HomeMy Public PortalAboutResolution 90-29751 RESOLUTION NO. 90 -2975 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DENYING A MODIFICATION OF CONDITIONAL USE PERMIT 71 -342 AND ZONE VARI- ANCE 89 -1036 A REQUEST BY SANTA ANITA VILLAGE SCHOOL TO ALLOW THE EXPANSION OF AN. EXISTING PRE - SCHOOL FROM AN ENROLLMENT OF 24 STUDENTS TO 56 STUDENTS, TO ALLOW INCREASED HOURS OF OPERATION AND TO ALLOW A PARKING DESIGN WHICH NECESSITATES THE BACKWARD MOTION OF VEHICLES RATHER THAN THE FORWARD MOTION OF VEHICLES AS REQUIRED BY THE ZONING CODE FOR SUCH PARKING AREAS WITHIN THE LIGHT MULTIPLE (R -2) ZONE. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. .Based upon a public hearing for the above Modi- fication of Conditional Use Permit and Zone Variance, the City Council finds: MODIFICATION OF CONDITIONAL USE PERMIT 1. That the site for the proposed use is not adequate in size, shape, topography and circumstances in that existing im- provements on the site preclude the expansion of the facil- ity to adequately accommodate additional pupils; and 2. That the site does not have sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the existing and proposed parking lay out neces- sitates the backward motion of vehicles into or nearly into the street in order to exit parking spaces; this results in inadequate parking, poor circulation and possible traffic safety hazards; and 3. That the proposed use will have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the proposed expansion does not adequately address existing inadequacies on the site and does not provide for improvements for ingress and egress; the site is inappropriate for expansion without substantial modifications to accommodate parking and vehicular move- ments. Resolution No. 90 -2975 Page 2 ZONE VARIANCE 1. That there are no exceptional and extraordinary circumstances or conditions applicable to the property which do not generally apply to other properties in the same zone in that the site is 81.74 feet by 185.74 feet and a proposed addition could be constructed to meet minimum code require- ments; and 2. That such variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that other similarly zoned proper- ties throughout the City are developed with pre - schools which have been constructed in accordance with the Zoning Code requirements in effect at the time of construction; and 3. That the granting of'the variance will be materially detri- mental to the public welfare or injurious to adjacent property in that the proposal to double the current pupil enrollment will substantially increase vehicular movement on the site. As proposed inadequate provisions are provided for parking and ingress and egress; the existing structures on the lot are not of substantial quality and could have a negative impact on surrounding properties if not substan- tially upgraded or replaced; and 4. That there are no special circumstances as provided in Section 65906 of the California Government Code in that the subject lot is rectangular in shape and generally level in grade and does not possess any unique features relative to size, shape, or topography. SECTION 2. This project should result in significant ef- fects upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. SECTION 3. Accordingly, Modification of Conditional Use Permit 71 -342 and Zone Variance No. 90 -1036 are denied. SECTION 4.
