GWYNN October 3, 1986 Assistant Town Manager -Town Clerk BARBARA GWYNN Chief of Police JAMES GREER Meeting called to order at 9:00 a.m. by Mayor Koch, who presided at the meeting. 1. Roll call. Present: William F. Koch, Jr. Mayor Alan T. Armour Vice -Mayor James E. Cross Commissioner Robert J. Dixson Caaaissioner Absent: Brian P. Pfeifler Conudssioner Also present: John Randolph Town Attorney William Gwynn Town Manager Barbara Gwynn Town Clerk John Buchan Captain, Police Department Lou Sessa Code Enforcement Officer 2. On motion duly made and seconded the minutes of the September 11, 1986 public hearing were approved. On discussion of the minutes of the September 29, 1986 meeting Commissioner Dixson stated, "I have one minor change that I would like to have included in the minutes of the 29th, over on page two, first line...'and now projecting that base on an average of eight municipalities' ... in the interest of accuracy involving language, it should read... 'and reflected in their 1986 -87 budget proposals'... otherwise, it is ambiguous." There being no other additions, changes or corrections, the minutes of the September 29, 1986 Public Hearing on the Budget were approved on motion duly made and seconded. 3. Financial Report Mr. Gwynn reported that the budget process has been completed according to law and added that the Financial Report for the month of September will be delivered next week. 4. a) The Managers Report was included in the above. b) Captain Jack Buchan provided statistics on police activities during the month of September. Commission Meeting Oct. 3, 1986 Minutes Page two 4. c) Captain Buchan reported that it is expected the Police Department will move into its new quarters during the ccn -dng week. A C.O. has not as yet been issued. d) on Code Enforcement, Mrs. Gwynn reported that everything is fine. 5. Discussion on Leadership Cable T.V. Franchise David Baker, attorney for Leadership Cable T.V., spoke on initiating the process for renewal of their franchise under the Cable Communications Policy Act of 1984. Mr. Baker gave the history of Leadership Cable and its relationship with the Town of Gulf Stream, and answered the Commissioners questions. Mr. Baker also called on other Leadership officers in attendance at the meeting to provide detailed information regarding the operation of Leadership T.V. on costs, operational and administrative problems, inclusion of public TV stations, etc. Inasmuch as this is a non - exclusive franchise, Town Attorney John Randolph informed the Commissioners and the public, that the Town is not legally required to consider other proposals although it is our legislative prerogative. Mayor Koch concluded the Leadership presentation by asking if anyone wished to speak on the subject. There being no response, the Mayor moved ahead on the agenda. 6. Mayor Koch announced that Florida Power and Light has written to the residents regarding yellow security lights. After discussion on the subject, it was decided to write Florida Power and Light requesting a review of their proposal. Mr. Gwynn read a letter from Lou Spano, Public Safety officer of the Town of Ocean Ridge,regarding the placement of blue fire hydrant markers on roads in the Town of Gulf Stream. After discussion it was decided that one marker is sufficient on roads in residential areas and two on AIA. Mayor Koch commented on a letter received by a resident which seemed to promote a real estate office and which gave a corporate address on Golfview Drive. It was recommended that the Police Department and the Code Enforcement officer look into this matter. Mr. Gwynn read Town of Gulf Stream Resolution No. 86 -9 entitled: A RESOLUTION FOR ADOPTING THE IDS FINANCIAL SERVICES, INC. FOR THE TOWN OF GULF STREAM, FLORIDA, PLAN No. 2367. This Resolution provides for the Town of Gulf Stream Pension Plan and it was unanimously approved by the Commission on motion duly made and seconded. Mrs. Gwynn explained to the Commission that Executone had come back to the Town Hall and had found that they ( Executone) had not installed the lightening protection equipment as was required of them. Thus, the bill Executone sent to Commission Meeting, October 3, 1966 Minutes Page Three 6. (continued) The Town of Gulf Stream in the amount of $14,000. is cancelled and that the only monies the Town is responsible for is $507. for telephone equipment damaged at the Maintenance building when lightening stuck there. This bill will be sent to our insurance company. Discussion ensued on the security of the Police Department communications; that maximum care be taken to install whatever protective devices are necessary to secure that system. Mr. Sessa explained that an elaborate protective device has been installed by Executone in the Town Hall and in the Police Department Headquarters building. These devices will prevent loss of service due to electrical storms. Discussion on the Town of Gulf Stream opposition to the proposed County -wide Planning Commission ensued with Town Attorney John Randolph interpreting the November 4th referendum as representing a loss of local control of territory by municipalities as well as initiating another County agency. Mr. Malstran, President of Place Au Soleil Civic Association, will include the above information in his Association newsletter and, on sugguestion of Mayor Koch, will send a copy of this newsletter to Mr. O'Brien. FOR THE TOWN OF GULF STREAM, FLORIDA, PLAN NO. 2367. MEETING OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA. A meeting of the Town Commission of the Town of Gulf Stream, Florida, was held on the 3rd day of October, 1986, at the offices of the Town, located at 100 Sea Road, Gulf Stream, Florida. There was presented to the meeting the IDS Financial Services Inc. Money Purchase Plan N 8, Plan No. 2367, which included the full text of the proposed plan and trust and related adoption agreement for the employees of the Town as approved by the Town counsel. This plan shall be known as the Town of Gulf Stream Pension Plan, hereinafter referred to as the "Plan ". The same was discussed and ordered annexed to these minutes. UPON MOTION DULY MADE, SECONDED, AND DULY CARRIED, IT WAS RESOLVED, that the Town accept and adopt the Plan as presented, and for such to be effective as of the 1st day Of October, 1984. (Except for paragraph 4.01 which shall be effective for the September 30, 1986 Plan year and thereafter.) FURTHER RESOLVED, that the officers of the Town be and hereby are authorized and directed to execute in the name and on behalf of the Town and under its Town seal such agreements as may he necessary for the initiation and continuity of the plan. FURTHER RESOLVED, that such sums of money as may be necessary according to the said agreement or agreements to provide benefits and to meet the expenses incurred in the administration thereof, shall, from time to time, be paid out of the funds of the Town by its Treasurer, to the order of t)ie Trustees. FURTHER RESOLVED, that William E. Gwynn, Brian Pfeifler,-and W. F. Souder be and hereby are authorized, directed and designated as Trustees under said agreement to administer the funds entrusted to them under said agreement for such Plan. FURTHER RESOLVED, that the officers Of the Town be and they hereby are authorized and directed to execute in the name of and on behalf of the Town, and under its Town seal, any amendments to the Adoption Agreement attached to the Plan to meet the requirements of Section 401(a) of the Internal Revenue Code of 1954, as amended, unless such amendments would cause the Plan to lose its prototype status.
