will look like from the front, etc.
A. Heideman said that her major concern is the wetland issue and she sees a lot if it
being covered up in this plan and isn't there a 2:1 mitigation.
L. Kohnen said that he can file for an exemption and that the law provides for this. He
said this would be similar to what Hennepin County went thru and that all the steps have
be gone thru before anything is approved.
D. Smith said that he has talked to the applicant and that Bruce had said that maybe a
video store but had said nothing about fast food. He said that he had concerns about
the traffic and that there is traffic that comes into the Dairy Queen at 52 MPH and that
practical experience says that this road/traffic plan will not work. He said that his
drainage is another concern and that the MnDot culvert is maintained.
C. Smith asked about a shared driveway with the Dairy Queen.
Bob Bradley asked if MnDot would have anything to do with it.
L. Kohnen said yes, that MnDot had worked with Randy and that our engineers, city
staff and MnDot would work together and that nothing will be done with this property
until all have approved a plan.
B. Bradley asked what we should do so that Mr. Turner could continue.

L. Kohnen said that it could go to the city council for their decision or it could come back
to the planning commission after some more work.
C. Smith said that it seems like a lot has not been completed.
L.Kohnen said the biggest item is that we have not heard from MnDot.
D. Smith asked what the elevation of the building was for the catch basin. ?
A. Heideman said what we need is a more extensive plan showing traffic flow with the
three businesses and the highway.
D. Smith asked if Subway customers would be stepping out onto the road and Loren
said pretty close.
C. Smith said that we need a better plan showing all the buildings, drainage elevation,
traffic patterns and agreement among the property owners. She said it would help to
see the entire corner.
Chris Crosby said refer to Shawn's letter concerning the road, access, etc. We are
trying to be constructive and helpful with this. MnDot is going to have to look at this
before much else can be done.
Randy Mayer, 762 Highway #55, said that if Mr. Turner chooses to go to MnDot for a
group closure , he is not ready to deal with that. He said it will be very expensive for the
taxpayers if they close his access and MnDot loves to close accesses and if road takes
place, can Dave (Dairy Queen) afford to lose some parking, what happens when an 18
wheeler decides to stop at Subway - the road is blocked. He wanted to know if soil
borings had been done and Loren said yes. Randy said that Mr. Turner can do
whatever he wants, but he does not need MnDot coming back.
B. Workman said if MnDot wants to do a road, probably Subway and Dairy Queen will
be gone.
C. Crosby said that he appreciates the comments about MnDot not coming back, but
MnDot need to address this.
R. Mayer asked if Subway met the 60/40 hardcover and Loren said yes.
B. Workman said this is a marginal piece of property.
C. Smith said that it seems that Subway and the liquor store do not have adequate
parking - could there be some kind of shared parking.
B. Turner said that he was told he could not do that because of the 60/40 hardcover.
C. Smith said that we are dealing with 2 not very good lots and if the 2 lots worked
together - -
L. Kohnen said they would have to be combined.

B. Bradley wanted to know if the applicant had asked for any variances.
C. Smith asked if Mr. Turner had gotten any input from his neighbors and that there
might be a better solution to help and be a better solution for all.
L. Kohnen said that MnDot might say that Subway and the new lot should share access.
R. Mayer asked if there was a storm water holding pond.
C. Crosby said that is one of the questions that need answering and that the Elm Creek
Watershed controls the property.
A. Heideman said perhaps we could deal with Mr. Turner's request.
Things that need to be provided:
1. Site plan to be provided that included proposed building, Subway building and Dairy

2. Detailed answers with information on signs, all signs to be to code
3. Wetlands delineated
4. Apply for & receive an exemption to fill any wetlands on this property
5. Concerns by neighboring property owners to be worked out to their satisfaction with
verification submitted to the city
6. Nine -hundred square feet of additional green space needed - no green space may
be removed from the Anderson property to the east
7. Parking arrangement be submitted to staff
8. Grading and drainage plans be submitted to Elm Creek Watershed for review and
approval
9. All utility fees and changes be paid as outlined in city engineers letter
10. Drainage & utility easements be provided as requested by city engineer
11. MnDot to review, comment and approve proposal
12. No garbage containers permitted outside the building unless totally enclosed with
enclosure built of materials similar to principal structure
13.All lighting to be downcast
14. No parking against front of building- provide sidewalk & curb
15. Frontage road and parking built to MnDot & City of Medina specifications -
maintenance & snowplowing by property owner
16.Total number of SAC units to be determined and paid for before any construction
Carolyn Smith wanted to know if existing road was used if MnDot approval was needed.
L. Kohnen said that MnDot has to approve the drainage also.
There was continued discussion of MnDot and it was said that no matter who develops
this property, MnDot would get involved.
B. Workman said that in general this was a tough site and he understood what Mr.
Turner wanted to do, but he really needs to check with MnDot.
Mr. Turner was asked if he wished his application to be tabled or denied and he asked
that it was tabled.

MOVED BY CAROLYN SMITH AND SECONDED BY BRUCE WORKMAN TO TABLE
THE BRUCE TURNER APPLICATION UNTIL FURTHER NOTICE FROM THE
APPLICANT.
MOTION PASSED.
Adjoining property owners will be notified when this is back on the agenda.
3. FLOODPLAIN ORDINANCE - PUBLIC HEARING - 8:34 P.M.
Anne Heideman said that as one who had gone thru the proposed ordinance did not
see any glaring objections.
Carolyn Smith questioned on page 5, Subd. 40 and it was explained that it was the
definition of a Floodplain.
Chris Crosby said that this all pertains to areas determined to be covered by this and
wanted to know if we were creating any non -complying parcels or homes and Loren
said no.
MOVED BY BOB BRADLEY AND SECONDED BY FRANK MIGNONE TO
RECOMMEND APPROVAL OF THE FLOODPLAIN ORDINANCE AS PRESENTED.
MOTION PASSED.
MOVED BY FRANK MIGNONE AND SECONDED BY SUSIE MACKAY TO ADJOURN.
MOTION PASSED.
