HomeMy Public PortalAbout2003-06 Amending Village Code Administration re Creation of DepartmentsORDINANCE NO. 2003-6 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AMENDING THE VILLAGE CODE, AMENDING CHAPTER 2 "ADMINISTRATION" AT ARTICLE I "IN GENERAL", BY AMENDING PARAGRAPH (a) "CREATED" OF SECTION 2 -1 " CREATION O F D EPARTMENTS", B Y REVISING THE DESCRIPTION OF THE "EMERGENCY SERVICES DEPARTMENT" TO BE THE "PUBLIC SAFETY DEPARTMENT"; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village Manager has recommended that the Emergency Services Department be reorganized and that the designation of the Emergency Services Department be revised to be the Public Safety Department; and WHEREAS, the Village Council desires to implement the Village Manager's recommendation as described above, as provided herein. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS': Section 1. Recitals. That each of the above stated recitals is hereby adopted and confirmed. Section 2. Village Code Amended. T hat P aragraph (a) "Created" o f S ection 2 -1 "Creation of Departments" of Article I "In General" of Chapter 2 "Administration" of the Village Code of the Village of Key Biscayne, Florida is hereby amended to read as follows: '1 Proposed amendments to existing Village Code text are indicated by the underline; proposed deletions from existing Village Code text are indicated by strikethrcrugh. Sec. 2-1. Creation of Departments. (a) Created. The following departments within the Village of Key Biscayne are hereby created: (1) Building, Zoning and Planning Department; (2) Finance and Administrative Services Department; (3) Recreation Department; Public Safety Department; and (5) Public Works Department. Section 3. Severability. That the provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, c lauses, a nd p hrases o f t his 0 rdinance b ut t hey s hall r emain i n e ffect, i t b eing t he legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion In The Code. That it is the intention of the Village Council that the provisions of this Ordinance shall become and made a part of the Village Code; that the sections of this Ordinance may be renumbered or re -lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 5. Effective Date. That this Ordinance shall become effective upon adoption on second reading. 2 PASSED AND ADOPTED on first reading this 24th day of June 2003.
