HomeMy Public PortalAbout10-08-2002DRAFT PLANNING COMMISSION MINUTES - OCTOBER 8, 2002 PRESENT: RON JOHNSON, RANDY BRINKMAN, ELIZABETH WEIR, LENNY LEUER, MARY VERBICK, BILL LOE, SHARON JOHNSON AND DICK PICARD. ALSO PRESENT: PLANNING AND ZONING ADMINISTRATOR LOREN KOHNEN, CITY ENGINEER TOM KELLOGG AND PLANNING AND ZONING ASSISTANT SANDIE LARSON ABSENT: JERRY BROST Chairperson Elizabeth Weir called the meeting to order at 7:03 p.m. 1. CHRISTOPHER DAHL - 2662 HAMEL ROAD - SUBDIVISION OF 1 LOT TO 2 LOTS - PUBLIC HEARING Loren Kohnen read his memo to the planning commission and put up overheads. He explained the slight change in the acreage for each of the proposed lots and showed the change on an overhead. He explained that Hennepin County must review this plat and that Jim Dillman the public works director had no problem with the driveway plan. There must be easements to both the south parcel and the new Lot 2, from Lot 1 for driveways. There was discussion of whether a private road agreement was necessary with 3 lots - staff will check. Christopher Dahl said the change was made in the lots to save some trees. He said they have the intention to build on the back lot and sell the other or maybe sell the back lot. Lenny Leuer asked about the current barn and noted that is just met the 150' setback. He wanted the applicant to be aware that there probably could not be an addition to the barn on the west side without variances. Lenny also wanted to know if there were animals in the barn now. C. Dahl said yes, some pheasants. L. Leuer wanted to know if there were plans for horses and C. Dahl said no. Lenny also said that the applicant should be aware of setbacks if they thought of a barn on Lot 2. MOVED BY LENNY LEUER AND SECONDED BY RANDY BRINKMAN TO RECOMMEND APPROVAL OF THE PRELIMINARY PLAT FOR CHRISTOPHER DAHL AT 2662 HAMEL ROAD TO DIVIDE THE NORTHERN LOT INTO 2 LOTS WITH THE FOLLOWING CONDITIONS: 1. The south parcel and Lot 2 must gain access via an easement over the flag portion of Lot 1 2. The location and construction of the driveway to be approved by the Public Works Director 3. All drainage and utility easement per city engineer 4. When a home is built on Lot 1, the use of the apartment must not continue MOTION PASSED. Planning Commission Minutes October 8, 2002 1 DRAFT 2. WARA REAL ESTATE - COUNTY ROAD 116/MEANDER ROAD - PLAT 4 LOTS TO 1 LOT AND 3 OUTLOTS - REZONE BP TO BP-PUD AND SITE PLAN REVIEW FOR OFFICE BUILDINGS - PUBLIC HEARING Loren Kohnen read his memo to the planning commission and went over the comments from city attorney Ron Batty. Loren put up overheads of the site. He talked of the additional landscaping needed, Meander Road construction, etc. He pointed out where the sewer easements was on the overhead. Tom Kellogg, city engineer, said that the location of the sewer easement will be verified. He said that the preliminary plat must be submitted to Hennepin County for review. He said the 30 day clock has not started yet, since the county has not received the plat. L. Kohnen said that extending the sewer line to 116 is a question. Elizabeth Weir asked why the applicant would be responsible for this. T. Kellogg said this is the opportunity to bring the sewer line to the east side of 116 and the city shares the cost and this would be also be for future development of the western part of the Rolling Green Country Club property (east side of 116). L. Kohnen put up overheads: 1 - possible building on Lot 34; 2 - view from NW (Foxberry); 3 - another building view and 4 - close up of building. There was discussion of the mezzanine in some of the units. L. Kohnen said that the entire building would be sprinkled including the attic spaces. Randy Brinkman asked when the fire chief would look at this plan. L. Kohnen said he will send it now. He said the buildings are separated by about 21' and code requires 10'. R. Brinkman asked about shingles. Todd Mohegan said asphalt. Sharon Johnson asked why the building on Lot 34 would not be done now. T. Mohegan said they are still working on the concept for it. They want to try and figure out the market use for the corner lot. REZONING and 4 LOTS TO 1 LOT AND 3 OUTLOTS Lenny Leuer said with the easement for Meander Road 2 of the outlots would be loess than 10 acres and wondered if a park fee would be due. Planning Commission Minutes October 8, 2002 2 DRAFT L. Kohnen said they would catch them when the outlots are re -platted. Sharon Johnson asked why they were outlots. L. Kohnen said since they are not being developed, they have a lesser value (taxes) and there would be not park fees. Lenny Leuer asked if there had been discussion with the Juberts. L. Kohnen said that staff has discussed this - move the road to the south to