Approval of Minutes: January 10, 1986 Mr. Dixson stated that in the first paragraph of item #5, the word "inquired" should be added immediately following his name. Upon a motion by Mr. Dixson and second by Mr. Armour, the minutes were unani- mously approved as revised. 3. Staff Report. a. Financial Report The financial report was approved by unanimous vote as presented by Mr. Gwynn. b. Police Report. The police report was approved by unanimous vote as presented by Chief Greer. c. Manager's Report. Mr. Gwynn presented a letter of rebuttal regarding the Town Audit Report. d. Bond Issue Project Report. Mr. Caputo discussed a list of items yet to be accomplished on the new Town Hall. He also stated that the contractor's tentative completion dates for the items and indicated that the current request for payment would be held until completion of the items. e. Town Attorney Report. Mr. Randolph discussed the recent letters regarding the emergency medical service. Minutes Town Commission Meeting Feb.14, 1986 page 2 f. Public Works Report There was no specific public works report for this meeting. 4. Planning and Zoning Board Report. a. P.B. #86 -3 A request by Scott Tiernan for final site plan approval for the renovation and addition to an existing single family residence located at 3018 N. Ocean Blvd. Upon a motion by Mr. Armour and second by Mr. Hunter the request was unanimously approved. b. P.B. 1186 -4 A request by Swan Brown for the removal of existing Australian pine trees along AlA at the residence of Mr. and Mrs. William North, 3224 No. Ocean Blvd. Upon a motion by Mr. Pfeifler and second by Mr. Hunter, the Commission unanimously authorized the removal of only the sick or dead trees to be replaced by new Australian Pines. The Commission further established this position to be the future policy of the Town regarding other trees along AlA. c. P.B. 1186 -5 A request and recommendation from the Planning & Zoning Board that Lots 3,4,5,6,7,8,9 Palm Beach Shores Acres, be rezoned from "RM" Multiple - Family Residential District to "RS" Residential Single - Family District. This property is located on Ocean Blvd., immediately north of El Cortijo. Upon a motion by Mr. Armour and second by Mr. Pfeifler, the Commission unanimously accepted the recommendation of the Planning & Zoning Board and set public hearings for March 26, 1986 and April 11, 1986, to formally consider the rezoning proposal. Mr. Randolph suggested that the Town officially declare "Zoning -In- Progress" for the subject properties and to issue no permits or subdivision approvals. Upon a motion by Mr. Pfeifler and second by Mr. Dixson, the Commission unanimously declared zoning in progress as suggested by Mr. Randolph. d. P.B. 1186 -6 A request and recommendation that the Zoning Ordinance be amended to require that all building setbacks be measured to the eaves, porches, projections, etc. Minutes Town Commission Meeting February 14, 1986 page 3 Upon a motion by Mr. Hunter and second by Mr. Dixson, the Commission referred the item to the Town Attorney for preparation of the necessary ordinances. Mr. Randolph suggested that the Town officially declare "Zoning -In- Progress" with reference to the measurement of setbacks to eaves, projections, overhangs, etc., and that no building permits be issued in contravention to this declaration. Upon a motion by Mr. Pfeifler and second by Mr. Armour, the Commission unanimously declared "Zoning -In- Progress" as suggested by Mr. Randolph. e. P.B. 1186 -7 A request and recommendation that variance application fees be increased from $75.00 to $150.00. Upon a motion by Mr. Armour and second by Mr. Pfeifler, the Commission unanimously approved the increase in fees as recommended by the Planning and Zoning Board and directed the Town Attorney to prepare the necessary ordinances. f. P.B. 1186 -8 A request and recommendation to adopt the proposed Model Coastal Construction Code. Upon a motion by Mr. Armour and second by Mr. Pfeifler, Ordinance 86 -1, adopting the Code, was approved at first reading through the declara- tion of emergency ordinance status due to the State of Florida deadline for adoption. 5. Resolution 1186 -1. Amending the present pension plan of the Town. The Resolution was approved as read by Mr. Gwynn upon a motion by Mr. Pfeifler and second by Mr. Hunter. 6. Commissioner Comments /Recommendations. There were no Commissioner comments or recommendations. 7. Public Comments /Requests. There were no public comments or requests. 8. Adjournment. There seems to be no justification for same and I wonder how these things are figured out and how you can say, when I pay $18,470.40 for taxes, that I am being justly treated when you compare things with Briny Breezes whose total taxes are $6,244.007 There certainly is a bank in Briny Breezes right on A -1 -A whose evaluation should be ten times mine and I believe they are in Briny Breezes and not the county. May I please ask you to justify the high taxes in Gulf Stream that all of my neighbors and 1 are forced to pay as a result of the 1985 appraisals and I assume they will go up again tremendously, as in the past, for 1986. RJD ORDINANCE NO. 86 -1 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, ADOPTING THE COASTAL BUILDING CODE AS RECOMMENDED BY THE STATE OF FLORIDA, DEPARTMENT OF COMMUNITY AFFAIRS, SO AS TO MEET THE REQUIREMENTS OF THE STATE OF FLORIDA "COASTAL ZONE PROTECTION ACT OF 1985 "; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, as follows: Section 1. The Coastal Building Code, as recommended by the State of Florida, Department of Community Affairs, meeting the requirements of the State of Florida, "Coastal Zone Protection Act of 1985 ", is hereby adopted and incorporated herein as fully as if set forth at length herein. Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications and to this end the provisions of this Ordinance are hereby declared severable. Section 3. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream, Florida. Section 4. GREER CHIEF OF POLICE RESOLUTION NO. 86 -1 A RESOLUTION OF THE TOWN OF GULF STREAM, PALM BEACH COUNT, FLORIDA, AMENDING THE PRESENT PENSION PLAN OF THE TOWN AND BY PROVIDING FOR A SEVEN (77) CONTRIBUTION OF THE TOWN AS EMPLOYER RATHER THAN (5%) BY THE EMPLOYER RESPECTIVELY AS PREVIOUSLY PROVIDED. WHEREAS, a meeting of the Town Commission of the Town of Gulf Stream, Florida, was held on the 10th day of September, 1985 and WHEREAS, there was presented to the Town Commission the need to amend the IDS Prototype (Pension) Plan used by the Town for the benefit of the employees of the Town. NOW THEREFORE, be it resolved by the Town Commission of the Town of Gulf Stream, Florida: Section 1. SECTION III — CONTRIBUTIONS. Paragraph 3.01 entitled "Employer Contributions" is amended at subparagraph (1) to read as follows: III. CONTRIBUTIONS. Paragraph 3.01 Employer Contributions. For each fiscal year of the employer beginning with the year ending SEPTEMBER 30, 1986 the Employer shall contribute to the Plan to be allocated to the account of each Participant: (1) An amount equal to seven (7%) of compensation paid to each such Participant for such year. Section 2. All other portions of the IDS Prototype (PenEiion) Plan shall remain intact and unchanged, the purpose of this resolution being only to increase the participation of the employer from Five (5%) to Seven (77) for the fiscal year ending September 30, 1986, and for each year of the employment thereafter as long as the IDS Prototype (Pension) Plan is in existence or until further amended.
