CITY OF TEMPLE CITY
' CITY COUNCIL
MINUTES
January 18, 1972
INITIATION:
1. The regular meeting of the City. Council was called to order at
7:40 p.m. by Mayor Gilbertson.
2. The invocation was given by Father Stephen Blaire, St. Lukes
Catholic Church, 9451 Broadway, Temple City.
3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson
4. ROLL CALL:
PRESENT: Councilmen- Briggs, Harker, Merritt, Tyrell, Gilbertson
ABSENT: Councilmen -None
ALSO PRESENT: City. Manager Koski, Assistant City, Attorney
Lieberman, Parks & Recreation Di rector Kobett,

Mr, Bob Gordon, Big Chief of Long House, Temple City YMCA Indian
Guides presented six pinewood derby racers to the care of. the Council &
C i ty Msriage5 for the forthcoming Pinewood Derby Race to be held on
Saturday, January 29 , 1972, at 9 a.m. at the Oak Avenue School.
It was moved by. Councilman Merritt, seconded by Councilman Briggs
and unanimously carried to adopt Resolution No. 72 -1170 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
COMMENDING THE TEMPLE CITY Y.M.C.A. INDIAN. GUIDES FOR OUTSTANDING
PERFORMANCE, and proclaiming. January 23 -29, 1972, as Indian Guide
Week and January 29, 1972, as Pinewood Derby Day.
At this point Mayor Gilbertson. recognized Charles Harrington, President
of the Temple City Jaycees, and asked him to present some of the ideals
and goals of the Jaycees. Mayor Gilbertson then presented Mr. Harrington
with a certificate of appreciation in recognition of the services rendered:
to the community by this organization.
Mayor Gilbertson recognized Parks and •Recreat.ion Director Vic Kobett
recipient of the Meritorious Award from the Cal 'i:f.:Pa:r.k,:i.Recreation
Society, District XIII. This award had been presented last ins:
.1963.
5. APPROVAL OF MINUTES:
It was moved by Councilman Briggs, seconded by Councilman
Merritt and carried to approve the minutes of the January. 4,
1972, Council meeting as written. Mayor Gilbertson abstained
from voting.
UNFINISHED BUSINESS:
PUBLIC HEARING - 7:30 p.m. Re. Amendment to Municipal Code -
Undergrounding of Utilities.
City Manager Koski presented Planning Commision recommendation
regarding undergrounding of utilities as outlined in
memorandum dated January. 13, 1972, which had been set for
='ub 1 ti. ; Hearing by the Council at the January 4, 1972 meeting and
for which due notice had been given.
Mayor Gilbertson declared the Public Hearing open, and invited
those present who wished to speak on the matter to come forward.
No one spoke in favor.

Mr. Bob Hill, Cooper Realty, El Monte, spoke against the Planning
Commission Resolution No. 71`- 442PC, stating that usually under-
grounding was restricted to new construction and apartment com-
plexes.
Councilman Tyrell moved to close the Public Hearing, seconded by
Councilman Briggs and unanimously carried.
Following discussion Councilman Tyrell moved to refer the matter
of proposed undergrounding of utilities back to the Planning
Commission to evaluate the application of the following items in
making a final determination on the proposed amendment to the Temple
City Municipal Code: •a) the City Attorney: to investigate the legal
position of the City in providing partial financial assistance to
private property owners who install underground utility services;
and b) the Planning Commission to consider modifying the require-
ment that all new residential uses be included by substituting the
criteria that two or more new residential units be included. The
motion was seconded by Councilman Briggs, and unanimously carried.
7. PUBLIC HEARING: 7:30 p.m. Appeal from Planning Commission Decision,
ZV Case No. 71-361 - Re. Child Care at 4932 McClintock (Kenneth C.
Coles, Applicant).
City Manager Koski presented background information on an appeal
for Zone Variance Case No. "71 -361; including Planning Commission
Resolution No. 71 -441 denying the variance, and advised that the
matter had been set for public hearing with due notice being given.
Mayor Gilbertson declared the public hearing open. It was moved
by Councilman Harker, seconded by Councilman Tyrell and carried
unanimously, to include the Planning Commission records as part of
the Public Hearing before the Council.
Mr. Kenneth Cole, 4932 McClintock Ave.,. Temple City, spoke in favor
of the appeal, reviewing the items outlined in his appeal before
the Planning Commission on December 22, 1971.
No one spoke against the appeal. it was moved by Councilman Briggs
seconded by Councilman Merritt and carried unanimously to
close the public hearing.
Assistant City Attorney Lieberman stated that the granting of
a zone variance must be evaluated by the same criteria
that applied to the Planning Commission as enumerated by the
Assistant City Attorney at the Planning Commission meeting of
December 15, 1971.
Bt was moved by Councilman Briggs, seconded by Councilman
Harker and unanimously carried that the appeal of a zone
variance in case No. 71 -361 be denied in that the requirements
for granting a variance were not met.
The Council also recognized the possibility of the transitional
nature of the neighborhood which might indicate a change to
a higher density use. It was moved by Councilman Briggs,
seconded by Councilman Tyrell and carried unanimously to ask
the Planning Commission to make a study of the area, and
specifically that side of the street, to ascertain appropriate
land uses and to submit any recommendations or stipulations
as to what changes should be made.
PUBLBC HEARING 7:30 p.m. Re. Request for Permit for Dance and
Entertainment License - The Crest, 5921 Temple City Blvd.
City Manager Koski presented a request for a Dance and Entertain-
ment License together with the Sheriff's Report, which had been
set for public hearing and posted as such, for 5921 Temple City Blvd.
Mayor Gilbertson declared the public hearing open.

