Mayer Town Attorney, John Randolph In response to Mr. Hunter's request for corrections or additions to the April 11th Minutes, Commissioner Armour said he would like to add that the April 11th meeting was an historic occasion as it was the first meeting in the new quarters. This addition to the Minutes was unanimously approved by the Commissioners and So Ordered by Vice -Mayor Hunter. 3. Staff Reports a. Financial Report Upon Motion by Commissioner Dixson and seconded by Commissioner Pfeifler the Financial Report, as submitted by Mr. Gwynn, was unanimously approved. b. Police Report Chief Greer reported his department's activities noting the problem of cars parking in the City Hall parking lot on weekends. After discussion with the Commissioners and Mr. Mayer, it was decided to place cones at the entrance to the parking lot to prevent access. The advice of the Beautification Committee will be sought on this matter. Renovations under way at the new Police Headquarters were discussed. Vice -Mayor Hunter inquired whether the building was being completed in the legal sense. Mr. Gwynn replied in the affirmative noting there was a revised schedule of architect's fees. c. Code Enforcement Report Mr. Sessa reported on the status of the community with regard to new residences, renovations, etc. noting the problem of a retaining wall and the retention of water in some areas. Mr. Gwynn read a letter regarding a re- surfacing contract. Discussion Minutes Commission Meeting May 9, 1987 Page 2 ensued on this item with the Comm_i.ssion assured of enforcement of Town code's on completion of projects. 4. Planning and Zoning Report PB -86 -12 Mr. Harry Kates, appearing for the Place Au Soleil Association, requested approval of plans and funds required to re- design and landscape the entrance into the subdivision on Federal Highway #1. Mr. Gwynn noted that the Town recognizes its responsibility in this matter and estimated approximately $1500., or 308, would be the Town's financial commitment to this project. Commissioner Pfeifler requested the Association provide the Canmission with final plans for the area under discussion. Mr. Kates agreed to provide said plans. Vice -Mayor Hunter asked for a vote of confidence and the Commission unanimously voted to approve. So Ordered by Vice -Mayor Hunter. FTENITIM Request for approval of placement of a satellite TV antenna on property located at 1511 N. Ocean Blvd. Commissioner Dixson requested information on possible visibility of the antenna. Assured by Messrs. Sessa and Mayer that every precaution will be taken to insure against visibility, Commissioner Dixson made a Motion to approve. Commissioner Armour seconded and the request was approved by the Commission. So Ordered by Vice -Mayor Hunter. raIILam[! Request for addition to existing single family dwelling on property located at 3145 N. Ocean Blvd. Discussion ensued regarding problems with the setback line. Commissioner Pfeifler made a Notion that this item be tabled. Motion seconded by Commissioner Dixson and passed by the Commission. BOA -3 -86 Request by Mark Perchick for variances to Sections VII.I.1 and VII.K.1 of the Zoning Ordinance. Commissioner Armour noted that construction cannot begin until the Town gives approval. Vice -Mayor Hunter said that the letters of notification to neighbors had not gone out and he recommended this item be tabled until the June meeting. The Commission agreed to the adjournment. 5. Item Not on the Agenda Mrs. Joan LaPorte wishes to build a small pool -spa on the south side of her property in order to provide therapy for a severe health problem. Mrs. LaPorte has secured all necessary Permits and it would not be visible from the road. Commissioner Dixson made a Motion to approve, Commissioner Armour seconded and the Commission unanimously approved. 6. Report on Drainage Mr. Mayer also spoke on the problem of water running off the Fogarty property noting that a drain pipe is needed. Mr. Mayer will provide further information to the Commission on this situation at their next meeting. Minutes Camai.ssion Meeting May 9, 1986 Page 3 7. Second and Final reading of Town of Gulf Stream Water Ordinance 86 -3. Unanimously approved by the Commission and So Ordered by Vice -Mayor Hunter. 8. Resolution of the Town Commission of the Town of Gulf Stream, Florida, on behalf of the Town to thank Mrs. Joan LaPorte for her generous gift of an antique table to be used in the vestibule of the new Town Hall. This Resolution wag read by Mr. Gwynn and will be presented to Mrs. LaPorte. It will also became a part of the permanent records of the Town of Gulf Stream. 