of the
Town of Gulf Stream, Florida
Held: March 9, 1957
Present: Mayor - Commissioner - L. Seton Lindsay
Commissioner - Stewart B. Iglehart

Town Attorney - H. F. Lilienthal
Town Clerk - J. R. Fountain
Also in attendance - Curtis H.Dodson, J. D. S. Coleman,
John G. Hart, Talbot T. Speer, C. P. Young, Mr. C.E. Jones and
Mr. Anderson.
Mayor Lindsay called the meeting to order. The Town Clerk
called the roll.
Mr. Iglehart moved that the Commissioners dispense with the
regular order of business. Mr. Pope seconded and the motion
passed unanimously.
Mr. Iglehart moved that the ballot box be opened. Mr. Pope
seconded and it passed unanimously.
Mr. Anderson, who stated that he represented Mr. Hart,
requested that the ballots be canvassed.
Mr. Lilienthal, Town Attorney, asked Mr. Anderson which candi-
datesl votes he wished polled. Mr. Anderson said that he was
interested in Mr. HartIs and Mr. Pope's votes.
After a pole of the votes for Mr. Pope and Mr. Hart, Mr.
Anderson and J. R. Fountain stated they had 32 votes for each.
J. R. Fountain said that one ballot was voided by the election
officials because the elector had voted for 6 men. Mr. Lilienthal
located this ballot and stated that since it had one vote for
Mr. Hart that it must be invalidated, thereby reducing the votes
for Mr. Hart to 31. This made Mr. Pope the winner.
Mr. Anderson requested that the election be not certified
as correct until an investigationtle made. He requested that the
ballot containing 6 (X) marks be counted, and that a ballot con-
taining (VI marks instead of (X) marks be disallowed. Mr.
Lilienthal stated that the ballot with (4 mark would be counted
as valid.
Mr. Anderson further stated that the canvas of the ballots
and the election not be completed because the Town has no
ordinances governing the procedure for elections, and further

that the list of registered voters was not correct, being evident
from the tremendous increase in the number of registered votes;
and for the additional reason that Mr. Pope was not a resident
of Gulf Stream and, therefore, was not qualified to serve as
a Town Commissioner.
Mr. Lilienthal asked if there were any further objections;
there being none, Town Clerk J. R. Fountain was instructed to
read the official final returns, which were as follows:

The Commissioners voted unanimously that this was the
official final return of the election held on March 5, 1957.
Mayor Lindsay declared the portion of the Town Commission
meeting pertaining to the election adjourned, and invited any
residents of Gulf Stream or their representatives to remain
for the regular business meeting. Only the 4 Commissioners,
Mr. Dodson, Mr. Lilienthal and J. R. Fountain remained.
Mayor Lindsay called the regular meeting of the Town
Commissioners to order.
The minutes of the regular meeting held on February 9,
1957 were read, approved and adopted.
Mayor Lindsay read a letter addressed to Mr. Wilbur E. Jones
of the State Road Board and asked that the Commissioners sign it.
The Town Clerk gave the financial report and read a list of
the checks drawn during February, 1957. All of the payments were
unanimously approved.

Mr. Koch requested that J. R. Fountain prepare a letter to
Delray Beach and state in it that the Town would be willing to
pay the City of Delray Beach X1200.00 for Fire Protection with
a flat rate of $75.00 per fire call. He made a motion that in
the event the Delray Beach Council showed no interest that the
Town renew its contract with Boynton Beach. Mr. Pope seconded
the motion and it was passed unanimously.
P'fayor Lindsay appointed Mr. Pope and Mr. Koch as a committee
of two to investigate the feasibility of the Town purchasing a
fire truck that could be used by pumping water from the canal.
He asked that they report on the results of their investigation
at the Commissioner's meeting on April 13, 1957.
Mayor Lindsay read a draft of the following resolution:
RESOLUTION NO. 465
FIXING TIME WHEN TOWN COMMISSION
WILL SIT AS BOARD OF EQUALIZATION
WHEREAS, the Town Charter requires that the Town Com-
mission shall sit as a Board of Equalization on the 1957 tax
rolls on a day or days between March 15th and April 1st;
NOW, THEREFORE, BE IT RESOLVED, BY THE TOWN COMMIS-
SION OF THE TOWN OF GULF STREAM, FLORIDA, in regular session
assembled March 9, 1957, as follows:
1. That the Town Commission will sit as a Board of
Equalization on the Town tax rolls for the year 1957 on March
19, 20, & 21, 1957, between the hours of 10:00 otclock
a.m. and 12 :01 o1clock p. m. of each day for the purpose of
hearing complaints, if any, and of equalizing the assessment
rolls.
2. The Town Clerk is directed to post a copy of this
resolution on the Town Bulletin Board immediately after its
adoption and to leave the same on the Bulletin Board until April
first.
3. All persons having any complaints or objections
to the assessment rolls are directed to make their complaints in

writing and to present the same at the time that the Commission
will sit as a Board of Equalization.
Adopted this 9th day of March, 1957.
Mayor Lindsay made a motion_ the above resolution be adopted.
Mr. Koch seconded and it was carried unanimously. Mayor Lindsay
and each Commissioner present signed the original of the resolu-
tion and it was voted unanimously that this resolution be made
a part of these minutes.
Mayor Lindsay moved and Mr. Koch seconded that the Town
pay each election official X10.00 each for their 122 hrs. work
and $5.00 each for expenses. The Commissioners voted unanimously
to pay each election official, Mrs. Bauer, Mr. Turner and Miss
Cramp this above stated amounts.

CARD FROM ANY AUTOMOBILE OR VEHICLE,.OR
OTHERWISE TO DISCARD, THROW OR DEPOSIT
ANY REFUSE, OR ANY OTHER THING OR SUB-
STANCE ON THE STREETS, ROADS OR HIGHWAYS
IN THE TOWN OF GULF STREAM, OR ON THE
PROPERTY ADJOINING SUCH STREET, ROAD OR
HIGHWAY: AND PROVIDING PENALTIES FOR THE
VIOLATION OF THIS ORDINANCE: AND PROVID-
ING THAT THIS ORDINANCE SHALL BECOME
EFFECTIVE IMMEDIATELY UPON ITS PASSAGE.
was read in full on first reading.
Mayor Lindsay requested Mr. Koch to investigate the possi-
bility of the town having county or State prisoners trim the
trees on AIA.
Mayor Lindsay stated that he had heard that some residents
of Gulf Stream have 'voiced complaints about the Commissioners
permitting contractors and workers to continue with their work
after December 1st. They feel that under the Zoning ordinance
of 1952 all work should cease after that date. Mayor Lindsay
appointed Mr. Dodson chairman of the Zoning and Building
Committee and instructed him to select other tax payers of
Gulf Stream to work with him in recommending a new draft of
the Zoning and Building ordinance. The Mayor recommended that
Mr. Dodson get the views of the Civic Association Zoning
Committee members.

Mayor Lindsay stated that he had heard complaints regarding
the water contract with the Golf Club and poor water pressure.
He asked the Commissioners to consider these matters and make
suggestions at the next regular meeting.
Mr. Iglehart reported a complaint by Mr. Hornney regard-
ing the placing of a garbage receptical of Mr. Burkets too
close to Gulf Stream Road. The Town Clerk said he would
check into this matter.
It was moved, seconded and passed unanimously for the Town
to take out insurance on the Towns Radios, sirens and blinker
lights at $10.00 per year.
There being no futher business the commis - ioners