Mr. Dennis Gagnon, 10132 Slauson, Whittier spoke in favor, as
the applicant for the license, and answered questions relating
to the request.
Deputy Gillmann of the Los Angeles County- Sheriff's Department
was present and stated that result of investigation failed
to indicate a basis for protest.
There was discussion regarding conditions to be included in
the request relating to closing of doors so that music does
not transmit, appropriate attire, manager to be known by
Sheriff's Department, and type of entertainment.
Since no one spoke against, it was moved by Councilman Merritt
seconded by Councilman Harker and carried unanimously
to close the public hearing.
It was moved by Councilman Merritt, seconded by Councilman
Harker and carried unanimously to grant the Dance and
Entertainment License for The Crest, 5921 Temple City. Blvd,
subject to conditions as discussed.
NEW BUSINESS:
9. SET PUBLIC HEARING: Re. Extension of Interim Ordinance No. 71 -340.
City Manager Koski presented background information. that
Interim Ordinance 71 -340 pertaining to Rosemead Boulevard
Redevelopment Project Area No. 1 will expire March 5, 1972.
It was moved by. Councilman Tyrell, seconded by Councilman
Merritt and carried unanimously -to set public hearing to
consider extension of Interim Ordinance No. 71 -340 for
Tuesday, February 15, 1972, at 7 :30 p.m.
10. ACCEPTANCE OF SANITARY'SEWERS: Subdivision Tract No. 29825 -
20 unit Condominum, 5530 -38 N. Welland (Noellpark)
City Manager Koski advised that a recommendation had been
received from Harvey T. Brandt, County Engineer, acting.as
City. Engineer, to approve the work that has been completed
and accept for public use the sanitary - sewers under Private
Contract 71 -2, and to release the sanitary sewer agreement
between.the City of Temple City and the subdivider, and
authorize release of the Bond for Faithful Performance for
Tract No. 29825 (Bond No. B- 642250 in the amount of $3,200,
dated May 7, 1971). It was so moved by Councilman Tyrell,
seconded by Councilman Briggs and unanimously carried.
11. TENTATIVE TRACT NO. 27410, 6340 N. Oak Avenue.
City Manager Koski advised that the Planning Commission.had
adopted Resolution No. 71- 438PC recommend,i ng,tto-the :.City ; Counc i l
t6pprov ,4'1 Of: .tl Tentative .Tract Map No.. 27410, relating to
proposed subdivision at 6340 N. Oak Avenue, Temple City.
Subject property is zoned R -1, Single Family Residential.
Proposed are five parcels with reduced lot area and lot width,
as outlined in the Planning Commission Resolution.
It was moved by. Councilman Merritt, seconded by. Councilman
Harker and carried unanimously to support the Planning
Commission recommendation and approve Tentative Tract Map.
No. 27410, subject to the requirements set forth in
Resolution No. 71- 438PC.
A ten minute recess was declared and the Council reconvened at
9 :30 p.m.

12. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of January 5, 1972:
A. Temple City Boulevard, from Lemon to Camino Real - Parking
Restrictions
The City Council received the recommendation from the Traffic
Commission outlining request from property . owners requesting
removal of parking restrictions on the east side of Temple
City. Boulevard between Lemon Avenue and Camino Real. The
Traffic Commission recommended a change in the present signs
from "No Stopping 7:00 a.m. to 5:00 p.m, School Days Only"
to "No Parking 7:00 a.m. to 5:00 p.m. School Days Only':', as
outlined in memorandum to City Council dated January 10, 1972.
It was moved by Councilman Briggs, seconded by Councilman Merritt
and carried to approve the Traffic Commission recommendation
as outlined in memorandum of January 10, 1972. Councilman
Tyrell cast a no vote.
B. Overnight Parking Permits - Amendments to Ordinance
The City Council received a recommendation from the Traffic
Commission relative to overnight parking permits, as to
temporary overnight parking needs of citizens, and quarterly
reduction on applications throughout the year.
It was moved by Councilman Merritt, seconded by Councilman
Tyrell and carried unanimously to approve the recommendation
of the Traffic Commission relative to overnight parking
permits as revised: a) the issuance of emergency temporary
overnight parking permits up to 30 days by the City Manager,
b) the permit fee remain at $12 for calendar year, with a
$2 reduction for each quarter for applications received after
April 1, July 1, and October 1, and to instruct the City. Attorney
to prepare an ordinance with the necessary changes for first
reading at the February 1, 1972 meeting of the City. Counci 1.
The Ordinance would amend Ordinance No, 63 -105 (Municipal Code
Sections 3324 to 3332).
13. RESOLUTION NO. 72 -1168: Employment of Temporary Personnel
It was moved by Councilman Tyrell, seconded by Councilman
Briggs and carried unanimously to adopt Resolution No. 72 -1168
entitled A RESOLUTION OF THE CITY, COUNCIL OF THE CITY. OF TEMPLE
CITY APPOINTING TEMPORARY PERSONNEL.
14 WARRANTS AND DEMANDS: RESOLUTION NO. 72 -1169, Demand Nos. 5220
thru '528.6 Fn the amount of $108,105.72.
It was moved by Councilman Harker, seconded,by Councilman
Briggs and carried unanimously to adopt Resolution No.
72 -1169 entitled ;A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM
OF $108,105.72 DEMAND NOS. 5220 THRU 5286.
COMMUNICATIONS:
A. Chamber of Commerce - Sidewalk Sale.
City Manager Koski presented a request from the Chamber of
Commerce to conduct a sidewalk sale, Saturday, February 5,
1972, between Primrose and Camellia Avenues along Las Tunas
Drive, during the hours of 9 a.m. to 5:30 p.m.
It was moved by Councilman Harker, seconded by'Councilman..
Briggs and carried unanimously to approve the request from
the Chamber of Commerce for the sidewalk sale subject to
insurance and the removal of the signs following the sale.

