TEMPORARY NONCOMMERCIAL SIGNS &
LITERATURE REGULATIONS
This handout provides the basic information regarding posting of temporary
noncommercial signs and distribution of handbills. You can review the text of the
Municipal Codes referenced in this document at www.cityoffullerton.com.
TEMPORARY NONCOMMERCIAL SIGNS
Fullerton Municipal Code Chapter 15.49 regulates the placement of temporary
noncommercial signs within the City of Fullerton.
What is a Temporary
Noncommercial Sign?
A Temporary Noncommercial Sign is any temporary sign
(for example – political, candidate or charitable purpose)
visible to the public, including but not limited to, signs
supporting a particular vote in a scheduled public election
that do not involve a commercial message or encourage a
commercial transaction.
Where can I place
Temporary Noncommercial
Signs?
You may post Temporary Noncommercial Signs on private
property with the property owner’s approval as long as the
signs do not constitute a public safety hazard.
Where can Temporary
Noncommercial Signs not
be placed?
Per Fullerton Municipal Code 15.49.040(A), you may not
place signs in the following locations:
In city street medians
On public property
On or over public streets, sidewalks, crosswalks or
curbs, including parkways
In any public park, including but not limited to trees,
parkway, walkways, benches or fences
Upon any tree, power pole, street light or
other above ground fixture within the public right of
way
In addition, state regulations prohibit signs:
Within 100 feet of a polling place on Election Day
whether private or public property (Election Code
Section 18370(b), (d))
Within the right of way of a state highway
(Imperial Highway or Beach Boulevard) (Business
& Prof. Code)
Within 660 feet of the edge of and visible from the
right of way of a landscaped freeway (SR 91 or SR
57) (Business & Prof. Code)
Do I need a permit to post
a political sign?
No
How many Temporary
Noncommercial Signs does
the City allow at any time?
The City does not limit the number of Temporary
Noncommercial Signs erected at any time.
What are the size limits for
Temporary Noncommercial
Signs?
32 square feet (total area).
Sign Removal The City’s Public Works Department may remove signs
which do not meet City and/or State criteria or which
pose a safety hazard.
The Public Works Department will remove signs placed
in the public right-of-way.
The City will keep removed signs at the Maintenance
Yard for pickup by the sign’s owner. The City shall
destroy signs not picked up by the owner within 30
days of the election.
Signs in Medians Removed
Immediately
The City Council finds that signs placed in the medians
present a particular danger for traffic safety as signs can
be blown into traffic or obstruct visibility. The City shall
immediately remove such signs.

LITERATURE / HANDBILL / FLYER REGULATIONS
Handbills are an effective way to express protected First Amendment activity but can also
result in excessive littering and annoyance. The City of Fullerton places some restrictions
on handbill distribution. Municipal Code Chapter 7.30 governs the distribution of handbills
within the City.
Distribution to unwilling
recipients
Handbills shall not be handed to persons who do not wish
to receive them. FMC 7.30.030 (individuals), 7.30.032
(properties), 7.30.034 (multi-unit properties)
No Littering It is unlawful to litter on any private or public property
with handbills or any other kind of written or printed
materials. FMC 7.30.040
It is unlawful to litter park areas with handbills or printed
materials. FMC 9.12.110
Handbills must be placed directly in a person’s hand or
bound, folded or affixed to the premises such that the
materials shall not blow away or be scattered by
normal pedestrian and traffic flow. FMC 7.30.050
