Koch, Mayor, who presided at the meeting. 7 2. Roll Call Present: William F. Koch Alan T. Armour James E. Cross Robert J. Dixson Brian J. Pfeifler Also Present: John Randolph William Gwynn Barbara Gwynn James Greer Clarence Sova Louis Sessa Mayor Vice -Mayor Commissioner Commissioner Commissioner Town Attorney Town Manager Town Clerk Chief of Police Public Works Supervisor Code Enforcement Officer On motion duly made and seconded the Minutes of the Town Conuassion meetings of January 9, 1987 and January 26, 1987 were approved. 3. Financial Report Mr. Gwynn gave the financial status of the Town with regard to real estate taxes, transfer of funds and cash projection. On motion duly made and seconded the Town Commission accepted the Town Manager's report, copy of which is attached hereto and made a part of these minutes. 4. Police Rexoort Chief Greer reported on the activities of his department over the past month then reported on a request for Town of Gulf Stream police services by Ballantrae. On motion duly made and seconded the Town Commmission voted against providing said services to Ballantrae. 5. Attorney Donald Reed, Jr. appeared for Delray Beach Drive -In regarding its use of F.I.N.D. property located in the Town of Gulf Stream requesting consideration for his client. The Town Attorney was Town Concdssion Meeting Minutes - February 13, 1987 Page Two (continued) previously instructed (1/9/87 meeting) to pursue all legal limits to prevent this use. Said instructions stand. No action taken. Code Enforcement Report Mr. Sessa reported on building and renovation activities in the Town noting that all trades are getting licenses and are being checked out thoroughly. 6. Discussion on Mr. William Kelly letter and Mr. William Evans letter on Delray Heacn Fire /Rescue Emergency services. After detailed discussion of the two incidents reported and recaRmndation that the residents require specific information on procedure to follow in emergency situations, the Cmmission, on motion duly made and seconded, voted 4 to 1 that Mr. Kenny is responsible for the charges rendered by Delray Beach Fire/Rescue Service. 7. Town of Gulf Stream flags. On motion duly made and seconded the Town CamLissicn tabled the request for six Town of Gulf Stream flags. 8. Town Manager William Gwynn read Town of Gulf Stream Resolution 87 -2 relating to insurance coverage for public officials and employees. on Motion duly made and seconded the Town Camassion approved said Resolution. Mr. Gwym read Town of Gulf Stream Resolution 87 -3 pertaining to the cancellation of the March 10, 1987 Town election for the five Ca[mission seats. on motion duly made and seconded the Commission approved said Resolution. The Town Manager reported on the state mandated Comprehensive Plan. on motion duly made and seconded the cmmissicn accepted the recommendation of the Town Manager to use the services of the Resource Engineering and Planning Company with the stipulation that the cost not exceed the money cost allocated to the Town of Gulf Stream by the State of Florida for this purpose. on motion duly made and seconded the Cawassion appointed George Frost to the County Master Planning Commission. on motion duly made and seconded the Camassion directed the Town administration to dispose of excess items by means of sale. Notice of sale to be put on the Bulletin Board at Town Hall. The Town Commissioners recognized Joe Donly for his excellent library work and directed the Town Manager to prepare a Resolution honoring Mr. Donly for his contribution of time and effort to the ccauunity. on motion duly made and seconded the meeting was adjourned at 10:20 a.m. Barbara �o.•�GwyM,- Town C:lerk South County Council of Governments P.O. Stanley Weaver, please accept our assurances that the South County Council of Governments is alive and well and in need of your presence at the meetings. We request that you appoint an alternate to attend the meetings, in the event of an absence by your designee, Mayor Koch. There will be an election held on the first meeting in May, 1987, but until then Mr. Weaver has agreed to remain as Acting Chairman. At the March meeting, we have invited Senator "Doc" Myers to give us the status of pending Legislation that might abolish Special Districts. Mr. Weaver is also inviting a Representative of the Special Districts Association to speak. While it is true that many subjects are discussed by the Palm Beach Municipal League, they do not include representation of these Special Districts, such as the Lake Worth Drainage District, the Southeastern Palm Beach County Hospital Taxing District, the Greater Boca Raton Beach Tax District, nor the County and the School Board. So as long as you have paid your dues for the present Fiscal Year, please do remain in this organization, and please send representatives from your very important Town to the meetings. WHEREAS, recent state laws have caused a reluctance on the part of private insurance companies to write public officials and employees liability insurance. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA that: Section 1. The State Legislature is urged to enact legislation either ensuring the availability of public officials and employees liability insurance or becoming an insurer for a state program covering the liability of municipal officials and employees. Section 2. This Resolution shall take effect upon adoption by the Town Commission of the Town of Gulf Stream, Florida. PASSED AND ADOPTED BY THE TOWN COMMISISON OF THE TOWN OF GULF STREAM, THIS 13 DAY OF February , 1987 MAYOR ATTEST: Town Clerk RESOLUTION NO. 87 -1 A RESOLUTION OF THE TOWN COMMISISON OF THE TOWN OF GULF STREAM, FLORIDA, DECLARING THAT OF THE FIVE COMMISSION SEATS AVAILABLE FOR THE MARCH 10 MUNICIPAL ELECTION THAT ONLY FIVE CANDIDATES FILED FOR SAID SEATS PRIOR TO THE EXPIRATION DATE FOR FILING; DECLARING, AS A RESULT, THAT THERE SHALL BE NO NEED FOR A MUNICIPAL ELECTION ON MARCH 10 AND THEREBY CANCELLING SAID ELECTION. WHEREAS, a proclamation announcing the date of the municipal election of the Town of Gulf Stream for the purpose of electing commissioners to the five commission seats available, was posted and advertised pursuant to law; and WHEREAS, the expiration date for filing for said seats was February 10, 1987; and WHEREAS, of the five commission seats available, only five persons filed to fill said seats; and WHEREAS, since there is no opposition for the seats available, there is no need to hold a municipal election; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, as follows: Section 1. The expiration date for filing for the March 10 municipal election in the Town of Gulf Stream having been February 10, 1987 and only five persons having filed for the five commission seats available, it is hereby declared that there is no need to hold the March 10 municipal election and said election is hereby cancelled. Section 2. The following five persons having filed for the five commission seats available shall, subsequent to March 10, 1987, pursuant to the terms of the Charter and Ordinances of the Town of Gulf Stream assume the offices of Commissioners of the Town of Gulf Stream: a. William F. Koch, Jr. b. Allen I. Armour C. James E. Cross d. James T. Skelly, Jr. e. Lawrence Stahl Section 3. A copy of this Resolution shall be provided to the Supervisor of Elections of Palm Beach County, Florida. PASSED AND ADOPTED in a regular, adjourned session assembled this 13 day of February , 1987.
