Approval of Minutes: November 8, 1985. Upon a motion by Mr. Pfeifler and second by Mr. Hunter, the minutes were unanimously approved. 3. A request by Leadership Cablevision for a rate increase. SECOND READING OF ORDIPMXE 85 -4. Upon a motion by Mr. Hunter and second by Mr. Pfeifler, the Ordinance was unanimously passed on second reading. 4. Staff Report. a. Financial Report. The Financial Report was approved as submitted by Mr. Gwynn. The Town Audit was unanimously accepted as presented by representatives of the accounting firm of Ernst & Whinny. b. Police Reoort. The Police Report was approved as submitted by Chief Greer. There was considerable discussion regarding the placement of illegal signs. The Commission asked Mr. Randolph to investigate the Town's ability to remove signs on private property. Mayor Koch indicated that paramedic coverage with the City of Delray Beach will increase from $175.00 per call to $270.00. Upon a motion by Mr. Hunter and second by Mr. Pfeifler, the Commission unanimously approved the new agreement cost increase. Town Commission Meeting Minutes - Dec.13, 1985 page 2 c. Manager's Report. There was no specific Manager's Report at this meting. d. Bond Issue Project Report. Mr. Caputo reported that Murphy Construction would correct the canal dredging problems during the first part of January. e. Town Attorney Report. There was no Town Attorney Report. 5. Planning and Zoning Report. a. P.B. #85 -10. A. A request by Milord Development to remove the pine trees along AIA at Case Serena, 2601 No. Ocean Blvd. B. Notice of temporary issuance of Certificate of Occupany by Palm Beach County for Casa Serena. Upon a motion by Mr. Hunter and second by Mr. Pfeifler, both requests were unanimously approved. b. P.B. #85 -11. A request by the Gulf Stream School for modification to a previously approved site and landscape plan. Upon a motion by Mr. Hunter and second by Mr. Pfeifler, the Commission unanimously approved the request subject to Mr. Pfeifler, the School, and the Planning and Zoning Board resolving the landscaping layout. Conutissioner Convents /Recommendations. Mayor Koch reported on the meed for a Police Depart rent Study and Analysis. He indicated that he would like to proceed with Rousten and Associates to prepare the study. Mr. Pfeifler moved to meet with the company and negotiate a price. Seconded by Mr. Hunter and passed on a 2 to 1 vote with Mayor Koch opposing. 7. Public Convents /Requests. Mr. Fred Swanson inquired about the drainage problem on Gulf Stream Road in front of his property. Mr. Caputo stated that Earl Harvel and the Town Engineer were looking into the matter and would report back appropriately. B. adjournment. WHEREAS, Fairbanks Communications, Inc. (formerly Fairbanks Cable of Florida, Inc.), d /b /a Leadership Cablevision, cable television services to residents of Gulf Stream, Florida pursuant to a franchise granted by the Town by Ordinance No. 81 -3, on July 31, 1981, and WHEREAS, the rates and charges for cable television services have remained unchanged since Ordinance No. 79 -8 was amended by the Town in 1982; and WHEREAS, based upon the increased costs of operation since that time and other factors, Fairbanks Communications, Inc. (formerly Fairbanks Cable of Florida, Inc.), d /b /a Leadership Cablevision, has adequately demonstrated the need to increase the said rates and charges: NOW THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM THAT: Section 1. Section 29, "Rates of Ordinance No. 74 -5 of the Town of Gulf Stream, Florida, as amended on October 8th 1982, is deleted in its entirety and the following is substituted in its place and stead: Section 29, Rates. The maximum rates and charges which may be levied by the Company for connection to and use of its services are as follows: (a) Type of Service Residential & Commercial (Individual Billing ) First Outlet Connection Monthly Service Charge Rate (Effective (Effective 11/1/85) 11/1/85) $25.00 $9.95 -2- Additional Outlet Relocation (per outlet) Reconnections Residential Only (Bulk rate Billing, Annual Basis) First Outlet 4 or more units Additional Outlets 4 or more units Residential Only (Bulk rate Billing, Seasonal Basis, November 1, thru April 30) First Outlet 4 or more units Additional Outlets $15.00 $2.50 15.00 25.00 $25.00 $4.95 Time & Material By Contract $25.00 $5.95 4 or more units Time & Material By Contract An option to pay over twelve month period will be made available. (c) The Company is granted the privilege of making additional installation charges based on time and material for custom installation charges as defined in this Ordinance. The amount of the Company's compensation shall be subject to applicable federal, state and local law and regulations. All rates shall be uniform throughout the City. No changes in rates charged to subscribers shall be made except as authorized by the City after an appropriate public hearing. (1) "Standard Installation" shall mean any installation which requires no more than 100 feet of lead -in -type cable, where entry into the structure is made through an outside wall, where internal wiring can be affixed to the surface of the wall or base - board, and where the method of outside installation, either aerial or underground, is the same as is employed in the distribution line serving the subscriber. -3- (2) "Custom Installation" shall mean any installation which employs outside construction methods, either aerial or underground, different from that employed in the distribution line serving the subscriber, where inside wiring involves installation of cable or wire in any attic, crawl space or within the dead space area of any wall, or requires more than 100 feet of lead -in -type cable, or requires additional amplification equipment to provide proper service.
