Koch, who presided at the meeting. 1. Roll Call Present: Also present: William F. Koch Alan T. Armour James E. Cross Robert J. Dixson Brian J. Minutes Ccnmdssioner Dixson said his recollection of the discussion suggested the following amendments to the Minutes of the February 13, 1987 meeting as follows:1lTO Item No. 6 - After full discussion of the two incidents involving the Kenny and Evans emergency calls, it was resolved as follows: 1. Both Messrs. Kenny and Evans are obligated to pay the full charges for the services of the Delray Beach Emergency Service. This resolution was duly made and seconded and adopted on a four to one vote. 2. It was further resolved that the Police Chief or his representative would meet with representatives of the Delray Beach Emergency Service for the purpose of defining precisely the nature of the services and the reason Fire equipment of the Delray Beach Police responded to emergency calls in the Town of Gulf Stream. 3. It was further resolved that an appropriate instruction letter would be issued to the residents of Gulf Stream for the purpose of informing those who may call for such emergency service, the proper procedure to follow and possibly to avoid the double and over- lapping charge of Delray Beach Fire Rescue Services and Bethesda Memorial Hospital. Town Commission Meeting Minutes March 13, 1987 Page Two The following to be added to Item No. 7 and the action taken by the Town Commission as stated therein: However, it should be understood that tabling such request should not be construed as a final and permanent rejection of the need for two large flags, one for the Council Chamber to be used in place of the State flag and another to be used for the same purpose in the lobby of the Police Department building. Further, the proposal should be reduced to these two flags only and six 3 x 5 flags for display on the Town flagpole. There is, in fact, no need for the Town's personal insignia to be included in the proposal submitted. It should be eliminated from any future submission for price. The price quoted can be reduced considerably from other sources." The above amendment and addition, on motion duly made and seconded were approved by the Commission. 3. Financial Report on motion duly made and seconded the Commission approved the Financial Report given by Town Manager, William Gwvnn, copy of which is annexed hereto. 4. Police Report Chief Greer reported the activities of his department during the previous month. Ballantrae again requested the services of the Gulf Stream Police Department. Chief Greer was instructed to formally reply to Ballantrae that the position taken by the Commission at the February 13, 1987 meeting stands. Discussion ensued on the Delray Beach Emergency Rescue Service. Chief Greer will send the letter mentioned in Item 6 above to the residents of the Town of Gulf Stream during the coming week. 5. Code Enforcement Mr. Sessa reported on the status of building activity noting no problems at this time. Complaints of traffic on a private road were noted but the Town has no authority to stop such traffic. The Town will enforce the sign Ordinance. 6. Planning and Zoning Mr. Mayer, Chairman of the Planning and Zoning Board reported on the variance requested by Mr. and Mrs. William Farish, owners of Lot 2, Ydm. H. Evans subdivision, to construct a single family residence. Noting no objection by neighbors, builder agreement of setback requirements and restrictions on air conditioner setback, the Commission, on motion duly made and seconded approved said request on condition of Unity of Title. Town Commission Meeting Minutes March 13, 1987 Page Three 7. COm4nission Comments Mr. Mayer recommended the appointment of Joan Orthwein and William Lynch to the Planning and Zoning Board. On motion duly made and seconded, the Commission approved the appointments. Mr. Randolph commented on inquiries made in the Florida Legislature by Mr. Reed, attorney for Delray Beach Drive -In, regarding the de- annexation proposal. Mr. Randolph has written to each member of the Legislature from this area advising them of the Town's position in this matter and also advising them that we have litigation pending in opposition to de- annexation, and requesting them to let us know if they are approached on this matter. Discussion followed on control over the F.I.N.D. property with the Cc =ission suggesting the Town keep a record of what we do in that area. Mr. Randolph will obtain a copy of the F.I.N.D. lease. Mr. Gwynn read a letter from the Town of Ocean Ridge relative to sand transfer. In support of the Ocean Ridge position the Commissioners approved Town of Gulf Stream Resolution No. 87 -4 copy of which is annexed hereto. Mr. Gwynn read the Title of said Resolution as follows: A RESOLUTION OF THE TOWN OF GULF STREAM URGING THE SOUTH LAKE WORTH INLET CON�SSION AND THE PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS TO COMPLY WITH THE REQUEST OF UIE TOWN OF OCEAN RIDGE TO PROVIDE INCREASED SAND TRANSFER TO THE DOWNDRIFT SIDE OF THE SOUTH LAKE WORTH INLET AND TO RECONSIDER TEE POSITION PREVIOUSLY TAKEN ON RESOLVING THE SAND DEPRIVATIO14 FOR OCEANFRONT MUNICIPALITIES SOUTH OF THE SOUTH LAKE WORK INLET, FOR AN EFFECTIVE DATE AND OTHER PURPOSES. Mr. Gwynn read a report from the Florida Dept. of Natural Resources on beach erosion and renourishment of beaches. No action taken. Mayor Koch presented plaques to retiring Commission members Robert Dixson and Brian Pfeifler in token of their service to the Town of Gulf Stream. Messrs. Dixson and Pfeifler responded. Skelly, Jr., to the Town Commission. The Oath of Office was read by Town Manager William Gwynn. All current Conmiissioners took the Oath of Office along with Mr. Skelly. The Canmissioners then elected William F. Koch as Mayor and Alan T. Armour as Vice - Mayor. Many of our resi- dents are members of Gulf Stream's prestigious Clubs. Some of our residents formerly lived in Gulf Stream but since have given up private homes for the more carefree condominium lifestyle. our residents would like a higher level of police protection than the County Sheriffs office provides. Ballantrae would like to contract with the Town of Gulf Stream for police protection. Perhaps we would only need your service in a "standby" capacity until the Palm Beach County Sheriff arrives. GWYNN Assistant Town Manager-Town Clerk BARBARA GWYNN Chat of Police JAMES GREEK WHEREAS, the Town Charter of the Town of Gulf Stream adopted 3/11/80, requires a Town Election to be held on the SECOND TUESDAY in March, 1987, which is March 10, 1987. 1. An election is hereby called to be held on Tuesday March 10, 1987 for the purpose of electing five (5) Town Commissioners who shall hold office for a term of three (3) years beginning on the 2nd Tuesday of said month of March, 1987. J1 2. The election shall be held in the Town Hall of the Town of Gulf Stream, Florida, located at 100 Sea Road in Gulf Stream and the polling place shall be open between the hours of 7:00 o'clock A.M. and 7:00 o'clock P.M., Eastern Standard Time. 3. Only qualified, registered voters of the Town of Gulf Stream shall be allowed to vote in this election. 4. Any person who desires to have his or her name placed upon the official ballot shall file with the Town Clerk, no later than February 10, 1987 at 12 o'clock noon. A petition signed by at least (4) qualified electors of the Town of Gulf Stream requesting such person to become a candidate for such office. 5. Farish property are as follows: Special conditions and circumstances exist which are peculiar to this parcel of land which are not the result of actions of Mr. and Mrs. Farish. This lot is a long, narrow piece of land stretching f-rom State Road A -1 -A on the West to the beach on the East. The .length of the lot from East to West is approximately 439 feet, and its frontage on the West is approximately 101 feet. The parcel lies in .a*- single- family residential district ( "RS ") which requires a minimum front yard depth of 25 feet or 25 per cent of lot depth, whichever is greater. It also requires that the setback distance (along A -1 -A right -of -way) shall be at least 78 feet from the centerline of said right -of -way. If the requested variance were not granted, the property owner would be obligated to set back approximately 109 feet from the West property line. The requested variance would allow a front setback of 15 per cent of the lot depth, which is equal to a setback of 66 feet from the West property line. Such a 66 -foot setback would be 96 feet from the centerline of State Road A -1 -A, well beyond the 78 -foot minimum suggested in the zoning ordinance. The variance requested is the minimum which will make possible the reasonable use of the land as set forth on the plot plan of the proposed construction of garage and residential dwelling. The sand transfer plant located on the jetty is supposed to mitigate this problem. The plant pumps approximately 40,000 to 60,000 cubic yards of sand annually while the estimated natural flow is in the 150,000- 250,000 cubic yard range. This shortfall in sand transfer (over many years) is causing severe beach erosion in Ocean Ridge and the communities to the south including your beaches. The Town of Ocean Ridge will file suit against Palm Beach County and the South Lake Worth Inlet District to rectify the problem.