B. Chamber of Commerce.- Quarterly Report
City "Manager Koski presented correspondence from the Chamber
of Commerce advising that the Quarterly: Report will be presentcd
to the Council at the meeting of February.1, 1972.
C. Damage Claim -Frank 0. Hogan
The Council received a Claim for Property Damage from Mr.
Frank 0. Hogan, 6441 Livia, Temple City, caused from a parkway
tree falling during the windstorm of December 7, 1971. It was
moved by Councilman Tyrell, seconded by Councilman Briggs to
deny the claim and refer to the City's Insurance Carrier.
16. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
No one came forward.
17. MATTERS FROM CITY OFFICIALS:
A. Councilman Merritt reported on a letter received from
Robert L. Stitt, 10732 Freer Street, relative to overnight
parking on Freer. City staff was instructed to check into
matter.
Bo City Manager advised that Sheriff Peter Pitchess had
undergone surgery and was recuperating in Good Samaritan
Hospital. Mayor Gilbertson will send expression of good
wishes from City to Sheriff Pitchess and also to Supervisor
Bonelli who is ill.
C. City Manager presented travel requests as follows:
1) Joe Startin - League of California Cities Seminar
for Planning Commissioners in San Jose, February 23 -25
1972.
2) Everett Greenberg - California Association of Park and
Recreation Commissioners and Board Members, March 3,
4, and 5, 1972, at San Diego.
3) Vic Kobett - California Park and Recreation Conference,
March 4 -8, 1972, in San Diego.
It was moved by Councilman Briggs, seconded by. Councilman
Tyrell and carried unanimously to approve requests as outlined
and to authorize payment of necessary expenses.
D. Candidates Statement of Qualifications - General Municipal
Election 1972.
It was moved by Councilman Briggs, seconded by Councilman
Harker and carried unanimously that a $100 deposit be required
for candidates submitting "Candidates Statement of Qualifications"
to be printed only. in English; and that for candidates requesting
such statement in Spanish also, the deposit required should
be $200 to cover the cost of translation and the printing in
two languages.
E. Additional Work - Val Street (Cash Contract 4797X)
City Manager Koski presented a request for approval of additional
work on the improvement of Val Street (Cash Contract 4797X) of '
removal and replacement of asphalt concrete. It was moved by
Councilman Briggs, seconded by Councilman Harker and carried
unanimously to approve the additional work for improvement of
Val. Street as outlined in memorandum of January 18, 1972, and
appropriate additional funds in the amount of $4,400 from the
Gas Tax Fund and amend the adopted budget accordingly.

F. Mayor Gilbertson reported on Urban Problems Committee
Meeting. Discussion on policy being formulated was held.
It was moved by Councilman Tyrell, seconded by Councilman
Briggs and carried unanimously to oppose, in any way possible,
the Executive Committees' restructuring of SCAG which
Councilman Harker can use as a guide when attending the
SCAG General Assembly Meeting as official representative
on February 11, 1972.
G. Mayor Gilbertson apprised the Council that he had been
named to the Board of Directors of the Rosemead Chamber
of Commerce, •representing the Don Bosco Technical Institute.
H. Mayor Gilbertson suggested that a special flag be acquired
by the City for flying in Temple City Park on a day- and - night
basis, and especially lighted, with proper protection. It
was moved by Councilman Merritt, seconded by, Councilman Briggs
and carried to instruct the City staff to investigate the
possibility of the flag in Temple City Park and the
protection that might be needed.
I. Councilman Tyrell advised that he would again be a candidate
for City Council.
18. ADJOURNMENT:
It was moved by Councilman Merritt, seconded by Councilman
Briggs, and cari -ied unanimously to adjourn at 10:50 p.m.
The next regular meeting . of the City Council will be held
on Tuesday, February 1, 1972 at 7:30 p.m. in the Council
Chamber of the City Hall.