give Jubert more property next to residential - flexibility for Jubert's and Wara. Tom Kellogg said it would be a platted road easement to the west line. There was discussion of grading of Meander Road to the west. L. Kohnen said the material would be used for some wetlant mitigation. L. Leuer asked about the dirt balance. , Wara, said there is flexibility on the site. He said they were expecting some poor soils. , Wara, said there should be some discussion of dirt work, top soil, pond, etc. and the connection to the NURP pond to the south. L. Leuer showed the contour lines on an overhead. He talked of connection to the NURP pond. , said their pond stands alone. R. Brinkman asked if all the soil from 55/Willow was taken care of. , said maybe they could use some. He was told to call Jim Dillman. MOVED BY RANDY BRINKMAN AND SECONDED BY MARY VERBICK TO RECOMMEND PRELIMINARY APPROVAL OF PLATTING TO 1 LOT AND 3 OULOTS WITH THE FOLLOWING CONDITIONS: 1 Hennepin County Planning to review and comment before this proposal goes to the city council for preliminary approval. 2. Comments to be received from Elm Creek Watershed before this proposal goes to the city council. 3. All requirements and conditions of the city engineer including all drainage and utility easements. 4. Meander Road built to a 9 ton standard for 341.18' and graded to the west side of the wetland in the middle of the proposal. Planning Commission Minutes October 8, 2002 3 DRAFT 5. A continuation of a trail must be provided for the east side of the entire parcel. This trail must be graded by the applicants. 6. Easements provided over wetlands, drainage ways and ponding areas. The following two conditions to be discussed by the city council: 1. A sewer line be extended to the east side of County Road 116, the location to be determined by the Public Works Director and city engineer. 2. A sanitary sewer line and water line be extended to the west side of the wetlands in conjunction with the grading of Meander Road. MOTION PASSED RE -ZONING BP TO BP-PUD Mary Verbick asked if there was any reason not to do this and Liz said no. Dick Picard asked about the building height. Loren Kohnen said the height is measured mid point - 40' is to the peak. He said the height shown meets our ordinance. D. Picard questioned the set -backs, wetlands. L. Kohnen said the set -backs are different in PUD's - the setbacks are set in the PUD. Richard Revering, applicants engineer, said that the building itself is 100' or so. There was discussion of putting 50' setbacks in the PUD. R. Revering said that the county has asked for an additional 10', so we might have to shift the development in 10' or so. We are still well away from the wetland - 90' or so. He said that they will meet the watershed requirements. There was discussion of maximum sanitary sewer usage. MOVED BY RANDY BRINKMAN AND SECONDED BY MARY VERBICK TO RECOMMEND APPROVAL OF THE RE -ZONING FROM BUSINESS PARK TO BUSINESS PARK-PUD WITH THE FOLLOWING CONDITIONS: 1. Site and hydrant locations be reviewed by the Hamel Fire Chief. 2. Any requirements of the Elm Creek Watershed 3. Any conditions of Hennepin County Planning 4. All lighting fixtures onsite and on the buildings must be downcast type with all sides enclosed except the bottom, with the globe or lens not visible. 5. Light standards in parking areas or on building be a maximum of 20' in height. 6. Additional landscaping areas be provided in 4 areas of the parking lot; on Co. Rd. 116, buildings 28-33; 22-27 and 8-12. Planning Commission Minutes October 8, 2002 4 DRAFT 7. Berms adjacent to Meander Road be provided with 8' spruce trees 20' o.c. for additional screening 8. All conditions of city engineer 9. A landscaped berm must be placed on the south side of Lot 34 to run the length of the lot east and west to block the view into loading areas between the buildings to the south. 10. Lot 34 must be completely landscaped, trees, grass, shrubbery and maintained as a park type area to be used by the association. 11. Park fees due on all lots in block 1 before building permits are issued. Amount to be determined. 12. Each business will need an Administrative Conditional Use Permit. Lenny Leuer asked the applicant if they were o.k. with the height of the light standards and the additional spruce trees. Todd Mohegan said yes. MOTION PASSED. 3. MINUTES OF AUGUST 13, 2002 MOVED BY LENNY LEUER AND SECONDED BY RANDY BRINKMAN TO APPROVE THE MINUTES AS PRESENTED. MOTION PASSED. 4. MINUTES OF SEPTEMBER 11, 2002 There were a few minor corrections. MOVED BY MARY VERBICK AND SECONDED BY RANDY BRINKMAN TO APPROVE THE MINUTES AS CORRECTED. MOTION PASSED 5. ADJOURNMENT MOVED BY RON JOHNSON AND SECONDED BY SHARON JOHNSON TO ADJOURN. MOTION APPROVED.
