APPROVING DESIGNATION OF REDEVELOPMENT AREA BOUNDRIES-
WEST CARTERET REDEVELOPMENT AREA
WHEREAS, by Resolution #05-45, adopted on January 27, 2005, the Mayor and
Council of the Borough of Carteret ("Borough Council") authorized and directed the
Planning Board of the Borough of Carteret (the "Planning Board") to undertake a
preliminary investigation to determine whether those properties listed on Exhibit A
hereto ("Delineated Area") meet the criteria set forth in the New Jersey Redevelopment
and Housing Law, NJ.S.A. 40A: 12A-l et seq. ("Redevelopment Law"), a for being
determined to be an "area in need ofredevelopment" as therein defined; and
WHEREAS, after providing requisite notice, the Planning Board held a hearing on
March 23, 2005 to review the results ófthe preliminary investigation and to solicit public
comment on whether the Planning Board should recommend to the Borough Council that
the Delineated Area be determined to be an "area in need ofredevelopment"; and
WHEREAS, at the public hearing, the Planning Board considered the testimony of and
exhibits furnished by a license professional planner from Beacon Planning and
Consulting Services, LLC, the author of the Redevelopment Area Assessment Report for
the Delineated Area, and afforded all interested members of the public an opportunity to
make inquire into and give testimony concerning the boundaries of the proposed
Delineated Area and whether said area should be determined to be a redevelopment area;
and
WHEREAS, the Planning Board, by a Resolution of Findings and Conclusions dated
April 27, 2005, has recommended to the Borough Council, pursuant to Section 6 of the
Redevelopment Law, that the Delineated Area be determined to be an "area in need of
redevelopment", finding that the properties constituting the Delineated Area meet at least
three (3) of the statutory criteria to be an area considered in need ofredevelopment; and
WHEREAS, the Borough Council has given due consideration to the recommendation of
the Planning Board and further finds that said recommendation is supported by
substantial evidence; and
WHEREAS, the Borough Council further concludes that there exits within the delineated
area sufficient criteria for the designation of a redevelopment area as set forth in NJ.S.A.
40A:12A-5, as more fully described and delineated in the Redevelopment Area
Assessment Report, and as found by the Carteret Planning Board.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough
ofCarteret, County of Middlesex, State of New Jersey that the West Carteret Commercial
Redevelopment Area as depicted on Figure 15, Proposed Redevelopment Area,
containing those properties listed on Table 1, Study Area Properties, as set forth in the
above-described Beacon Planning report, a copy of which is attached hereto and made a
part hereof, is a redevelopment area as so defined by NJ.S.A. 40A:12A-3.
BE IT FUTHER RESOLVED, that a duly executed copy of this Resolution shall be
transmitted to the Commissioner ofthe New Jersey Department of Community Affairs.
BE IT FUTHER RESOLVED, that a copy of the Redevelopment Area Assessment
Report shall be kept on file in the Office of the Borough Clerk for public inspection.
BE IT FURTHER RESOLVED, that the Borough Council hereby directs the Planning
Board to prepare a Redevelopment Plan for the Delineated Area in accordance with the
Redevelopment Law.
BE IT FURTHER RESOLVED, that duly executed copies of this Resolution shall be
transmitted to the Planning Board and filed in the office of the Borough Clerk.

Dear Ms. Barney:
With regard to the above referenced parcels described in Resolution #2005-188,
and in accordance with your proposals to designate said parcels as redevelopment
areas within the Borough of Carteret, please be advised that we consider your request to
be consistent with the Department of Community Affairs' smart growth principles.
Accordingly, the proposed redevelopment areas fall entirely within a defined
smart growth area, pursuant to N.J.S.A. 40A: 12A-6.b.(5). If you have any additional