9. Mr. Gwynn spoke on possible Agreement with the accounting firm of Ernst and Whinny to do the annual audit from October 1, 1985 to September 30, 1986 at no increase in cost from previous years. Agreement unanimously approved by the Commission and So Ordered by Vice -Mayor Hunter. 10. Mr. Henry Wright presented a picture of the Board of Crnmissioners to Vice - Mayor Hunter with a short speech of the history of the picture. Vice -Mayor Hunter accepted the picture with thanks. 11. Mr. Gwynn announced there would be a general Police Department review on Wednesday, May 28, 1986. Commissioner Armour requested the Commission receive printed material on this review a day ahead of the event. 12. Announcement made .of-.a Hurricane Preparedness meeting to be held on Thursday, May 29th. It is a meeting for the whole Tartan. A slide presentation will be given by the Delray Beach Police Department. It was suggested that information resulting from this meeting be shared with the residents. u 13. Mr. Gwynn read a letter of resignation sent to Mayor Koch by Vice -Mayor Hunter. 14. Commissioner Dixscn, requesting his remarks be made a part of the Minutes of this meeting said: "Not only did the Camiission regret deeply that conditions are such as to require Mr. Hunter's resignation but that the cammnity at large feels the same way. That not only has the Commission enjoyed their association with Mr. Hunter but that they have bene- fited by his advice, by his incisive observations over the years, and that I personnally am grateful for the benefits I have received as I have functioned in my position as Commissioner and that all the Commissioners feel the same way. The community owes a deep debt of gratitude to Mr. Hunter for the almost nine years he has served on the Camuission." Turning to Mr. Hunter, Mr. Dixon said, "Joel, we are very grateful to you and we regret, as I say, that you have to leave us. I hope your resignation will not deprive us of the right to cane to you in the future to seek your advice and counsel. We are very, very grateful to you and again I say to you that it is unfortunate that conditions are such that you have to leave us." Complainant's Solicitor. n ORDINANCE 86 -3 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, PROVIDING FOR THE DISCONTINUANCE OF WATER SERVICE TO PREMISES FOR WHICH A WATER BILL REMAINS UNPAID FOR A PERIOD OF SIXTY DAYS AFTER THE BILL IS RENDERED AND MAILED; PROVIDING FOR A PENALTY ON UNPAID WATER BILLS; PROVIDING FOR A LIEN; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AS FOLLOWS: Section 1. Any water bills remaining unpaid for a period in excess of thirty (30) days after the bill is rendered and mailed shall bear interest at the maximum rate allowed by law. In addition, the water supply may be shut off from any premises for which the water bill remains unpaid for a period of more than sixty (60) days after the bill is rendered and mailed. When shut off, water shall not be turned on except upon the payment of a fee of $100.00 for turning off and turning on the water. Notice shall be given by the Town to the owner of the premises for which the water bill remains unpaid at said owner's last known address as indicated on the Palm Beach County tax rolls, at least fifteen (15) days prior to the date that the water is shut off. Section 2. Charges for water shall become a lien upon the premises. Whenever a bill for water service remains unpaid sixty (60) days after it has been rendered, the Clerk may file with the recorder of Palm Beach County, a statement of lien claim. This statement shall contain the legal description of the premises served, the amount of the unpaid bill, and a notice that the Town claims a lien for this amount as well as for all charges for water served subsequent to the period covered by the bill. Section 3. Property subject to a lien for unpaid water charges may be sold for non - payment of the same, and the proceeds of such sale shall be applied to pay the charges, after deducting costs, as in the case of the foreclosure of statutory liens. Section 4. If any section, paragraph, clause, phrase or term of this ordinance be declared invalid, the same shall not operate to invalidate any other provisions which can be given effect. Section 5. This ordinance shall be codified and made a part of the Official Code of Ordinances of the Town of Gulf Stream. Section 6. That this ordinance shall be in full force and effect from and after its passage and approval according to law.
